ARTICLE VIII

Amendments

§ 194-53 Procedure.

A. 
The Town Board may, from time to time, on petition or on recommendation of the Planning Board and/or the Zoning Board of Appeals, and after public notice and hearing, amend, supplement, change, or modify this chapter pursuant to provisions of the Town Law applicable thereto. If the proposed amendment is made by petition, such amendment shall be referred to the Zoning Board of Appeals for report prior to public notice and hearing thereon.
B. 
Any proposed amendment to the Town of Nichols' Zoning Law, including any amendment to this section, or any other local law or ordinance, or any proposed adoption of any local law or ordinance or moratorium, which would affect, in any way, the right to mine sand or gravel within the current I-B-A-R District at the eastern end of the Town, which district is generally bounded on the south and on the east by Stanton Hill Road and the current I-2-B-A-R District, and on the west and on the north by the Susquehanna River, or which would amend Article III of this chapter with respect to the vesting of certain property rights within said I-B-A-R District, shall not be adopted until all property owners in said I-B-A-R District are provided with a written notice, sent by certified mail, return receipt requested, of the proposed amendment to this chapter, or adoption of or amendment to any local law or ordinance or moratorium, at least three months prior to the adoption of or amendment to any such local law or ordinance or moratorium. Such written notice shall include a copy of the proposed amendment, or proposed local law or ordinance or moratorium, a copy of which shall also be published in the official Town newspaper at least three months prior to the adoption of such amendment, local law or ordinance or moratorium.
