CHAPTER 6

RESIDENCE DISTRICTS

5-6-1: PREAMBLE:

The regulations for residence districts are designed to conserve existing residential areas and to regulate the efficient use and orderly development of vacant land designated for residential uses. It is essential that areas be designated and regulations imposed for the various kinds of residential developments in order that the village and other governing bodies can plan ahead for services, future schools, parks, streets and utilities. 5-6-2: GENERAL PROVISIONS:

Unless otherwise provided in the regulations of this title, the following provisions shall apply to all residence districts: (Ord. 1996-33, 12-10-1996)
   A.   Signs: Sign regulations shall be as set forth in chapter 13 of this title. (Ord. 1998-1, 1-13-1998)
   B.   Home Occupations: In all residence districts, any customary home occupation shall be permitted, provided:
      1.   It is conducted entirely within the dwelling and only by members of the family residing in the dwelling, and when such home occupation is incidental and secondary to the use of the dwelling purpose.
      2.   It is not conducted from a detached or attached accessory building or does not require internal or external alteration, or involve construction features or use of equipment not customary in a dwelling, and the entrance to the space devoted to such occupation shall be from within the dwelling and not more than one-fourth (1/4) of the floor area of a story (including also a cellar of the dwelling) shall be devoted to such home occupation.
      3.   There is no display or activity that will indicate from the interior of a dwelling that is being used for any use other than a dwelling, except one nameplate, no more than one square foot in area which contains only the name of the occupant of the dwelling and the home occupation conducted therein and is attached to the dwelling and not illuminated shall be permitted.
      4.   No mechanical equipment is used, except such as is customarily used for purely domestic or household purposes.
      5.   Stock in trade, including that which is produced on the premises, shall not require receipt or delivery of merchandise, goods or equipment by other than United States letter carrier mail, similar parcel delivery service or by private passenger automobile.
      6.   A home occupation conducted by a professional person shall be only for consultation or performance of religious rites, but not for the general practice of the professional.
   C.   Temporary Buildings: In all residence districts, temporary buildings for construction purposes are for a period not to exceed such construction.
   D.   Accessory Uses: In all residence districts, accessory uses, buildings or other structures customarily incidental to and commonly associated with a principal or conditional use may be permitted provided that they are operated and maintained under the same ownership and on the same lot as the permitted use and do not involve the conduct of any business, trade or industry.
   E.   Off Street Parking And Loading: In all residence districts, off street parking and loading is permitted in accordance with the regulations set forth in chapter 9 of this title. (Ord. 1996-33, 12-10-1996)

5-6-3: R1 SINGLE-FAMILY DETACHED RESIDENCE DISTRICT:

   A.   Permitted Uses:
   Accessory poultry husbandry, subject to the requirements of subsection 5-3-7B of this title.
   Agriculture on a tract of land twenty (20) acres or more in area.
   Parks, forest preserves and recreational areas, when publicly owned and operated.
   Single-family detached dwellings.
   B.   Conditional Permitted Uses:
   Cemeteries on a lot not less than ten (10) acres in area and provided no building shall be located less than three hundred feet (300') from a lot line.
   Churches, temples, synagogues or other places of religious worship on a lot not less than two (2) acres in area.
   Colleges, universities and accessory uses thereto, provided on a lot not less than forty (40) acres in size.
   Community parks, recreational facilities, and amenities, when approved as part of a planned unit development.
   Golf courses, public or private, but not including par 3 courses, commercially operated driving ranges or miniature golf courses; and provided that no clubhouse or accessory building shall be located less than two hundred feet (200') from a property line.
   Hospitals.
   Planned unit developments.
   Public libraries on lots having areas, widths, yards and other conditions as approved by the village board.
   Public utility and governmental service uses on lots having areas, widths, yards and other conditions as approved by the village board, including, but not limited to:
      Electrical substations and booster stations.
      Filtration plant, pumping station, well and water reservoir.
      Police and fire station.
      Sewage treatment plant.
      Telephone exchange and microwave relay tower.
      Other government and utility uses.
   Schools, public or private, elementary, junior high or high.
   C.   Site And Structure Requirements:

5-6-6: R3 SINGLE-FAMILY ATTACHED AND MULTIPLE-FAMILY RESIDENCE DISTRICT:

There shall be no application for any zoning map amendment to the R3 zoning district after December 10, 1996. No land annexed into the village after December 10, 1996, shall be zoned for the R3 district.
   A.   Permitted Uses:
   Any of the permitted uses in the R2 single-family residence district.
   Multiple-family dwellings, provided that the minimum gross area of the development is one acre.
   Single-family attached dwellings.
   Single-family attached dwellings but not more than six (6) such dwellings in addition to the two (2) single-family semidetached dwellings shall be contained within a detached building.
   Two-family detached dwellings.
   B.   Conditional Permitted Uses:
   Any of the conditional permitted uses permitted in the R2 single-family residence district.
   Mobile home parks on a lot not less than ten (10) acres in area, and each mobile home site shall have a minimum area of four thousand five hundred (4,500) square feet and a width of not less than fifty feet (50'). The mobile home park shall have front, side and rear yards having a depth or width of no less than forty feet (40'), and containing no obstructions except trees and shrubs. Municipal type sanitary sewerage, storm sewers and water systems; paved service drives, off street parking of no less than one and one-half (1 1/2) spaces for each mobile home; grading and landscaping; building containing recreational, laundry and office facilities; and other improvements shall be constructed in accordance with the development plans and specifications approved by the planning and zoning commission.
   Tourist homes not having more than five (5) rooms for transient guests, on a lot not less than one acre in area.
   C.   Lot Area Per Dwelling:
      1.   Single-family detached dwelling, not less than nine thousand six hundred (9,600) square feet.
      2.   Single-family semidetached dwelling, (duplex building), not less than five thousand five hundred (5,500) square feet per dwelling unit.
      3.   Single-family semidetached dwelling having a party wall common with a single-family attached dwelling, single-family attached dwelling and multiple-family dwelling as follows:

   D.   Lot Width:
      1.   Single-family detached dwelling, not less than eighty feet (80').
      2.   Two-family detached dwelling, not less than eighty feet (80').
      3.   Single-family semidetached dwelling (duplex building), not less than seventy feet (70') and not less than thirty five feet (35') for each dwelling.
      4.   Two (2) single-family semidetached dwellings and one single-family attached dwelling (row house building), not less than eighty eight feet (88'), plus not less than twenty feet (20') of additional lot width for each additional single- family attached dwelling in a building.
      5.    Multiple-family dwelling, not less than one hundred feet (100').
   E.   Floor Area Ratio:
      1.   Single-family detached dwelling, not applicable.
      2.   Multiple-family dwelling and nonresidential uses:
         a.   For one-story structures, not more than 0.3; and
         b.   For structures having two (2) stories or more, not more than 0.5.
   F.   Building Height:
      1.   Single-family detached, attached and semidetached dwellings and permitted nonresidential buildings and structures, as in the R1 district.
      2.   Two-family detached dwellings shall not exceed a height of two (2) stories or thirty feet (30'), whichever is lower.
      3.   All other dwelling types, not more than two (2) stories or thirty feet (30'), whichever is lower.
   G.   Ground Floor Area Per Single-Family Dwelling: As in the R2 district.
   H.   Yards: Except as may be herein otherwise required, yards shall be in accordance with the following regulations:
      1.   For Single-Family Detached Dwellings:
         a.   Front Yard: Not less than twenty five feet (25'); provided, that in any block in the village which is developed with buildings erected prior to the adoption of these regulations having front yards, the building setback shall conform to the adjacent building setbacks and shall not be required to be set back twenty five feet (25').
         b.   Side Yards: A side yard on each side of the zoning lot of not less than ten percent (10%) of the lot width except where a side yard adjoins a street, the minimum width shall be not less than twenty five feet (25').
         c.   Rear Yard: Not less than twenty five feet (25').
      2.   For Two-Family Detached Dwellings:
         a.   Front Yard: Not less than twenty five feet (25'); provided, that in any block in the village which is developed with buildings erected prior to the adoption of these regulations having front yards, the building setback shall conform to the adjacent setbacks and shall not be required to be set back twenty five feet (25').
         b.   Side Yards: A side yard on each side of the zoning lot of not less than ten percent (10%) of the lot, except where a side yard adjoins a street, the minimum width shall be not less than twenty five feet (25').
         c.   Rear Yard: Not less than thirty feet (30').
      3.   For Multiple-Family Dwellings:
         a.   Front Yard: Not less than twenty five feet (25'); provided, that in any block in the village which is developed with buildings erected prior to the adoption of these regulations having front yard, the building setback shall conform to the adjacent building setbacks and shall not be required to be set back twenty five feet (25').
         b.   Side Yards: Two (2) side yards each not less than twelve feet (12') in depth, except a side yard adjoining a street shall not be less than twenty five feet (25') in depth and for structures more than thirty feet (30') in length, measured perpendicular to the front lot line, an interior side yard shall be increased in depth by one-half foot (1/2') for each foot the building exceeds thirty feet (30') in length.
         c.   Rear Yard: Not less than forty feet (40').
      4.   For Single-Family Semidetached Dwellings:
         a.   Front Yard: Not less than twenty five feet (25'); provided, that in any block in the village which is developed with buildings erected prior to the adoption of these regulations having front yards, the building setback shall conform to the adjacent building setbacks and shall not be required to be set back twenty five feet (25').
         b.   Side Yards: One yard but not less than ten feet (10') in width, except a side yard adjoining a street shall not be less than twenty five feet (25').
         c.   Rear Yard: Not less than forty feet (40').
      5.   For Single-Family Attached Dwellings;
         a.   Front Yard: Not less than twenty five feet (25'); provided, that in any block in the village which is developed with buildings erected prior to the adoption of these regulations having front yards, the building setback shall conform to the adjacent building setbacks and shall not be required to be set back twenty five feet (25').
         b.   Side Yards: Not applicable.
         c.   Rear Yards: Not less than forty feet (40').
   I.   Spacing Between Structures: When two (2) or more structures which contain single-family detached dwellings, single-family attached dwellings, single-family semi-detached dwellings or two (2) or more multiple-family dwelling structures, or combinations thereof are on a lot or on contiguous lots comprising a unified development under the same ownership or control, the distance between the structure walls shall be as follows:
      1.   When the front wall of a structure faces the front wall or rear wall of the nearest structure, the distance between the two (2) structure walls shall be not less than sixty feet (60').
      2.   When the rear wall of a structure faces the rear wall of the nearest structure, the distance between the two (2) structure walls shall be not less than fifty feet (50').
      3.   When the side wall of a structure faces the front or rear wall of the nearest structure, the distance between the two (2) structure walls shall be not less than forty feet (40'), except when the side wall contains more than two (2) windows on a floor that are not from bathrooms or storage rooms, such distance between structures shall be not less than fifty feet (50'), or sixty feet (60') if a main entrance doorway is in such side wall.
      4.   When the side wall of a structure faces the side wall of the nearest structure, the distance between the two (2) structure walls shall be not less than twenty feet (20'), except when facing side walls of either of such structures contain more than two (2) windows on a floor that are not from bathrooms or storage rooms, such distance between the two (2) structures shall be not less than fifty feet (50'), or sixty feet (60') if a main entrance doorway is in such side wall.
      5.   A wall of a structure forming the end of a court shall be not less than ten feet (10') from the nearest wall of a structure forming the sides of the court, and a structure forming the end of the court may be attached to one or both of the structures forming the sides of the court, providing the distance between facing walls of the structures forming the sides of the court is not less than the applicable requirements as set forth above.
      6.   Where structures are not parallel to each other the required spacing shall be measured at the midpoint of the distance along which they face each other, however, the spacing between the structures at the narrowest point shall in no event be less than one-half (1/2) the required distance. 5-6-7: R4 TWO-FAMILY (DUPLEX) RESIDENCE DISTRICT:

There shall be no application for any zoning map amendment to the R4 zoning district after August 26, 2003. No land annexed into the village after August 26, 2003, shall be zoned for the R4 district. (Ord. 2003-34, 8-26-2003)

5-6-8: R4A TWO-FAMILY (DUPLEX) RESIDENCE DISTRICT:

   A.   Permitted Uses:

      Two-family dwellings.
   B.   Conditional Permitted Uses:
      As in the R1 district.
   C.   Site And Structure Requirements:

   A.   Permitted Uses: The following uses are permitted independently or collectively in the R5 district provided that they are planned so as to create a cohesive and unified development. All R5 residential developments must be planned unit developments planned and approved in conformance with title 6, chapter 7 of this code:
   Single-family attached dwellings.
   Single-family detached dwellings.
   Two-family dwellings.
   The following uses are permitted in the R5 district as part of a planned unit development or may, if they are the sole use of the property, be permitted without need of a planned unit development:
   Parks, forest preserves and recreational areas, when publicly owned and operated.
   B.   Conditional Permitted Uses:
   As in the R1 district.
   C.   Site And Structure Requirements:

   A.   Permitted Uses: The following uses are permitted independently or collectively in the R6 district provided that they are planned so as to create a cohesive and unified development.    Single-family attached dwellings.
   Single-family detached dwellings.

      9.   Spacing Between Buildings: When two (2) or more structures which contain attached single-family or multiple-family dwellings, or combinations thereof, are on a lot or on contiguous lots comprising a unified development under the same ownership or control, the distance between the exterior structure walls shall be as follows:
         a.   When the front wall of a structure faces any wall of another structure, the distance between the two (2) structure walls shall be not less than sixty feet (60').
         b.   When the rear wall of a structure faces the rear wall of the nearest structure, the distance between the two (2) structure walls shall not be less than fifty feet (50').
         c.   When the side wall of a structure faces the side wall of the nearest structure, the distance between the two (2) structure walls shall not be less than twenty feet (20').
         d.   Where structures are not parallel to each other, the required spacing shall be measured at the midpoint of the distance along which they face each other; however, the spacing between the structures at the narrowest point shall in no event be less than one-half (1/2) the required distance.
