CHAPTER 7

BUSINESS DISTRICTS

5-7-1: PREAMBLE:

Business district regulations are intended to govern the locations and uses of a full range of business and commercial establishments needed to serve the citizens of the village and its trade area. The regulations of the various business districts are designed to provide for groupings of business and commercial establishments that are compatible in scope of services and method of operations. 5-7-2: GENERAL PROVISIONS:

Unless otherwise provided in the regulations of this title, the following provisions shall apply to all business districts:
   A.   Dwelling Units: Dwelling units and lodging rooms are not permitted on the ground floor level in any business district except in a permitted hotel, motel or as a nonconforming use existing on the effective date hereof. (Ord., 5-15-1974)
   B.   Enclosure Of Operations: All business servicing or processing shall be conducted within completely enclosed buildings except:
      1.   Off street parking or off street loading;
      2.   Drive-in type of operations when conducted as a conditional permitted use in the B2 commercial district;
      3.   Open sales and rental lots when operated as a use in the B2 commercial district; and
      4.   Truck and boat storage, building material storage, and landscaping materials such as landscaping rocks and bulk wood chips for sale at greenhouses, garden centers and nurseries, when operated as a use in the B2 commercial district. Provided, that the area for storage shall be completely surrounded by a uniformly painted solid fence or wall not over eight feet (8') in height and no storage shall project higher than the height of the fence or wall.    C.   Performance Standards: All activities shall conform with the performance standards established for the M1 manufacturing district; provided, that performance standards shall in every case be applied at the boundaries of the lot on which any such activities take place.
   D.   Parking Limitations: Parking of trucks when accessory to the conduct of a permitted use shall be limited to vehicles having not over one and one-half (11/2) tons' capacity, except for pick up or delivery services during normal business hours.
   E.   Scope Of Operations: All business establishments shall be retail trade or service establishments dealing directly with consumers, and all goods produced on the premises shall be sold on the premises where produced except for specific uses in the B2 commercial district where wholesale sales or processing and fabricating are permitted. 5-7-3: B1 BUSINESS DISTRICT:

The B1 business district regulations are designed to accommodate prime retail trade activities of the village and environs significant thereto as designated by the official zoning map. Regulations provide for a wide variety of related shopper type business establishments along with personal service and other complementary uses.
   A.   Permitted Uses:
   Art and school supply stores.
   Art galleries and antique shops.
   Automobile accessory stores.
   Bakeries.
   Banks and financial institutions.
   Barbershops and beauty parlors.
   Book; stationery; and office supply stores.
   Business machine sales and service.
   Camera and photographic supply stores.
   Candy and ice cream stores.
   Catalog sales stores and mail order service stores.
   Catering establishments.
   China and glassware stores.
   Clothing stores.
   Clubs or lodges, when located above the ground floor.
   Coin and philatelic stores.
   Currency exchange.
   Department stores.
   Drugstores.
   Dry cleaning and laundry receiving stations, including self-service coin operated equipment.
   Dry goods stores.
   Flower and gift shops.
   Fraternal, philanthropic and eleemosynary institutions, when located above the ground floor.
   Frozen food stores, including locker rental in conjunction therewith.
   Furniture stores, including upholstering when conducted as part of the retail operations and secondary to the principal use.
   Furrier shops, including the incidental storage and conditioning of furs.
   Garden supply store with no outdoor storage or display of merchandise.
   Grocery stores, supermarkets, meat and fish markets and delicatessens.
   Hardware stores, retail and wholesale.
   Hobby shops.
   Household appliance stores, including radio and television sales with incidental repair facilities.
   Interior decorating shops, including upholstery and making of draperies, slipcovers and other similar articles when conducted as part of the retail operations and secondary to the principal use.
   Jewelry stores.
   Laboratories, medical, dental or optical, when located above the first story or as accessory to a principal use occupying the first story.
   Leather goods and luggage stores.
   Libraries, public and private.
   Liquor stores, package.
   Loan offices.
   Locksmith shops.
   Magazine and news stores.
   Medical and dental clinics.
   Millinery shops.
   Music stores - phonographs, phonograph records, sheet music, musical instrument sales and repair.
   Newspaper offices, including printing.
   Newsstands.
   Offices, professional or business.
   Paint and wallpaper stores.
   Parks, forest preserves and recreational areas, when publicly owned and operated.
   Pawnshops.
   Pet service, domestic (no overnight boarding).
   Photography studios, including developing and printing of photographs when conducted on the premises as part of the retail business.
   Picture framing.
   Post offices.
   Radio and television broadcasting studios.
   Restaurants, including entertainment, dancing and serving of alcoholic beverages.
   Shoe and hat repair stores.
   Shoe stores.
   Sporting goods stores.
   Tailor shops.
   Taverns.
   Telephone booths, outdoor.
   Theaters.
   Tobacco shops.
   Toy stores.
   Travel bureaus and ticket offices.
   Undertaking establishments and funeral parlors.
   Vending machines.
   Accessory uses customarily incidental to the above permitted uses, including, but not limited to, off street parking, off street loading and business signs as herein regulated and dwelling units or lodging rooms when above the first story.
   B.   Conditional Permitted Uses 1 :
   Other uses similar to permitted uses in this district.
   Animal hospitals, on a lot not less than twenty thousand (20,000) square feet in area.
   Automobile sales establishments for only authorized new passenger automobile sales agencies and accessory open sales lots and public garages (automobile maintenance), provided vehicular access to open sales lots and public garages (automobile maintenance) is from an alley or service drive at the rear lot line.
   Automobile service stations, on a lot not less than ten thousand (10,000) square feet in area.
   Bakeries, including sale of bakery products to restaurants, clubs, hotels, institutions and similar establishments.
   Battery and tire sales and service establishments.
   Catering establishments, when located above the ground floor or not less than fifty feet (50') from the front lot line on the ground floor.
   Commercial Solar Farm (Roof Mounted Only), subject to all rules and regulations of Chapter 15 (Commercial Solar Farms) of this Title.
   Daycare center.
   Drive-in establishments, except theaters.
   Drive-through facilities.
   Dry cleaning and laundry establishments, provided that not more than two thousand five hundred (2,500) square feet of floor area shall be devoted to dry cleaning, pressing or laundering processes other than self-service coin operated facilities.
   Laboratories, medical, dental, optical.
   Medical cannabis cultivation center, provided that: 1) each medical cannabis cultivation center operates in strict conformance with the Compassionate Use of Medical Cannabis Pilot Program Act1. 410 ILCS 130/1 et seq.1, as amended and the regulations promulgated thereunder; and 2) the medical cannabis cultivation center is not located within two thousand five hundred feet (2,500') of the property line of a preexisting public or private preschool or elementary or secondary school; daycare center, daycare home, group daycare home, part day childcare facility; public park; church or other place of worship; or an area zoned for residential use or designated for residential use on the Village's comprehensive plan.
   Medical cannabis dispensing organization, provided that: 1) each medical cannabis dispensing organization operates in strict conformance with the Compassionate Use of Medical Cannabis Pilot Program Act2. 410 ILCS 130/1 et seq.2, as amended and the regulations promulgated thereunder; 2) the medical cannabis dispensing organization is not located within one thousand feet (1,000') of the property line of a preexisting public or private preschool or elementary or secondary school; daycare center, daycare home, group daycare home, part day childcare facility; public park; or church or other place of worship; and 3) drive-throughs are prohibited.
   Meeting halls.
   Nursery school.
   Parking lots or structures, commercial or governmental.
   Parks, forest preserves and recreational areas, when privately owned and operated.
   Pet service, domestic and overnight boarding services.
   Pet shops.
   Plumbing, electrical or heating, fixture and equipment - sales, service and repair establishments.
   Printing, publishing or lithography establishments, maximum gross floor area of six thousand (6,000) square feet.
   Public Garages (Automobile Maintenance).
   Restricted production and repair, limited to the following: needlework; clothing, such as custom manufacturing and alterations; jewelry from precious metals; watches, dentures and optical lenses.
   Schools, commercial or trade, including those teaching music, dancing, business, commercial or technical subjects when operations do not involve danger of fire and explosion, and objectionable noise, vibration, smoke, dust, odor, glare, heat or other similar influences.
   Self-service car washes, coin operated, on a lot not less than twenty thousand (20,000) square feet in area.
   Storage garages (automobile), storage or off street parking lots or structures, commercial or governmental.
   Video gaming cafes.
   C.   Lot Area: Minimum lot area shall be in accordance with bulk and off street parking and loading requirements of the district and as specifically required for a conditional permitted use.
   D.   Yards:
      1.   Front yard: No yard requirements.
      2.   Side yards: No yard requirements, except if a yard is provided, it shall not be less than five feet (5') in width, except where the side lot line adjoins a residence district a side yard not less than ten feet (10') in width shall be provided, and be maintained as a landscaped area.
      3.   Rear yard: No yard requirement, except where the rear lot line adjoins a residence district, a rear yard not less than twenty five feet (25') in depth shall be provided, and be maintained as a landscaped area.
   E.   Floor Area Ratio: Not to exceed 1.0.
   F.   Building Height: No height limitations.
   G.   Signs: Sign regulations shall be as set forth in chapter 13 of this title. (Ord. 1998-1, 1-13-1998)
   H.   Off Street Parking And Off Street Loading: In accordance with regulations set forth in chapter 9 of this title. (Ord., 5-15-1974; amd. 5-7-4: B2 COMMERCIAL DISTRICT:

The B2 Commercial District classification is established to accommodate a wide range of specialized commercial uses including highway oriented service and commercial types of establishments to serve the needs of the motorists. In addition, those shopper and personal service types of business establishments permitted in the B1 District are also permitted uses in the B2 Commercial District. The B2 Commercial Districts may be located adjacent to the B1 Business Districts to form a complete business center, or may be commercial areas consisting entirely of specialized commercial activities.
   A.   Permitted Uses:
   Uses permitted in the B1 District.
   Amusement establishments - bowling alleys, billiard parlors, gymnasiums, swimming pools and clubs and recreation centers containing one or more of the above uses and other recreation uses as approved by the Board of Trustees.
   Auction rooms.
   Automobile and truck sales establishments.
   Automobile service stations.
   Bakeries, including sale of bakery products to restaurants, clubs, hotels, institutions and similar establishments.
   Battery and tire sales and service establishments.
   Boat sales, rentals, storage and repair including sales and service of marine motors, boat parts and accessories and boat fuels.
   Building material sales with outdoor storage.
   Catering establishments.
   Clubs or lodges, private, fraternal or religious.
   Contractors' offices and shops.
   Drive-in establishments, except theaters.
   Dry cleaning and laundry establishments, provided that not more than two thousand five hundred (2,500) square feet of floor area shall be devoted to dry cleaning, pressing or laundering processes other than self-service coin operated facilities.
   Feed fertilizer and seed stores.
   Fraternal, philanthropic and eleemosynary institutions.
   Frozen food lockers.
   Fruit and vegetable stands.
   Fuel and ice retail sales establishments with no outside storage and liquid fuels are stored in underground tanks.
   Greenhouses, garden centers and nurseries, retail and wholesale sales.
   Highway maintenance shops and yards.
   Laboratories, medical, dental, optical.
   Linen, towel or diaper service establishments.
   Live bait stores.
   Machine, sheet metal or welding shops; provided, a building for such a use shall contain not more than five thousand (5,000) square feet of floor area, and operations are within the enclosed building, and glare from welding operations is not visible from outside the building.
   Machinery and equipment sales establishments, construction and agriculture.
   Mail order houses, order and service centers.
   Meat markets, including sale of meats to restaurants, clubs, hotels, institutions and similar establishments.
   Medical and dental clinics.
   Meeting halls, convention or exhibition halls.
   Mobile homes and trailer sales establishments.
   Model homes or garage display and sales.
   Monument sales.
   Motels and hotels.
   Newspaper distribution agencies, for home delivery and retail trade.
   Newspaper offices, including printing.
   Open sales lots.
   Packing and crating establishments.
   Parcel delivery stations.
   Pet service, domestic (no overnight boarding).
   Pet shops.
   Plumbing, electrical or heating, fixture and equipment - sales, service and repair establishments.
   Printing, publishing or lithography establishments, maximum gross floor area of six thousand (6,000) square feet.
   Public garages (automobile maintenance), including painting, body and fender work and motor rebuilding.
   Public utility and governmental service uses.
   Radio and television stations and towers, transmitting and receiving.
   Religious institutions - churches, chapels, temples and synagogues, convents, monasteries and theological schools.
   Research laboratories.
   Restaurants, including entertainment, dancing and serving of alcoholic beverages.
   Schools, commercial or trade, including those teaching music, dancing, business, commercial or technical subjects when operations do not involve danger of fire and explosion, and objectionable noise, vibration, smoke, dust, odor, glare, heat or other similar influences.
   Self-service stores, coin operated vending machines.
   Taverns.
   Taxidermists.
   Temporary buildings for construction purposes for a period not to exceed the duration of construction.
   Training centers, engineering or sales.
   Wholesale and warehouse establishments, except for the sales or storage of flammable liquids, materials or gases, except those that are in the original sealed containers.
   Accessory uses customarily incidental to the above permitted uses including, but not limited to, off street parking, off street loading and signs as herein regulated and dwelling units or lodging rooms customarily accessory to religious institutional uses and clubs and lodges.
   B.   Conditional Permitted Uses1. See section 5-11-9 of this title.1:
   Other uses similar to the above permitted uses.
   Amusement establishments, outdoor - par 3, miniature or pitch and putt golf courses, golf driving ranges and similar recreation facilities, on a lot not less than one acre in area.
   Animal hospitals, on a lot not less than twenty thousand (20,000) square feet in area.
   Athletic fields, stadiums, arenas or recreation buildings.
   Automobile laundries, on a lot not less than twenty thousand (20,000) square feet in area.
   Cartage, express and parcel delivery establishments, not including motor freight terminals, on a lot not less than one acre in area.
   Daycare center.
   Drive-through facilities.
   Medical cannabis cultivation center, provided that: 1) each medical cannabis cultivation center operates in strict conformance with the Compassionate Use of Medical Cannabis Pilot Program Act 1. 410 ILCS 130/1 et seq.1 , as amended and the regulations promulgated thereunder; and 2) the medical cannabis cultivation center is not located within two thousand five hundred feet (2,500') of the property line of a preexisting public or private preschool or elementary or secondary school; daycare center, daycare home, group daycare home, part day childcare facility; public park; church or other place of worship; or an area zoned for residential use or designated for residential use on the Village's comprehensive plan.

   Nursery school.
   Parks, forest preserves and recreational areas, when privately owned and operated.
   Pet service, domestic and overnight boarding services.
   Radio and television towers, receiving or transmitting.
   Railroad rights-of-way.
   Rebound tumbling (trampoline) centers and go-kart tracks.
   Single-family dwellings when designed as an integral part of a building, the principal use of which is a permitted or conditional permitted use, and when occupied by the proprietor of such use.
   Theaters, outdoor, provided that vehicular entrance and exit driveways intersect with a secondary or primary thoroughfare and traffic signal lights or other means of traffic control are provided. Reservoir parking spaces for temporary parking of automobiles of patrons awaiting entrance shall be provided on the lot, in the amount of not less than the number of parking spaces equivalent to ten percent (10%) of the vehicular capacity of the theater. No building or structure shall be located nearer than one hundred feet (100') from a residence district boundary line. Artificial illumination shall be arranged in such a manner that direct rays of light shall not beam upon adjoining properties and streets.
   Video gaming cafes.
   Accessory uses customarily incidental to the above conditional permitted uses including, but not limited to, off street parking, off street loading and signs as herein regulated.
   C.   Lot Area And Lot Width: Except as may herein otherwise be required for a specific permitted or conditional permitted use, not less than fifteen thousand (15,000) square feet in area and one hundred feet (100') in width.
   D.   Yards: No yards are required unless the lot abuts a residential district, and then the following shall apply:
      1.   Front Yard: Not less than forty feet (40').
      2.   Side Yard: Two (2) side yards, neither of which is less than ten feet (10') in width, except: a) a side yard adjoining or across the alley from a residence district shall be not less than twenty feet (20') in width; and b) a side yard adjoining a street shall be not less than forty feet (40') in depth.
      3.   Rear Yard: Not less than forty feet (40').
   E.   Floor Area Ratio: Not to exceed 1.0.
   F.   Signs: Sign regulations shall be as set forth in chapter 13 of this title.
   G.   Off Street Parking And Off Street Loading: In accordance with regulations set forth in chapter 9 of this title.
