- ZONING DISTRICTS ESTABLISHED; DISTRICT REGULATIONS
For the purpose of regulating and restricting the use of land and location of buildings designated for specific uses and regulating and determining the buildings thereafter erected or altered, and regulating and determining the area of yards, courts, and other office spaces in connection with buildings thereafter erected or altered, the city is divided into the following zones or districts within the city limits, the boundaries of which are to be defined upon an official city map to be incorporated by reference in this article and filed in the office of the city clerk, such other public offices may be designated by the governing body and to be open to inspection and available to the public at all reasonable business hours, which map the governing body may from time to time supplement, change, or generally revise the boundaries or regulations contained in such zoning ordinance by amendment:
(1)
Public building and property zone.
PB - color blue - public buildings.
PR - color green - parks and recreational.
(2)
Residential zone.
R-1 - color yellow (no trailer homes or churches).
R-2 - color brown (trailers and churches with permission of residents within 200 feet).
MH - color orange - multiple housing.
(3)
Local business zone.
C - color red - commercial buildings.
(4)
General business and industrial zone.
T - [color] pink - mobile home park.
Ind. - [color] purple - industrial.

The following zones exist within the city:

Residential zone. All other lots, parcels, and tracts of land within the city limits, not included in any other zone.

Lots 11 and 12, except the south 102 feet of said lots, North Eighth Street Subdivision of the city, subject to the following conditions which shall apply only to this property:
a.
A six-foot-high wood cedar fence shall be constructed along the west and south property lines. The fence on the west side shall be tapered from a height of six feet to a height of three feet at the north property line. The property owner shall keep the fence repaired and in good condition at all times.
b.
The parking of vehicles on the north side of the present structure shall be limited to no more than two. Parking on Granby Street is prohibited.
c.
The existing driveway onto Granby Street shall not exceed 40 feet in width. Only one driveway is permitted.
d.
The property is exempt from the local business zone yard limit requirements as long as the existing structure remains. Any yard limit requirements in effect at the time the structure is removed shall then apply to the property. If the structure sustains more than 50 percent damage, the structure cannot be rebuilt and shall be removed.
The planning commission and governing body may remove these conditions at any time. These conditions shall be removed automatically if all adjacent property is zoned local business zone.

In the public buildings and property zone shall be buildings and premises owned by the city, the county, Neodesha School District, U.S. government and any other governmental body authorized by statutes to levy taxation. Such buildings and premises may include the following uses:
(1)
Administration of civil government;
(2)
Fire and/or police protection;
(3)
Education;
(4)
Public-owned utilities;
(5)
Health and welfare;
(6)
Recreation.

In the residential zone no building or premises shall be used and no building shall be hereafter erected, moved in or structurally altered, unless otherwise provided in this article, except for one or more of the following uses:
(1)
One-family dwelling;
(2)
Two-family dwelling;
(3)
Church and/or church-operated schools;
(4)
Accessory use;
(5)
Accessory buildings;
(6)
Those uses provided in section 38-104.

(a)
In the local business zone as defined and determined by this article, no buildings or premises shall be hereafter erected, moved in, or structurally altered, unless otherwise provided in this article, except for one or more of the following uses:
(1)
Retail sales;
(2)
Service establishments;
(3)
Public buildings and property, as provided in section 38-104;
(4)
Professional services or offices;
(5)
Food and/or drink establishments;
(6)
Multiple dwellings;
(7)
Roominghouses and boardinghouses;
(8)
Hotels or motels;
(9)
Any trade, industry or use that is not obnoxious or offensive by reason of the emission of order, dust, sight, smoke, gas or noise, or any uses declared a nuisance in a court of record.
(b)
In the local business zone, property being hereafter rezoned as local business zone for use for any of the purposes as stated in subsection (a) of this section, that except where over 50 percent of adjoining property is zoned for other than residential purposes, the following stated yard limits shall apply to all buildings or moved onto such property:
(1)
Front yard. The minimum depth of front yards shall be at least 30 feet.
(2)
Side yard. There shall be a side yard on each side of a building not less than ten percent of the width of the lot; except that such side yard shall not be less than seven feet and need not be more than 15 feet. Buildings on corner lots shall provide a side yard on the street side not less than 15 feet; provided this regulation shall not be interpreted as to reduce the building width of a corner lot at the time of the passage of this article to less than 35 feet.
(3)
Rear yards. The depth of rear yards shall be at least ten feet.
(4)
Obstructions. On any corner lot, there shall be no plating, structures, fences or other obstructions to vision more than three feet higher than the curb or street level within 30 feet of the intersection of the street right-of-way lines.

In the general business and industrial zone, no building or premises shall hereafter be erected, moved in, or structurally altered, unless otherwise provided in this article, except for one or more of the following uses:
(1)
Public buildings and property as provided in section 38-104;
(2)
Any trade or industry;
(3)
Any trade or industry or use that is obnoxious or offensive by reason of the emission of odor, dust, smoke, sight, gas or noise, or any uses declared a nuisance in a court of record; provided that the city building inspector advises that in his best judgment the obnoxious and offensive features are controlled and kept to a minimum.

- ZONING DISTRICTS ESTABLISHED; DISTRICT REGULATIONS
For the purpose of regulating and restricting the use of land and location of buildings designated for specific uses and regulating and determining the buildings thereafter erected or altered, and regulating and determining the area of yards, courts, and other office spaces in connection with buildings thereafter erected or altered, the city is divided into the following zones or districts within the city limits, the boundaries of which are to be defined upon an official city map to be incorporated by reference in this article and filed in the office of the city clerk, such other public offices may be designated by the governing body and to be open to inspection and available to the public at all reasonable business hours, which map the governing body may from time to time supplement, change, or generally revise the boundaries or regulations contained in such zoning ordinance by amendment:

In the public buildings and property zone shall be buildings and premises owned by the city, the county, Neodesha School District, U.S. government and any other governmental body authorized by statutes to levy taxation. Such buildings and premises may include the following uses:
(1)
Administration of civil government;
(2)
Fire and/or police protection;
(3)
Education;
(4)
Public-owned utilities;
(5)
Health and welfare;
(6)
Recreation.

In the residential zone no building or premises shall be used and no building shall be hereafter erected, moved in or structurally altered, unless otherwise provided in this article, except for one or more of the following uses:
(1)
One-family dwelling;
(2)
Two-family dwelling;
(3)
Church and/or church-operated schools;
(4)
Accessory use;
(5)
Accessory buildings;
(6)
Those uses provided in section 38-104.

(a)
In the local business zone as defined and determined by this article, no buildings or premises shall be hereafter erected, moved in, or structurally altered, unless otherwise provided in this article, except for one or more of the following uses:
(1)
Retail sales;
(2)
Service establishments;
(3)
Public buildings and property, as provided in section 38-104;
(4)
Professional services or offices;
(5)
Food and/or drink establishments;
(6)
Multiple dwellings;
(7)
Roominghouses and boardinghouses;
(8)
Hotels or motels;
(9)
Any trade, industry or use that is not obnoxious or offensive by reason of the emission of order, dust, sight, smoke, gas or noise, or any uses declared a nuisance in a court of record.
(b)
In the local business zone, property being hereafter rezoned as local business zone for use for any of the purposes as stated in subsection (a) of this section, that except where over 50 percent of adjoining property is zoned for other than residential purposes, the following stated yard limits shall apply to all buildings or moved onto such property:
(1)
Front yard. The minimum depth of front yards shall be at least 30 feet.
(2)
Side yard. There shall be a side yard on each side of a building not less than ten percent of the width of the lot; except that such side yard shall not be less than seven feet and need not be more than 15 feet. Buildings on corner lots shall provide a side yard on the street side not less than 15 feet; provided this regulation shall not be interpreted as to reduce the building width of a corner lot at the time of the passage of this article to less than 35 feet.
(3)
Rear yards. The depth of rear yards shall be at least ten feet.
(4)
Obstructions. On any corner lot, there shall be no plating, structures, fences or other obstructions to vision more than three feet higher than the curb or street level within 30 feet of the intersection of the street right-of-way lines.

In the general business and industrial zone, no building or premises shall hereafter be erected, moved in, or structurally altered, unless otherwise provided in this article, except for one or more of the following uses:
(1)
Public buildings and property as provided in section 38-104;

Any trade or industry;
(3)
Any trade or industry or use that is obnoxious or offensive by reason of the emission of odor, dust, smoke, sight, gas or noise, or any uses declared a nuisance in a court of record; provided that the city building inspector advises that in his best judgment the obnoxious and offensive features are controlled and kept to a minimum.
