ARTICLE I

General Provisions

§ 275-1 Short title.

This chapter shall be known as and may be cited as the "Middletown Township Zoning Ordinance of 2025," as amended.

§ 275-2 Authority and purpose.

A. 
This chapter is enacted under and pursuant to the PA Municipalities Planning Code, Act 247 of 1968, as amended,[1] to maintain and enhance the character of the Township and the suitability of its various parts for particular uses, buildings, and structures in order:
(1) 
To promote, protect and facilitate public health, safety, and general welfare, coordinated and practical community development, appropriate population densities, emergency management preparedness and operations, airports and national defense facilities, provision of adequate light and air, access to incident solar energy, police protection, adequate vehicle parking and loading space, transportation, water, sewerage, schools, recreational facilities, public grounds, provision of a safe, reliable, and adequate water supply for domestic, commercial, agricultural or industrial use, and other public requirements, preservation of natural, scenic, historic features, forests, wetlands, aquifers, and floodplains.
(2) 
To prevent blight, danger and congestion in travel and transportation, threats to health, life or property from fire, flood or other dangers.
(3) 
To require that development and land use reflect appropriate use of the topography, soils and other natural features.
(4) 
To provide for the use of land within the Township for residential housing of various dwelling types encompassing all basic forms of housing.
(5) 
To respect the carrying capacity of land and site constraints and accommodate reasonable overall community growth and provide opportunities for development of a variety of residential dwelling types and nonresidential uses.
(6) 
To prevent inappropriate use and development of scenic and natural resources such as floodplains, wetlands, aquifers, steep slopes and forests.
(7) 
To encourage the preservation of historic and cultural resources.
(8) 
To encourage the preservation of prime agricultural and farmland and open spaces.

§ 275-3 Establishment and scope of controls.

Act 247 grants local municipalities the power to enact, amend, and repeal zoning chapters. Middletown Township has enacted this chapter in accordance with the provisions of Act 247, establishing the following controls:
A. 
Land shall be developed, used, or occupied, and structures shall be constructed, altered, used, or occupied in accordance with the provisions of this chapter.
B. 
Uniform regulations. The provisions established by this chapter within each zoning district shall apply uniformly to each class or type of structure or land.
C. 
New uses and structures. Following the effective date of this chapter, any new building or other structure or any tract of land shall be developed, constructed, occupied, and used in accordance with the provisions of this chapter and other chapters, as applicable.
D. 
Existing uses, structures, lots, or signs. Following the effective date of this chapter, any existing use, structure, lot, or sign that is not in conformity with the provisions of this chapter shall be deemed nonconforming and subject to § 275-129, Nonconformities.

§ 275-4 Community development objectives.

A. 
This chapter is enacted to implement the purposes of § 275-2, Middletown Township Comprehensive Plan policies, and other applicable codes, chapters, plans, or studies of the Township.
(1) 
Retain and enhance the traditional suburban community identity and quality of life. Maintain a balance between the accommodation of change and development with the ability of the land to sustain new uses and the conservation of resources to preserve the suburban character and protect the health, safety, and welfare of current and future residents.
(2) 
Plan for the present and future housing needs of residents that reflects the existing community character. Maintain and promote attractive, safe, healthy and stable residential areas and to enhance and encourage rehabilitation of existing neighborhoods.
(3) 
Provide for appropriate and adequate community services and facilities with respect to the natural constraints of the land and within practical fiscal limitations to meet the needs of current and future Township residents and businesses.
(4) 
Plan for safe, effective, and diversified transportation, circulation, screening, parking and related needs while protecting community-defining characteristics.
(5) 
Promote complementary land uses to maintain a unified character, direct growth to appropriate areas, and minimize traffic, noise and visual conflicts.
(6) 
Protect natural and cultural resources to sustain ecosystems and protect public health and quality of life.
(7) 
Encourage the provision and preservation of usable and functional open spaces areas: to aid in natural and cultural resource protection; to provide increased opportunities for recreational use and activities; to create visual buffers and to promote high-quality design and land development.
(8) 
Encourage safe and convenient access throughout the Township: to help ensure the compatibility of major roads, residential streets, parking areas and driveways for existing and planned uses; and to promote the safe and efficient movement of people and goods.
(9) 
To require that all development and uses have the necessary utility systems and infrastructure such as public water, public sewer, storm sewers, permanent erosion and sedimentation control structures and other facilities.
(10) 
Continue to maintain, enhance, and expand parks and recreational facilities to meet the needs of current and future residents of the Township.
(11) 
Encourage energy conservation and the effective utilization of renewable energy resources to reduce environmental impacts and reduce energy costs.
(12) 
Encourage cooperation with surrounding municipalities and regional planning to achieve mutually beneficial goals for the Township and region.

§ 275-5 Conflict.

It is not intended by this chapter to repeal, abrogate, annul, or interfere with any existing ordinance, or any statue, rule, regulation, or permit adopted or issued thereunder, provided the same is not inconsistent or in conflict with any provision of this chapter. Where this chapter imposes greater restrictions on the use of structures or land, height or bulk of structures and of lots, prescribes larger open spaces or parklands, or other applicable provisions, the provisions of this chapter shall control.

§ 275-6 Interpretation; when effective.

A. 
Chapter provisions shall be interpreted, applied, and administered in such a manner as to facilitate attainment of the purpose of this chapter in § 275-2 and objectives of this chapter in § 275-4.
B. 
This chapter shall become effective upon the 31st day following enactment.

§ 275-7 Validity and severability.

Should any section of provisions of this chapter be declared by a court of competent jurisdiction to be invalid, such decision shall not affect the validity of this chapter as a whole or in part.

§ 275-8 Repealer.

The "Middletown Township Ordinance of 1986, as amended" is hereby repealed and replaced by the provisions of the "Middletown Township Zoning Ordinance of 2025, as amended."
