2.- PLANNING COMMISSION
(A)
There is hereby created a Planning Commission to consist of either five or seven members appointed from among the qualified electors of the City by a majority vote of the City Council members present. In addition, by a majority vote of the City Council members present, the Council may appoint alternate Planning Commission members who may be called to sit on the Commission and vote as a member thereof on account of the absence of any regular member. Such alternate members shall become voting members in the order of their seniority of appointment as alternates.

Each Planning Commission member except the Chairperson shall receive compensation of $80.00 per month. The Chairperson shall receive compensation of $100.00 per month. Additionally, members may be reimbursed for authorized expenses.

The Planning Commission shall act by majority vote of a quorum present. The Commission shall act to recommend approval, approval with conditions, or denial of the application. A motion to make "no recommendation" shall not be in order; provided however, in the event of a tie vote on a motion to make a recommendation, the result thereby shall be no recommendation. In that event and in the event that the Commission fails to adopt any motion of recommendation, pursuant to Table 1.1 in Chapter 4 of this Title, the application shall move on to the City Council. In the event the application is one for which the Planning Commission is the final decisionmaker, and the Commission fails to adopt any motion, the Commission's decision may nevertheless be appealed to the City Council.

Members of the Planning Commission and alternates, if any, shall serve four-year overlapping terms. Vacancies shall be filled for the remainder of the unexpired term by consent of a majority of the City Council members present. Members of the Planning Commission shall serve at the pleasure of the City Council, and may be removed by majority vote of the City Council members present, with or without cause.

The Planning Commission shall elect from its membership a Chairperson, and their term of office shall be for one year with eligibility for re-election. The Commission shall adopt rules for its own organization and for the transaction of business not in conflict with ordinances or laws. It shall also keep a public record of its proceedings. Meetings may be held monthly or more frequently as the Commission deems it advisable.

(A)
The Commission shall perform the following duties:
(1)
Pursuant to relevant provisions of the City Code, review matters limited to planning, zoning, subdivision, land use and development and make recommendations to the Council for adoption of such amendments.
(2)
Promote public interest and education in planning land use and development matters.
(3)
Participate in the process for the adoption of a Comprehensive and amendments thereto as described in Section 11-2-6.
(4)
Perform other duties as set out in the City Charter and City ordinances or regulations.
(B)
The Planning Commission may recommend to Council for adoption bylaws for the conduct of its business consistent with the City Charter and City ordinances and regulations.

(A)
It is the duty of the Commission to prepare a Comprehensive Plan, parts thereof, and amendments thereto, for the physical development of the City, including any areas outside its boundaries, subject to the approval of the County for unincorporated lands, which in the judgment of the Commission bear a relationship to the planning for the City.
(B)
The elements of the Comprehensive Plan may be adopted separately, and may include, but are not limited to, the following:
(1)
Plans for physical improvements, public projects and facilities;
(2)
A major street plan;
(3)
A land use plan;
(4)
Detailed goals, objectives, guidelines, policies, and implementation steps;
(5)
Other plans related to development, land use and environmental protection.
(C)
The Comprehensive Plan shall include a recreational and tourism uses element as required by C.R.S. § 31-23-206(5).
(D)
The Comprehensive Plan shall be made with the general purpose of guiding and accomplishing the coordinated and harmonious development of the City and its environs which will, in accordance with present and future needs, promote the health, safety, morals, order, convenience, prosperity, and general welfare, as well as efficiency and economy in the process of development, including, among other things, adequate provision for traffic, the promotion of safety from fire, flood waters and other dangers, adequate provision for light and air, the promotion of healthful and convenient distribution of population, the promotion of good civic design and arrangement, wise and efficient expenditure of public funds, the promotion of energy conservation, and the adequate provision of public utilities and other public requirements.
(E)
Prior to adoption of the Comprehensive Plan or any element thereof, and after receipt of the Commission's recommendation, the City Council shall hold a public hearing with prior published notice thereof.
(F)
Following adoption, the Comprehensive Plan and elements thereof shall serve as a guide to the City Council and City Manager, and shall have such legal status as may be provided by ordinance.
