ARTICLE III

ZONING DISTRICTS ESTABLISHED; ZONING MAP

Sec. 109-72.- District classification.

In order to classify, regulate, and restrict the location of trade and business and the location of buildings designated for specific uses; to regulate and limit the height and bulk of buildings hereafter erected or altered; to regulate and limit the intensity of the use of the lot areas; and to regulate and determine the areas of yards, recreation and open space within and surrounding such buildings, the city is hereby divided into zoning districts. The use, height and area regulations are uniform in each district. Districts shall be known as:

Sec. 109-73. - Zoning map.

(a)

The location and boundaries of the districts established by this article are hereby set forth in a map known as the city zoning map. Said map and all notations, references, and data shown thereon are hereby incorporated by reference into this article and shall be as much a part of it as if all were fully described herein. It shall be the responsibility of the city administrator or designee to maintain said map, and amendments thereto shall be recorded on said map within 30 days after official publication of amendments. The official zoning map shall be kept on file in the city hall.

(b)

Wherever uncertainty exists as to the boundary of any use district as shown on the zoning map incorporated herein, the following rules shall apply:

(1)

Where district boundary lines are indicated as following streets, railroads, or similar rights-of-way, they shall be construed as following the centerlines thereof;

(2)

Where district boundary lines are indicated as approximately following lot lines or section lines, such lines shall be construed to be such boundaries;

(3)

Where a lot held in one ownership, and of record at the effective date of the ordinance from which this article is derived, is divided by a district boundary line, the entire lot shall be construed to be within the less restricted district; provided that this construction shall not apply if it increases the area of the less restricted portion of the lot by more than 20 percent;

(4)

Where figures are shown on the zoning map between a street or property line and a district boundary line, they indicate that the district boundary line runs parallel to the street line or property line at a distance therefrom, from equivalent to the number of feet so indicated, unless otherwise indicated.

Sec. 109-74. - Future annexation.

Any land annexed to the city in the future shall be placed in the A district until placed in another district by action of the city council after recommendation of the planning commission.
