AMENDMENTS TO

GENERAL PLAN AND ZONING ORDINANCE

§ 153.115 SCOPE.

   The general plan, with accompanying maps, shall be considered an advisory policy document for the purposes of this chapter, as provided herein, and the management and guidance of growth and development occurring in the city, and the provisions of required infrastructure and services provided by the city.

§ 153.116 PUBLIC USES CONFORM TO GENERAL PLAN.

   After the City Council adopted the general plan, with accompanying transportation map, and any amendments thereto, no street or other public way may be constructed or authorized until and unless:
   (A)   It conforms to the general plan, including consistency with the transportation circulation map; or
   (B)   It has been considered by the Planning Commission and, after receiving public input and the advice of the Planning Commission, approved by the City Council as an amendment to the general plan.

§ 153.117 AMENDMENTS TO GENERAL PLAN.

   A proposed amendment to the general plan or maps may be initiated by any city property owner, any city resident, any city business owner, the City Council or Planning Commission, by filing a general plan amendment application. An application for an amendment to the general plan shall be filed with the city.

§ 153.118 PROCEDURES FOR AMENDING GENERAL PLAN.

   (A)   Completeness of application. A general plan amendment application shall be considered by the city for application completeness.
   (B)   Public hearing. Prior to recommending the adoption, rejection or revision of any general plan amendment application, the Planning Commission shall hold a public hearing in accordance with the procedures of this chapter and Utah Code Annotated. The minimum notice required for the Planning Commission public hearing shall be as required by § 153.004.
   (C)   Recommendation to City Council. After the Planning Commission has reviewed the application and made its recommendation, the Planning Commission shall transmit to the City Council a copy of the Planning Commission’s recommendation and the meeting minutes, all public comments and all other relevant materials of the proceedings before the Planning Commission. The Planning Commission recording secretary shall place the general plan amendment application on the agenda of a regularly scheduled public meeting for the City Council to consider the Planning Commission recommendation for the general plan amendment application.
   (D)   Consideration by City Council. At a regularly scheduled public meeting, following a recommendation by the Planning Commission, the City Council shall consider and may approve, revise or reject the proposed general plan amendment. If the City Council approves the proposed amendment as submitted or as revised, the City Council shall adopt the general plan amendment by resolution.

§ 153.119 AMENDMENTS TO ZONING ORDINANCE AND MAP.

   (A)   Application. A proposed amendment to this chapter, including the zoning district map, may be initiated by any city property owner, any city resident, any city business owner, the City Council or Planning Commission by filing a zoning ordinance text or zoning ordinance district map amendment application with the city.
   (B)   Rezone applications consistent with general plan. A zoning district map (rezone) amendment application to change a zoning district designation shall be found to be consistent with the general plan. If the zoning district map amendment application is found to be inconsistent with the general plan or the land use maps, a general plan amendment application shall be filed, reviewed and approved in accordance to the requirements of this chapter, prior to any zoning district map (rezone) amendment application being filed with the city.

§ 153.120 PROCEDURES FOR AMENDING ZONING ORDINANCE AND MAP (REZONE).

   (A)   Completeness of application. A zoning ordinance text amendment application and/or zoning district map amendment application shall be considered by the city for application completeness.
   (B)   Public hearing. Prior to recommending the adoption, rejection or revision of any zoning ordinance text amendment application or a zoning district map amendment application to the City Council, the Planning Commission shall hold a public hearing in accordance with the procedures of this chapter and Utah Code Annotated. The minimum notice required for the Planning Commission public hearing shall be as required by § 153.004.
   (C)   Recommendation to City Council. After the Planning Commission has conducted a public hearing, reviewed the application and formulated a recommendation, the Planning Commission shall transmit to the City Council a copy of the Planning Commission recommendation, all public comments and all other relevant materials of the proceedings before the Planning Commission. Following receipt of a copy of the previously identified materials, the Planning Commission recording secretary shall place said application on the agenda of a regularly scheduled public meeting for the City Council to consider the Planning Commission recommendation for the proposed amendment.
   (D)   City Council consideration. At a regularly scheduled public meeting, the City Council shall consider and may approve, revise or deny the proposed application. If the City Council approves the proposed amendment as submitted or as revised, the City Council shall adopt the zoning ordinance text and/or zoning map amendment by ordinance.

§ 153.121 CRITERIA FOR APPROVAL OF ZONING TEXT AND/OR MAP AMENDMENT.

   No amendment to the zoning ordinance text or zoning district map (rezone) may be recommended by the Planning Commission nor approved by the City Council unless such amendment is found to be consistent with the general plan. In considering a zoning ordinance text or zoning district map amendment, the Planning Commission and the City Council shall consider the following factors, among others:
   (A)   The effect of the proposed amendment to advance the goals and policies of the general plan;
   (B)   The effect of the proposed amendment on the character of the surrounding area;
   (C)   The compatibility of the proposed uses with nearby and adjoining properties;
   (D)   The suitability of the properties for the uses requested and
   (E)   The overall community benefits.

§ 153.122 NOTICE OF PENDING AMENDMENTS.

   The Planning Commission recording secretary shall provide all applicants affected by a pending zoning ordinance text or zoning district map amendment application a written notice that:
   (A)   Identifies that a zoning ordinance text or zoning district map amendment application is pending with the City Council;
   (B)   The application for an approval, permit or license may be affected by the pending zoning ordinance text or zoning district map amendment, which may require revisions and changes to the application upon adoption of the pending zoning ordinance or zoning district map amendment; and
   (C)   A copy of the pending zoning ordinance or zoning district map amendment application is available for inspection in the city office.
