ARTICLE VII

Administration and Enforcement

§ 200-48 Building permits.

A. 
No building or structure shall be erected, added to or structurally altered until a permit therefor has been issued by the Code Enforcement Officer.

B. 
There shall be submitted with all applications for building permits two copies of a layout or plot plan drawn to scale showing the actual dimensions of the lot to be built upon, the exact size and location on the lot of the building and accessory buildings to be erected and such other information as may be necessary to determine and provide for the enforcement of this chapter.
C. 
One copy of such layout or plot plan shall be returned when approved by the Code Enforcement Officer, together with such permit to the applicant upon payment of a fee to be established by the Village Board.
D. 
In the event that development authorized by the permit has not been commenced and diligently prosecuted within one year from the date of issue, the permit shall automatically lapse and be null and void, and the schedule of regulations shall apply as if no permit had been issued, except that the one-year limitation provided herein, upon written application by the proponent or developer stating reasons for delay, may be extended by the Planning Board for such additional periods of time as deemed appropriate.

§ 200-49 Certificates of occupancy.

A. 
No land shall be occupied or used and no building hereafter erected, altered or extended shall be used or changed in use until a certificate of occupancy shall have been issued by the Code Enforcement Officer stating that the buildings or proposed use thereof complies with the provisions of this chapter.
B. 
No nonconforming use shall be maintained, renewed, changed or extended without a certificate of occupancy (certificate of existing use, thereof) having first been issued by the Code Enforcement Officer.
C. 
All certificates of occupancy for new structures shall be applied for coincident with the application for a building permit. Said certificate shall be issued within 10 days after the erection or alteration shall have been approved as complying with the provisions of this chapter. Certificates of occupancy for existing structures, conforming and nonconforming, shall be obtained within six months of the effective date of this chapter.
D. 
The Code Enforcement Officer shall maintain a record of all certificates in the office of the Village Clerk, and copies shall be furnished upon request to any person having a proprietary or tenancy interest in the building affected.
E. 
No permit for excavation for or the erection or alteration of or repairs to any building shall be issued until an application has been made for a certificate of occupancy.
F. 
Under such rules and regulations as may be established by the Planning Board, a temporary certificate of occupancy for not more than 30 days for a part of the building may be issued by the Code Enforcement Officer.

§ 200-50 Enforcement officer.

This chapter shall be enforced by the Code Enforcement Officer, who shall be appointed by the Village Board. No building permit or certificate of occupancy shall be issued by him, except in compliance with all provisions of this chapter.

§ 200-51 Inspections. [1]

A. 
Except for owner-occupied, single-family residences, the Code Enforcement Officer shall be authorized and have the right, in the performance of his duties, to enter any premises during normal business hours and in emergencies whenever necessary to protect the public interest.
B. 
Owners, agents, operators and occupants shall be responsible for providing access to all parts of the premises within their control to authorized agencies' personnel acting in the performance of their duties.

§ 200-52 Filing of decisions.

Each order, requirement, decision, interpretation or determination of the Code Enforcement Officer shall be filed in the office of the Village Clerk and shall be a public record.
