ARTICLE I

General Provisions

§ 350-1 Short title.

This chapter shall be known and cited as the "1985 Amendment to the Zoning Ordinance of the Borough of North Irwin."

§ 350-2 Compliance required.

No building, sign or other structure or land shall be used or occupied and no building or structure or part thereof shall be erected, constructed, reconstructed, moved, enlarged or structurally altered unless in conformity with the regulations of this chapter. However, this chapter shall not require any change to any building, structure or use legally existing at the effective date of this chapter, or any amendment thereto, or to any building, structure or use for which construction in compliance with existing laws prior to the effective date of this chapter, or any amendment thereto, was started on the effective date of this chapter and completed within a one-year period after the effective date of this chapter.

§ 350-3 Applicability.

The regulations and provisions of this chapter shall apply to and affect the incorporated Borough of North Irwin.

§ 350-4 Purpose.

A. 
The purposes of this chapter are to comply with the provisions of the Pennsylvania Municipalities Planning Code[1] and to promote, protect and facilitate the following: the public health, safety, morals, general welfare, coordinated and practical development of the municipality, the proper density of population, the provision of adequate light and air, police protection, vehicle parking and loading space, transportation, water, sewage, schools, public grounds and other public requirements.

B. 
This chapter is also designed to prevent the following: the overcrowding of land, blight, danger and congestion in travel and transportation, loss of health, life or property from fire, flood, panic or other dangers.

§ 350-5 Community development objectives.

This chapter and the Zoning Map, as amended, are based on the Comprehensive Plan of the Borough of North Irwin. Said Comprehensive Plan contains a series of local recommendations and objectives which together constitute a statement of the Borough's community development objectives relative to land uses, densities of population, location and function of streets, community facilities and other considerations and which are hereby adopted by reference to serve as a basis for this chapter and the Zoning Map.

§ 350-6 Interpretation; repealer.

A. 
Interpretation. In the interpretation and the application of the provisions of this chapter, they shall be held to be the minimum requirements for the promotion of the health, safety, morals and general welfare. It is not intended to interfere with or abrogate or annul other rules, regulations or ordinances; provided, however, that where this chapter imposes greater restrictions upon the use of buildings or premises, or upon the height or bulk of a building, or requires larger open spaces, the provisions of this chapter shall prevail.
B. 
Repealer. The Borough of North Irwin Zoning Ordinance No. 7 of 1973 adopted January 8, 1973, and all amendments thereto are hereby completely amended by this chapter. All other existing ordinances or parts of ordinances in conflict with this chapter, to the extent of such conflict and no further, are hereby repealed.

§ 350-7 When effective.

This chapter shall take effect immediately upon adoption.
