ARTICLE III

Application of Regulations

§ 600-6 Conformance with regulations required.

No building or land shall hereafter be used or occupied and no building or part thereof shall be erected, moved or altered unless in conformance with the regulations herein specified for the district in which it is located.

§ 600-7 Restrictions on buildings.

No building shall hereafter be erected or altered:
A. 
Which is not in strict conformity with the accompanying Zoning Area and Limiting Schedule,[1] together with all the regulations contained in this chapter.

B. 
To accommodate or house a greater number of families or be used for or occupied by persons, materials, automobiles, equipment and other things not permissible in the respective zoning districts.

§ 600-8 Use of yard areas.

No part of a yard or other open space required about any building for the purpose of complying with the provisions of this chapter shall be included as a part of a yard or other open space similarly required for another building.

§ 600-9 Public utilities.

Public utilities or any public use may be located in any of the districts; provided, however, that before a building permit or certificate of occupancy shall issue, application shall first be made to the Board of Adjustment, which, after hearing in the same manner and under the same procedure as in the case of exceptions to this chapter, shall recommend, in writing, to the Borough Council that such permit shall be granted for the reason that the granting thereof shall not, in its judgment, be detrimental to the health, safety or general welfare of the community and that the permit is reasonably necessary for the convenience of the community.

§ 600-10 Industrial and business use of streets.

No person lawfully maintaining an industrial or business use in any district shall use or permit to be used any of the public streets of this Borough, other than primary or secondary roads as defined in Chapter 523, Streets and Sidewalks, Article IV, Construction Standards, as thoroughfares for trucking to and from the industrial or business uses.
