This chapter may be amended in accordance with the applicable procedures of the Pennsylvania Municipalities Code, as amended.

In the event any Owner or Owners of property petition for supplementing or changing the district boundaries or regulations established in this chapter, the Zoning Officer shall collect fees prior to such petition being heard by the Commission, as established by the Commission, for the payment of the costs of advertising the notice of hearing in such case and the cost of preparation of the proposed amendment.

The Commission shall determine by Resolution a schedule of fees, charges, and expenses, as well as a collection procedure for permits, Variances, Special Exceptions, Conditional Uses, amendments, and other matters pertaining to this Chapter. Said schedule of fees shall be posted in the Offices of the Secretary and the Zoning Officer.

The Commission shall be empowered to re-evaluate the fee schedule from time to time to make necessary Alterations to it. Such Alterations shall not be considered an amendment to this chapter and may be adopted at any Public meeting by resolution.

All fees collected hereunder shall be paid into the Municipal Treasury.

Special Exceptions and Variances shall be issued (or acted upon) only after fees have been paid in full, and the Zoning Hearing Board shall take no action on appeals until fees have been paid in full.

Written notification of violations of this chapter and actions to be taken to enforce the provisions of this chapter shall be provided in accordance with the applicable notification procedures set forth in the Pennsylvania Municipalities Planning Code, or other applicable law.

Any Person receiving notification of a violation of this chapter may appeal to the Zoning Hearing Board by filing a written Notice of Appeal on or before the expiration of 30 days from the date of mailing of the Notice.

Any Person, Partnership or Corporation, who or which has violated or permitted the violation of the provisions of this chapter shall, upon being found liable therefore in a civil enforcement proceeding commenced by the Municipality, pay a judgment of not more than $500 plus all court costs, including reasonable attorney fees incurred by the Municipality as a result thereof.

No judgment shall commence or be imposed, levied or be payable until the date of determination of a violation by the district justice.

If the defendant neither pays nor timely appeals the judgment, the Municipality may enforce the judgment pursuant to the applicable rules of civil procedure.

Each day that a violation continues shall constitute a separate violation, unless the district justice determining that there has been a violation further determines that there was a good faith basis for the person, partnership or corporation violating this chapter to have believed that there was no such violation, in which event there shall be deemed to have been only one such violation until the fifth day following the date of the determination of the violation by the district justice and thereafter each day that a violation continues shall constitute a separate offense punishable by a like penalty.

All judgments, costs and reasonable attorney fees collected for the violation of this chapter shall be paid over to the Municipality.
