ARTICLE I

- IN GENERAL

Sec. 38-1. - Definitions.

The following words, terms and phrases, when used in this chapter, shall have the meanings ascribed to them in this section, except where the context clearly indicates a different meaning:

Accessory building means a subordinate building or portion of a major building or main building, the use of which is incidental to that of the dominate use of the major building of the premises other than an attached garage having at least one wall in common with the residence.

Accessory use means a use customarily incidental and subordinate to the principal use of the building or premises and located on the same premises with such principal use of the building or premises.

Building means any structure, having a roof supported by columns or walls, for the housing or enclosure of persons, animals or chattels.

Conforming use means any use of a building or premises that is in accord with the provisions of this chapter.

Dwelling, multiple, means a building used entirely for residential purposes and having more than two dwelling units.

Dwelling, one-family, means a building used entirely for residential purposes and having only one dwelling unit.

Dwelling,two-family, means a building used entirely for residential purposes and having two dwelling units.

Nonconforming use means any use of a building or premises that is not in accord with the provisions of this chapter.

Premises means a parcel of land occupied or designed to be occupied by one building and the accessory buildings or uses customarily incident to it, including such open spaces as are arranged and designed to be used in connection with such buildings.

Service establishments means any business conducted for the general public which the public may or may not be able to conduct for themselves. Examples of such are: gasoline service stations, dry cleaners, laundries, electrical repairs, plumbing repairs, TV, radio and appliance repairs, barbershops, beauty shops, tailors, shoe repairs, funeral homes, etc.

Structural alteration means any change in the supporting members of a building such as bearing walls or partitions, columns, beams or girders or any substantial change in the roof or the exterior walls.

Sec. 38-2. - Violations and penalties.

Any person, whether acting directly or through employees or agents, that violates, disobeys, omits, neglects, refuses to comply with or resists the enforcement of this chapter, shall be deemed guilty of a misdemeanor, and upon conviction thereof shall, for each offense, be punished by a fine not to exceed $500.00, imprisonment not to exceed six months, or both such fine and imprisonment.
