CHAPTER 5
05 R-3 MULTIPLE-RESIDENTIAL DISTRICT
§ 5.05.010 Purpose.
A.
To encourage the development of multiple-family residential structures at varying densities consistent with the infrastructure, services, access, and facilities which are available at a particular location. In addition, factors such as adjacent land uses, environmental conditions, proximity to shopping and parks and measurable community benefits shall also be specifically evaluated in determining the suitable project density for permitted and conditional uses.
B.
Low-intensity nonresidential land uses may be allowed in the R-3 Zoning District as a conditional use, provided the use can meet the same performance and impact standards as multiple-family residential development.

§ 5.05.020 Permitted uses.
Unless otherwise governed by this title, the following uses are allowed by right (i.e., no discretionary permit is required that would constitute a "project" for the purposes of complying with the California Environmental Quality Act) in the R-3 Zoning District:
A.
Accessory buildings.
B.
Animals. For multiple-family residences, including mobile homes in mobile home parks, one dog maximum, one rabbit maximum, two cats maximum, domestic birds and other small caged animals are permitted where the total number of animals in one place of residence shall not exceed five.
C.
Apartments.
D.
Duplexes.
E.
Single-room occupancy.
F.
Supportive housing.
G.
Transitional housing.
H.
Triplexes.
I.
Residential care facility, small and large.

§ 5.05.030 Accessory uses – Administrative approval required.
The following uses are permitted in the R-3 Zoning District with administrative approval:
A.
Home occupations pursuant to Chapter 5.20 NCC.
B.
Temporary sales office and/or construction offices, and neighborhood or block parties, fairs or festivals, pursuant to Chapter 5.22 NCC.
C.
Sale of produce pursuant to Chapter 5.22 NCC.

§ 5.05.040 Conditional uses – Commission approval required.
Unless otherwise governed by this title, the following uses, and uses determined to be similar, may be permitted in the R-3 Zoning District subject to approval of a conditional use permit by the Planning Commission:
A.
Churches and other religious institutions.
B.
Clubs.
C.
Dwelling groups.
D.
Lodges.
E.
Mortuaries.
F.
Rest homes/hospital.
G.
Rooming and boardinghouses.

§ 5.05.050 Property development standards.
Unless otherwise governed by this title, the following standards shall apply to all land uses, development and subdivisions in the R-3 Zoning District:
A.
Minimum Floor Area Requirements.
1.
Studio units: 550 square feet.
2.
One-bedroom units: 650 square feet.
3.
Two-bedroom units: 800 square feet.
4.
Three-bedroom units: 900 square feet.
5.
Four-bedroom units: 1,000 square feet.
B.
Usable Open Space Requirements.
1.
A minimum of 300 square feet of usable open space shall be provided for each single-family dwelling unit or halfplex unit.
2.
A minimum of 200 square feet of usable open space shall be provided for each dwelling unit in duplex, triplex and fourplex residential buildings.
3.
A minimum of 100 square feet of usable open space shall be provided for each dwelling unit, trailer or mobile home in residential apartment buildings, mobile home parks or trailer courts.
C.
Architectural and Site Plan Review.
1.
Architectural and site plan review shall be required for those projects which could result in the development of residential units (including in-fill projects), or the development of any nonresidential building or use.
2.
Architectural and site plan review may be required by the Planning Department and Architectural Review Committee prior to issuance of a permit based on the finding that a proposed residence is out of character with the existing neighborhood or if the design and/or materials of a proposed residential addition are inconsistent with the existing residence.
D.
Other Applicable Provisions. Other provisions of this title as applicable such as off-street parking and loading, signs, landscaping and screening, trash enclosures, etc.

§ 5.05.060 Special use property development standards.
In addition to and in supplement of other provisions of this chapter, the following special property development standards shall be applied as follows:
A.
Single-family dwellings and halfplexes are subject to the regulations set forth in the R-2 District.
B.
Duplexes, Triplexes, Apartments or Dwelling Group.
1.
Minimum building site required: 6,000 square feet for interior lots and 6,500 square feet for corner lots for each dwelling. For any lot created on or after June 1, 2025, the lot shall be sized to accommodate a minimum of 20 units per acre, as per 6th Cycle Housing Element requirement.
2.
Minimum average lot width: 60 feet for interior lots and 65 feet for corner lots.
3.
Minimum Street Frontage. The City Planning Commission shall be responsible for determining the minimum street frontage based on the buildable area of the lot, access requirements and good design. However, in no case shall the Planning Commission approve lots having less than 35 feet of street frontage.
4.
Minimum lot area per unit: 1,500 square feet of lot per dwelling unit.
5.
Minimum front yard setback: 15 feet from property line.
6.
Minimum rear yard setback: 15 feet from property line.
7.
Minimum side yard setbacks: five feet from property line. However, a corner lot shall have a side yard abutting a street of not less than 10 feet from the property line.
8.
Maximum lot coverage: 80 percent of the total lot area. Lot coverage shall specifically include all buildings and structures and paved parking areas.
9.
Maximum building height: 35 feet.
10.
Minimum density requirement: 20 dwelling units to the acre.
C.
Rooming and boardinghouse, lodge, club, rest home and nonresidential uses (use permit required):
1.
Minimum building site required: 7,500 square feet for interior and/or corner lots.
2.
Minimum average lot width: 60 feet for interior lots and 65 feet for corner lots.
3.
Minimum Street Frontage. The City Planning Commission shall be responsible for determining the minimum street frontage based on the buildable area of the lot, access requirements and good design. However, in no case shall the Planning Commission approve lots having less than 35 feet of street frontage.
4.

5.

6.

D.
Affordable housing sites, which are herein defined as sites rezoned to R-3 for the purpose of implementing a housing program contained in the General Plan Housing Element, must comply with Government Code Section 65583.2(h) and (i). The following regulations apply to affordable housing sites:
1.
Owner-occupied and rental multifamily residential use is allowed by right (i.e., no discretionary permit is required that would constitute a "project" for the purposes of complying with the California Environmental Quality Act).
2.
The minimum allowable development density is 20 units per acre.
