Zoning Map, Districts and Boundaries

§ 500-8 Zoning Map.

A map entitled "New Bethlehem Borough Zoning Map" is hereby adopted as part of this chapter. The Official Zoning Map shall be kept on file available for examination at the Borough Building.[1]

§ 500-9 Zoning districts.

The Borough is divided into the following districts as shown by the district boundaries on the Zoning Map:
R-1 Residential
R-2 Residential
B Commercial
IN Industrial
C Conservation
L-IN Light Industrial

§ 500-10 District boundaries.

The boundaries between districts are center lines of streets, alleys, railroad rights-of-way, streams, or such lines extended, or lines parallel thereto or concentric therewith, or property lines when proximate thereto, or may be lines otherwise indicated on the Zoning Map. When the Zoning Officer cannot definitely determine the location of a district boundary, he shall deny the application and the Zoning Hearing Board, upon appeal, shall interpret the location of the district boundary.

§ 500-11 Territory added to R-1 Residential District.

§ 500-12 Territory added to R-2 Residential District.

A. 
The zoning district of a tract of land hereinafter described is changed from (B) Commercial to (R-2) Residential and the Borough Zoning Map is ordered changed accordingly to permit the construction of a high-rise apartment structure for the elderly under a federal housing program. The tract is bounded and described as follows:

On the north by Broad Street;
(2) 
On the east by the McEwen Building;
(3) 
On the south by Water Street; and
(4) 
On the west by Wood Street.
(5) 
Frontage on Broad Street is 120 feet.[1]

Editor's Note: Former § 25(2) of the 1972 Code of Ordinances, regarding a parcel of land for low-income housing, which immediately followed this subsection, was repealed at time of adoption of Code (see Ch. 1, General Provisions, Art. I).
B. 
The following tract of land is rezoned from R-1 Residential and C Conservation to R-2 Residential:

(1) 
All that certain tract of land situate in the Borough of New Bethlehem, bounded and described as follows: Bounded on the south by an unnamed 14 foot alley, on the west by Keck Avenue and lands of William McNeal, on the north by William McNeal, and on the east by the Borough line and lands of McGarrity. Containing 4 1/2 acres, more or less.
C. 
The zoning district of the parcel of land hereinafter described is changed from R-1 Residential to R-2 Residential. The parcel is bounded and described as follows: all those lots, being Lots No. 91 and 92, located in New Bethlehem Borough, Clarion County, Pennsylvania, as laid out on general plan of said Borough and being more particularly described as follows: bounded on the north by a public alley; on the east by Lafayette Street; on the south by Penn Street; and on the west by the east line of land now or formerly of Emerson Gruver, being the east line of Lot No. 90. Containing 1/2 acre, more or less. Tax Map No. 20-020-236.

§ 500-13 Territory added to B Commercial District.

A. 
The zoning district of the tract of land hereinafter described is changed from R-2 Residential to B Commercial and the Borough Zoning Map is ordered changed accordingly. The tract is bounded and described as follows:

On the north by Jockey Alley;
(2) 
On the east by Wood Street;
(3) 
On the south by Water Street; and
(4) 
On the west by Liberty Street.
B. 
The zoning district of a tract of land hereinafter described is changed to allow (R-2) Residential to (B) Commercial. The tract is bounded and described as follows:

(1) 
On the north by the north line of Willow Street a/k/a Broad Alley;
(2) 
On the east by lands of Redbank Valley School Building Authority;
(3) 
On the south by Redbank Creek; and
(4) 
On the west by Walnut Street.
(5) 
Frontage on Broad Alley is approximately 850 feet.
C. 
The land described below located in the Borough of New Bethlehem, Clarion County, Pennsylvania, which is now zoned as C Conservation is hereby changed and rezoned to B Commercial. The description of the property to be rezoned is as follows: all that certain tract of land situated in the Borough of New Bethlehem, Clarion County, Pennsylvania, bounded in the north by Edward Darr; on the east by Liberty Street; on the south by Broad Street; and on the west by Redbank Creek.
