- NONCONFORMING USES
Nonconforming uses are declared by this ordinance to be incompatible with permitted uses in the districts involved.
To avoid undue hardship, the lawful use of any building or land at the time of the enactment of this ordinance may be continued, even though such use does not conform to the provisions of this ordinance.
The nonconforming building or land use shall not be changed to another nonconforming use.
The nonconforming building or land use shall not be reestablished after discontinuance for one year or more.
A lawful nonconforming use may be continued into any new building erected on that lot.
A lawful nonconforming use may be continued onto an adjoining lot if a variance is provided.
Any new structure and alterations, extensions, or additions to existing structures shall conform to all the height, area, width, yard and coverage requirements for the district in which the lot is located.
A nonconforming building, which has been damaged or destroyed, may be reconstructed and used for the same nonconforming use.
Reconstruction shall start within two years from the date the building was damaged or destroyed.
Reconstruction shall be carried on without interruption.
If the original building did not meet any of the required height, area, width, yard and coverage dimensions, the reconstructed building can use the original building's dimension.
Under extenuating circumstances, the owner may appeal to the board of zoning appeals for an extension to the two-year period.
Nothing in this Article shall be deemed to prevent the strengthening or restoring to a safe condition any building or part thereof declared to be unsafe by any official charged with protecting the public safety or health, upon order of such official.
Signs existing and in place at the time of enactment of Section 7.01 which is not in compliance with the requirements of this ordinance are nonconforming signs.
Nonconforming signs existing on that date shall be exempt from fees or the requirement to apply for a permit.
However, any temporary or portable sign existing at that time shall be considered a nonconforming sign only for ninety (90) days. After that period, it shall be removed.
If nonconforming sign is replaced or renovated, the resulting sign must comply with the requirements of this ordinance. "Renovated" in this sentence means drastically, physically altered. Normal maintenance (such as painting) does not change the status of the sign.
If a nonconforming sign is replaced with a sign in conformance with this ordinance, the fees for a sign permit on the replacement sign will be waived.
Nonconforming signs shall be kept in the same manner of maintenance and repair as conforming signs. A nonconforming sign declared unsafe by the building inspector shall, be removed.
