SECTION 300

08. CERTIFICATES OF OCCUPANCY.

1. Certificate Required.

It shall be unlawful to use, occupy, or permit the use or occupancy of any building or portion of building constructed, erected, enlarged, altered, converted or moved onto a lot within the city until a certificate of occupancy has been issued.

2. Application.

Application for a certificate of occupancy shall be made on forms provided by the city.

3. Issuance.

A certificate of occupancy shall be issued within 10 days of completion of the building but only upon demonstration that the building and use are in conformance with all requirements of the code of city ordinances and that all conditions of approval have been met. A record shall be kept of all certificates issued.

4. Temporary Certificates.

A temporary certificate of occupancy may be issued for a period not to exceed six months. Additionally, one extension of a temporary certificate of occupancy for a period not to exceed six months may be authorized. Conditions may be imposed on the issuance of a temporary certificate of occupancy in order to ensure compliance with this ordinance, including posting financial security acceptable to the city. Issuance of a temporary certificate will not alter the rights or obligations of the owner, tenant or city with respect to full compliance with the requirements of this ordinance or other provisions of the code of city ordinances.

5. Non-conforming Uses.

A certificate of occupancy shall be required for all non-conforming uses or buildings. The certificate issued for non-conforming uses or buildings shall state the manner and extent to which the requirements of this ordinance are not met.

6. Revocation.

A certificate of occupancy may be revoked if the building or use is no longer in compliance with this ordinance. The procedure for revocation shall be the same as that for licenses specified in section 700.035 of the code of city ordinances. The city shall have authority to enforce the revocation of the certificate of occupancy by appropriate means. Upon revocation the building shall not be used for any purpose until issuance of a new certificate of occupancy.
