Zoning Districts

§ 301 Designation of Zoning Districts and Purposes.

1. 
For the purposes of this chapter, Mountville Borough is hereby divided into the following zoning districts, which shall be designated as follows:

2. 
Purposes of Each Zoning District. In addition to serving the overall purposes and objectives of this chapter and the Comprehensive Plan, each zoning district is intended to serve the following purposes:
A. 
Open Space Zoning District: to preserve existing recreational and open spaces, and institutional and public uses. This zoning district is intended to encourage those land uses and activities which maintain the Borough's small-town character and enhance the quality of life for residents, property owners and visitors.
B. 
Low-Density Residential Zoning District: to provide areas for the limited and orderly expansion of residential development in low to moderate densities compatible with existing neighborhoods, while preserving institutional uses and open space. It is a further intent of this district to exclude nonresidential activities not compatible with the existing residential development.
C. 
Medium-Density Residential Zoning District: to provide areas for a variety of housing types and densities including single-family detached dwellings, single-family semidetached dwellings, single-family attached/townhouse dwellings and multifamily/low-rise apartments and condominium dwellings. The intent of this district is to encourage development compatible and consistent with the traditional small-town character of the Borough. This district is also intended to provide for limited nonresidential uses, including commercial and public uses.
D. 
Town Center Zoning District: to provide for the continuation of the prevailing mix of retail, service, office, and residential uses; to maintain compatibility between residential uses and small-scale businesses; to preserve and reuse existing buildings that represent the Borough's historical character; and to encourage new construction that maintains the essential Borough character. The intent of this district is to permit a wide variety of housing types and densities, including single-family and multifamily residential uses; neighborhood-oriented retail and service businesses; and other low-intensity commercial uses in a pedestrian-friendly setting.
E. 
Commercial Zoning District: to provide areas for the development of restricted retail and business uses which have minimal impact on surrounding properties. This district is intended to permit a broad range of commercial, business, retail and service uses of a local and regional nature. It is further the intent of this district to limit the impact such nonresidential uses have on adjacent residential areas.
F. 
Industrial Zoning District: to provide sufficient space, in appropriate locations, to meet the current and anticipated future needs for a wide range of industrial activity. It is further intended that approved operations will be compatible with adjacent uses.

§ 302 Application of Regulations.

1. 
The regulations set by this chapter shall apply uniformly to each class or kind of structure or land, except as provided for in this chapter.
2. 
No structure shall hereafter be erected, used, constructed, reconstructed, structurally altered or occupied and no land shall hereafter be used, developed or occupied unless it is in conformity with the regulations herein specified for the use and district in which it is located.
3. 
General Requirements for all Uses. In addition to the standards set forth in this Part, all uses permitted within each zoning district shall also comply with:
A. 
Water and Sewage Facilities. All uses shall be served by public water and sewage facilities.
B. 
Off-Street Parking, Loading and Unloading. All uses shall provide off-street parking spaces and off-street loading and unloading space according to the provisions set forth in § 405 of this chapter.
C. 
Signs. Signs may be erected and maintained only when in compliance with the provisions of Part 5 of this chapter.

§ 303 Zoning Map. [1]

1. 
Unless otherwise noted, the locations and boundaries of the specific base zoning districts and overlay zoning districts are shown upon the map(s) that are attached to and made a part of this chapter. The map(s) and all notations, references and other data shown thereon are hereby incorporated by reference into this chapter as if all were fully described in this chapter. The map(s) shall be designated:
A. 
"Borough of Mountville, Lancaster County, PA: Zoning Map," in this chapter referred to as the, "Mountville Borough Zoning Map," "Mountville Zoning Map," "Zoning Map," and/or "Official Zoning Map."

§ 304 Zoning District Boundaries.

1. 
The boundaries between zoning districts are shown by zoning district boundary lines on the Zoning Map(s). Where uncertainty exists as to the location of boundaries of any zoning districts shown on the Zoning Map(s), the following rules shall apply:
A. 
Where zoning district boundaries are so indicated as approximately coinciding with the center lines of streets, highways, railroad lines, other rights-of-way lines, streams, or ridge lines, such center lines shall be construed to be the zoning district boundaries.
B. 
Where zoning district boundaries are so indicated as approximately coinciding with lot lines, such lot lines shall be construed to be the zoning district boundaries.
C. 
Where zoning district boundaries are so indicated that as approximately parallel to center lines of streets, highways, railroad lines, and other rights-of-way, the zoning district boundaries shall be construed as parallel thereto and at such distances from the center line as indicated on the Zoning Map(s).
D. 
For unsubdivided land or where a zoning district boundary divides a lot, the location of the zoning district boundary, unless dimensions are indicated, shall be determined by the scale appearing on the Zoning Map(s).
E. 
Where a municipal boundary divides a lot, the minimum lot area shall be regulated by the municipality in which the principal use(s) are located, unless otherwise provided by applicable case law. The land area within each municipality shall be regulated by the use regulations and other applicable regulations of each municipality.
F. 
In the case of any uncertainty as to zoning district boundaries on the Zoning Map(s), the Zoning Officer shall determine the zoning district boundaries; however, the Zoning Officer's determination may be appealed to the Zoning Hearing Board in accordance with § 816, Zoning Hearing Board, of this chapter.

Table 3-2 lists the types of uses permitted in the respective zoning districts as set forth by this chapter. Uses are divided into those Permitted by Right "P" (zoning decision by Zoning Officer) and Permitted by Special Exception "S" (zoning decision by Zoning Hearing Board). Many of the uses permitted by the above categories shall comply with certain criteria, which are found in Part 4 of this chapter. The specific section numbers where the criteria are located are noted in the tables and "N/A" is noted if no criteria apply. Uses not listed in the tables below shall specifically not be permitted in the applicable zoning districts.

§ 306 Open Space Zoning District.

§ 309 Town Center Zoning District.
