ARTICLE VII

Amendments

§ 500-48 General.

Borough Council may introduce and consider amendments to this chapter and to the Zoning Map, as proposed by a member of Borough Council, by the Planning Commission, or by a petition of a person residing or owning property within the Borough.

§ 500-49 Petitions.

[Amended at time of adoption of Code (see Ch. 1, General Provisions, Art. I)]
Petitions for amendment shall be filed with the Planning Commission, and the petitioner, upon such filing, shall pay an advertising deposit and a filing fee, payable to the Borough in accordance with current advertising costs or on a schedule fixed by Borough Council. The Planning Commission shall review the proposed amendment and report its findings and recommendations in writing to Borough Council.

§ 500-50 Referral.

Any proposed amendment presented to Borough Council without written findings and recommendations from the Borough Planning Commission shall be referred to the Borough Planning Commission and the Clarion County Planning Commission for review prior to public hearing by the Borough Council. The Borough Planning Commission and the County Planning Commission shall report their findings and recommendations in writing to Borough Council within 30 days of the referring action.

§ 500-51 Action.

Before acting upon a proposed amendment, Borough Council shall hold a public hearing thereon. Notice of such public hearing, containing a brief summary of the proposed amendment and a reference to the place where copies of the same may be examined, shall be published in a newspaper of general circulation in the Borough at least 14 days but not more than 30 days prior to the date of the hearing.
