Words in the text or tables of this Chapter shall be interpreted in accordance with provisions set forth in this Section. Where words have not been defined, the standard dictionary definition shall prevail.
ACCESSORY RESIDENTIAL IN "C-2"A separate, complete dwelling unit that is substantially contained within a commercial structure in the "C-2" District.
ACCESSORY STRUCTUREA structure that:
1. Is subordinate to and serves a principal structure;
2. Is subordinate in area, extent or purpose to the principal structure served;
3. Contributes to the comfort, convenience or necessity of the occupants, business or industry in the principal structure; and
4. Is located on the same lot as the principal structure served.
ACCESSORY USEA use of land or of a building or portion thereof that:
1. Is subordinate to and serves a principal use;
2. Is subordinate in area, extent or purpose to the principal use served;
3. Contributes to the comfort, convenience or necessity of the occupants, business or industry of the principal use; and
4. Is located on the same lots as the principal structure served.
ACREA measure of land area containing forty-three thousand five hundred sixty (43,560) square feet.
ADULT ENTERTAINMENT ESTABLISHMENTAn establishment used or intended to be used for commercial entertainment or having ten percent (10%) or more of its stock for sale or viewing of matters depicting, describing or relating to sexual conduct for the enjoyment of the patrons.
AGRICULTURAL PROCESSINGThe initial processing of crop-based agricultural products that is reasonably required to take place in close proximity to the site where such products are produced. Typical uses include grain mills.
AGRICULTURAL SALES AND SERVICEA use primarily engaged in the sale or rental of farm tools and implements, feed and grain, tack, animal care products and farm supplies. This definition excludes the sale of large implements, such as tractors and combines, but includes food sales and farm machinery repair services that are accessory to the principal use.
AGRICULTURAL USESThe use of a tract of land of not less than ten (10) acres for the growing of crops, pasturage or nursery, including the structures necessary for carrying out farming operations and the dwellings of these owning or operating the premises, member of the family thereof or persons employed thereon and the family thereof.
AGRICULTURE, GENERALThe use of land for the production of livestock, dairy products, poultry or poultry products.
AGRICULTURE, LIMITEDThe use of land for the production of row crops, field crops, tree crops or timber.
AIRPORT OR AIRSTRIPAny public or privately owned or operated ground facility designed to accommodate landing and takeoff operations of aircraft, including all taxiways, aircraft storage and tie-down areas, hangars and other necessary buildings and open spaces.
ALLEYA public or private street primarily designed to serve as secondary access to the side or rear of those properties whose principal frontage is on some other street.
ANIMAL CARE, GENERALA use providing animal care, boarding or veterinary services with outdoor animal runs. (See "ANIMAL CARE, LIMITED" and "KENNEL").
ANIMAL CARE, LIMITEDA use providing animal care, boarding or veterinary services for household pets, with no outdoor animal runs. (See "ANIMAL CARE, GENERAL" and "KENNEL").
ANIMAL CARE, WILDLIFE REHABILITATIONA use providing for rehabilitation of wild animals that are Missouri native small mammals pursuant to a wildlife rehabilitation permit issued by the Missouri Department of Conservation, with no outdoor animal runs.

ANIMATIONAny action or motion, other than flashing lights, automatic changeable copy or indexing, in an attempt to develop a pictorial scene through the movements of lights or parts of a sign.
APPLICANTA developer submitting an applications for development.
APPLICATION FOR DEVELOPMENTThe application form and all accompanying documents required by ordinance for approval of a subdivision plat or site plan.
APWAThe American Public Works Association.
AS-BUILT PLANSConstruction plans revised to show a facility or structure as actually constructed and as it appears on the tract of land involved.
ASTMAmerican Society for Testing Materials.
ASPHALT OR CONCRETE PLANTA use engaged in the manufacture, mixing, batching or recycling of asphalt, asphaltic cement, cement or concrete products.
ASSISTED LIVINGMulti-family dwelling units used or designed to be used by older persons, persons with disabilities or other persons needing or desiring assistance with day-to-day living matters, but not including group homes, group residential, hospitals or convalescent care facilities. Typical uses include retirement communities in which housekeeping services, common dining facilities and recreational and social activities are offered to residents.
AUDITORIUM OR STADIUMAn open, partially enclosed or fully enclosed facility used or intended to be used primarily for spectator sports, entertainment events, expositions and other public gatherings. Typical uses include convention and exhibit halls, sports arenas and amphitheaters.
AWNINGAn architectural projection that provides weather protection, identity or decoration and is wholly supported by the building to which it is attached. An awning is comprised of a light-weight, rigid skeleton structure over which a covering is attached.
AWWAAmerican Water Works Association.
BANK OR FINANCIAL INSTITUTIONEstablishments engaged in deposit banking. Typical uses include commercial banks, savings institutions and credit unions and automated teller machines.
BAR OR TAVERNAn establishment where fifty percent (50%) or more of gross income is derived from the sale of alcoholic beverages by the drink for consumption on the property and where the serving of food and non-alcoholic beverage for consumption on the property and the sale of package liquors may be accessory uses.
BASEMENTA story partly or wholly below grade. For purposes of height measurement, a basement shall be counted as a story when the finished surface of the floor above the basement is:
1. More than six (6) feet above the average grade.
2. More than six (6) feet above the finished grade for more than fifty percent (50%) of the total building perimeter.
3. More than twelve (12) feet above the finished grade at any point.
BASIC INDUSTRYA use engaged in the basic processing and manufacturing of materials or products predominately from extracted or raw materials. Typical uses include distilleries; pulp processing and paper products manufacturing; glass manufacturing; brick manufacturing; steel works; tanneries; acid manufacturing; cement, lime, gypsum or plaster of Paris manufacturing; fertilizer or chemical manufacturing; and petroleum refineries.
BED AND BREAKFASTA dwelling or portion thereof that contains guest rooms that short-term lodging, with or without meals, is provided for compensation.
BERMA mound of earth, typically located in a bufferyard to shield or block noise, lights or other nuisances.
BLOCKAn area of land within a subdivision that is entirely bounded by streets, highways or rights-of-way, except alleys or between streets, highways, streams, parks, etc., or any other barriers or combination thereof, to the continuity of development.
BOARDThe Board of Aldermen of the City of Oak Grove.
BOARDING HOUSEAn establishment or part thereof that lodging and meals are provided by the owner or operator for at least three (3) but not more than eleven (11) persons for compensation whether the compensation is paid directly or indirectly.
BUFFERYARDLand area typically containing trees, shrubs or other plants, berms, fences or walls and used to visibly separate one use from another or to block noise, lights or other nuisances.
BUILDABLE AREAThe area of a lot remaining after the minimum yard and open space requirements of the Zoning Ordinance have been met.
BUILDINGAny structure having a roof supported by columns or walls and intended for the shelter, housing or enclosure of any individual, animal, process, equipment, goods or materials of any kind or nature.
BUILDING CODESThe Building Code of the City of Oak Grove, Missouri, together with the Electrical Code, Plumbing Code, Fire Code and any related code(s) adopted by the Oak Grove Board of Aldermen and any regulations adopted in conformance therewith.
BUILDING COVERAGEThe horizontal area measured within the exterior walls of the ground floor of all principal and accessory buildings on a lot divided by the gross area of the lot.
BUILDING FACADEThat portion of a building that is parallel or nearly parallel to the abutting roadway or parking lot.
BUILDING MATERIALSThe physical characteristics that create the aesthetic and structural appearance of the resource including, but not limited to, a consideration of the texture and style of the components and their combinations, such as bricks, stone, shingle, wood, concrete or stucco.
BUILDING OR SETBACK LINEA line parallel to a street or right-of-way line, shore or a lake, edge of a stream, other property line established on a parcel of land or lot for the purpose of prohibiting construction of a building or structure in the area between such building line and right-of-way, lakeshore, streambank or other property line.
BUILDING, PRINCIPALA building that the primary use of the lot, that the building is located on, is conducted.
BULK REQUIREMENTSStandards that control the height, intensity and location of structures.
BULK STORAGEThe storage of chemicals, petroleum products and other materials in above-ground containers for subsequent resale (wholesale) to distributors or retail dealers or outlets.
BUSINESS AREAAny zoning district designated for office, government and institutional, commercial and industrial use.
CABINET/CARPENTRY SHOPA use primarily engaged in the manufacturing or assembly of custom wood products for residential or business uses. This use does not include the large-scale, mass manufacture of wood products such as furniture.
CANDLEPOWERThe amount of light that will illuminate a surface one (1) foot distant from a light source to an intensity of one (1) foot-candle. Maximum (peak) candlepower is the largest amount of candlepower emitted by any lamp, light source or luminaire.
CANOPYAn architectural projection that provides weather protection, identity or decoration and is wholly supported by the building to which it is attached and at the outer end by not less than one (1) stanchion. A canopy is comprised of a rigid structure over which a covering is attached.
CAR WASHA use primarily engaged in cleaning or detailing motor vehicles, whether self-service, automatic or by hand.
CARNIVAL OR CIRCUSAn amusement enterprise consisting of rides, acts, shows, games, amusement devices or other similar devices or any combination of such devices.
CEMETERYProperty used for interring of the dead, including mausoleums.
CHANNELThe bed and banks of a natural stream which convey the constant or intermittent flow of the stream.
CHANNELIZATIONThe straightening and deepening of channels and/or the surfacing thereof to permit water to move rapidly and/or directly.
CITYThe City of Oak Grove, Missouri.
CITY ENGINEERThe officially appointed engineer of the City of Oak Grove, Missouri, or his/her duly appointed designee. The term may be abbreviated in this Chapter as the "Board".
CITY PLANNING AND ZONING COMMISSIONThe official appointed Planning and Zoning Commission of the City of Oak Grove. The term may be abbreviated in this Chapter as the "Commission".
CLUB, PRIVATEA use providing meeting, recreational or social facilities for a private association, primarily for use by members and guests. Typical uses include private social clubs, lodges and fraternal organizations.
COMMERCIAL VEHICLEAny vehicle designed, maintained or used primarily for the transportation of property or persons for hire.
COMMISSIONThe Oak Grove Planning and Zoning Commission.
COMMUNICATION TOWERAM/FM radio, television and microwave transmission towers and accessory equipment and buildings.
COMPENSATIONThe receiving of goods, services or money in exchange for or as a result of a service performed.
COMPOST FACILITYA commercial or public solid waste processing facility where yard or garden waste is transformed into soil or fertilizer by biological decomposition.
COMPREHENSIVE MARIJUANA FACILITYA "Comprehensive Facility" as defined by Article
XIV, Section 2, of the Missouri Constitution, a Comprehensive Marijuana Cultivation Facility, a Comprehensive Marijuana Dispensary Facility, or a Comprehensive Marijuana-Infused Products Manufacturing Facility.

COMPREHENSIVE MARIJUANA CULTIVATION FACILITYA facility licensed by the Missouri Department of Health and Senior Services to acquire, cultivate, process, package, store on-site or off-site, transport to or from, and sell Marijuana, Marijuana seeds, Marijuana vegetative cuttings (clones) to a Medical Marijuana Facility, Comprehensive Marijuana Facility, or Marijuana Testing Facility. A Comprehensive Marijuana Cultivation Facility need not segregate or account for its Marijuana products as either non-medical Marijuana or medical Marijuana. A Comprehensive Marijuana Cultivation Facility's authority to process Marijuana shall include the creation of Prerolls, but shall not include the manufacture of Marijuana-Infused Products.

COMPREHENSIVE MARIJUANA DISPENSARY FACILITYA facility licensed by the Missouri Department of Health and Senior Services to acquire, process, package, store on-site or off-site, sell, transport to or from, and deliver Marijuana, Marijuana seeds, Marijuana vegetative cuttings (clones), Marijuana-Infused Products, and drug paraphernalia used to administer Marijuana as allowed by applicable law to a qualifying patient or primary caregiver, as defined by law, or to a consumer, anywhere on the licensed property or to any address as directed by the patient, primary caregiver, or consumer and consistent with the limitations of applicable laws and as otherwise allowed by law, to a Comprehensive Marijuana Facility, a Marijuana Testing Facility, or a Medical Marijuana Facility. Comprehensive Marijuana Dispensary Facilities may receive transaction orders at the dispensary directly from the consumer in person, by phone, or via the internet, including from a third party. A Comprehensive Marijuana Dispensary Facility need not segregate or account for its Marijuana products as either non-medical Marijuana or medical Marijuana, but shall collect all appropriate tangible personal property sales tax for each sale, as set forth in Article
XIV of the Missouri Constitution and provided for by general or local law. A Comprehensive Marijuana Dispensary Facility's authority to process Marijuana shall include the creation of Prerolls.

COMPREHENSIVE MARIJUANA-INFUSED PRODUCTS MANUFACTURING FACILITYA facility licensed by the Missouri Department of Health and Senior Services to acquire, process, package, store, manufacture, transport to or from a Medical Marijuana Facility, Comprehensive Marijuana Facility, or Marijuana Testing Facility, and sell Marijuana-Infused Products, Prerolls, and Infused Prerolls to a Comprehensive Marijuana Dispensary Facility, a Marijuana Testing Facility, or another Comprehensive Marijuana-Infused Products Manufacturing Facility. A Comprehensive Marijuana-Infused Products Manufacturing Facility need not segregate or account for its Marijuana products as either non-medical Marijuana or medical Marijuana.

COMPREHENSIVE PLANThe Master Plan and its associated elements of the City of Oak Grove adopted by the Planning and Zoning Commission and Board of Aldermen containing analysis, recommendations and policies for the community's population, economy, housing, transportation, community facilities and land use.
CONDITIONAL USEA use permitted in a particular zoning district only upon showing that such use in a specific location will comply with all the conditions and standards for the location or operation of such use as specified in the Chapter and authorized by the Board of Aldermen.
CONDOMINIUMA building, group of buildings or property that units are owned individually with the common elements owned by all the owners on a proportionate, undivided basis.
CONSTRUCTION SALES AND SERVICEA use engaged in the retail or wholesale of materials used in the construction of buildings or other structures and the outdoor storage of construction equipment or materials on lots other than construction sites. Typical uses include lumberyards, home improvement centers, lawn and garden supply stores, electrical, plumbing, air conditioning and heating supply stores, swimming pool sales, construction contractors' storage yards and construction equipment rental establishments.
CONVALESCENT CAREA use providing bed care and in-patient services for persons needing regular medical attention, but excluding facilities for the care and treatment of mental illness, alcoholism, narcotics addiction, emergency medical services or communicable disease. Typical uses include nursing homes.
COPYThe letters, figures, characters, representations, pictures or wording on a sign, including any identification, description, symbol, trademark, object, design or logo illustration, illuminated or non-illuminated, that directs attention to a product, service, place, activity, person, institution, business or solicitation, including any permanently installed or situated merchandise; or any emblem or painting designed to advertise, communicate, identify or convey information.
CORRECTIONAL FACILITYA facility providing housing and care for individuals confined for violations of law.
CUL-DE-SACA street having one (1) end opened to traffic and being terminated by a vehicle turnaround.
CULTURAL SERVICEA facility providing cultural and educational services to the public. Typical uses include museums, art museums, observatories, planetariums, botanical gardens, arboretums, zoos and aquariums.
CURBA vertical or sloping edge of a roadway.
CUTOFFThe point that all light rays emitted by a lamp, light source or luminaire are completely eliminated (cutoff) at a specified angle above the ground.
CUTOFF ANGLEThe angle formed by a line drawn from the direction of light rays at the light source and a line perpendicular to the ground from the light source, above where no light is emitted.
CUTOFF-TYPE LUMINAIREA luminaire with elements such as shields, reflectors or refractor panels that direct and cut off the light at a cutoff angle that is less than ninety degrees (90°).
DAY CAREA use that provides care, protection and supervision for individuals on a regular basis away from their primary residence for less than twenty-four (24) hours per day.
DAY CARE, GENERALA day care establishment conducted in a private residence that provides care for seven (7) to ten (10) individuals at any one time, excluding those persons related to and residing in the home of the day care provider.
DAY CARE, LIMITEDA day care establishment conducted in a private residence that provides care for four (4) to six (6) individuals at any one time, excluding those persons related to and residing in the home of the day care provider.
DEDICATIONAn act transmitting property or interest thereto.
DEMOLITIONAny act or process that destroys in part or in whole any building or structure.
DENSITYThe permitted number of dwelling units per gross acre of land to be developed.
DESIGN FLOODThe relative size or magnitude of a major flood or reasonable expectancy which reflects both flood experience and flood potential and is the basis of the delineation of the floodway, the flood hazard area and the water surface elevations.
DETAILArchitectural aspects that, due to particular treatment, draw attention to certain parts or features of a structure.
DIRECTORThe Director of the Community Development Department of the City of Oak Grove, Missouri, or his/her designated representative.
DISTRICTA part, zone or geographic area within the area of Oak Grove where certain zoning regulations apply and are uniform.
DIVIDED STREETA street having an island or other barrier separating moving lanes.
DRAINAGEThe removal of surface water or ground water from land by drains, grading or other means.
DRAINAGE SYSTEMThe system through which water flows from the land, including all watercourses, waterbodies and wetlands.
DRIVEWAYA paved or unpaved area used for ingress or egress of vehicles and allowing access from a street to a building or other structure or facility.
DUPLEXA structure on a single lot containing two (2) dwelling units, each that is totally separated from the other.
DWELLINGA building or portion therefor designed and used exclusively by individuals for no less than thirty (30) day residential occupancy with complete cooking and sanitary facilities, excluding hotels, motels, boarding, rooming and lodging houses and institutional care facilities.
DWELLING, MULTI-FAMILYA dwelling on a single lot containing three (3) or more dwelling units where each is totally separated from the others.
DWELLING, SINGLE-FAMILY, ATTACHEDA dwelling unit attached to one (1) or more dwelling units by common vertical walls and each dwelling unit is located on a separate lot. This definition may include the term zero lot line, twin house or patio house.
DWELLING, TOWN HOUSEA dwelling unit of at least three (3) such units where each unit has its own front and rear access to the outside, no unit is located over another unit, and each unit is separated from any other unit by one (1) or more common walls.
DWELLING UNITOne (1) or more rooms located within a dwelling that creates an independent housekeeping establishment for occupancy by one (1) family with separate toilets and facilities for cooking and sleeping.
EASEMENTA right-of-way granted, but not dedicated, for limited use of private land for a public or quasi-public purpose and within which the owner of the property shall not erect any permanent structures.
ECONOMIC HARDSHIPWhen the landowner cannot economically utilize the property and it is impractical to sell or lease it or no market exists for it at a reasonable price.
ENGINEERA professional engineer registered in the State of Missouri.
ENGINEERING DRAWINGSThe construction or public works plans showing types of materials and construction details for physical structures and facilities, including dwelling units to be installed in conjunction with development of subdivision.
ERECTThis term shall mean attach, alter, build, construct, reconstruct, enlarge or move.
ESCROWMoney delivered to a third person to be delivered by him/her to the grantee only upon fulfillment of a condition.
FAMILYThe following living arrangements shall constitute a family for the purposes of this Chapter:
1. One (1) or more persons related by blood, marriage, adoption or custodial relationship living as a single housekeeping unit;
2. Three (3) or less persons living as a single housekeeping unit; or
3. Two (2) unrelated persons, plus their biological, adopted or foster children or other minors for whom they have legally established custodial responsibility, living as a single housekeeping unit.
Domestic servants, employed on the premises, may be housed on the premises without being counted as part of the family. The term "family" shall not be construed to mean a fraternity, sorority, club or institutional group. |
FENCEAn enclosure or barrier such as wooden posts, wire, iron, etc., used as a boundary, means of protection, privacy screening or confinement, but not including hedges, shrubs, trees or other natural growth.
FINAL APPROVALThe official action taken on a preliminary approved major subdivision or site plan after all conditions, engineering drawings and other requirements have been completed or fulfilled.
FINAL PLATThe final maps of all or portion of a subdivision which is presented for final approval.
FLASHING LIGHTA continuously intermittent light or sequential light, but not including animation or lighting changes that change the copy of a sign.
FLEXTECHA use combining office and warehousing; office and light assembly; or office, warehousing and light assembly activities within the same building. Flextech buildings typically have office storefronts on one (1) side of the structure and loading docks or roll-up doors on the other side. Loading and service areas are screened from view of public right-of-way, public recreation facilities and lower intensity zoning districts. Flextech uses may involve retail sales of merchandise as an accessory use.
FLOOR AREAFor non-residential buildings or buildings containing residential and non-residential uses, "floor area" means the sum of the gross horizontal area of all floors of the building measured from the exterior faces of the exterior walls. For residential buildings, "floor area" shall mean the gross horizontal area of all floors in a dwelling measured from the external faces of the exterior walls. Garages, basements and open porches shall be excluded when measuring residential floor area.
FLOOR AREA RATIO (FAR)The gross floor area of all buildings on a lot divided by the lot area. For the purpose of this Chapter, parking decks are not included in calculating the floor area ratio.
FOOT-CANDLEA unit of illumination produced on a surface, all points of which are one (1) foot from a uniform point source of one (1) candle.
FREIGHT TERMINALA building or area in which freight brought by truck, rail or air is processed for continued shipment by truck, rail or air.
FRONTAGEThat part of a lot or premise immediately adjacent to a street or streets without regard to access to or elevation of the street or streets.
FUNERAL HOMEA building used for the preparation of the deceased for burial and the display of the deceased and ceremonies connected therewith before burial or cremation, but shall not include facilities for cremation.
GAS AND FUEL SALES/STORAGEThe use of a site for bulk storage and distribution and sales of flammable liquid, gas or solid fuel, excluding below-ground storage that is clearly ancillary to an allowed principal use on the site.
GLAREThe effect produced by brightness sufficient to cause annoyance, discomfort or loss in visual performance and visibility.
GOLF COURSEA facility providing private or public golf recreation services and support facilities. This definition shall exclude miniature golf courses and golf driving ranges except those that are clearly accessory uses. (See "RECREATION AND ENTERTAINMENT, OUTDOOR").
GOVERNMENT SERVICEBuildings or facilities owned or operated by a government entity and providing services for the public, excluding utilities and park and recreation services. Typical uses include administrative offices of government agencies and utility billing offices.
GRADEThe slope of a street or other public way specified in percentage terms.
GREENHOUSEA building whose roof and sides are made largely of glass or other transparent or translucent material and in which the temperature and humidity can be regulated for the cultivation of delicate or out-of-season plants for subsequent sale or for personal enjoyment.
GROUP HOME, GENERALA facility providing twenty-four (24) hour care in a protected living environment for more than eight (8) persons with physical or mental disabilities and any number of caregivers.
GROUP HOME, LIMITEDA facility providing twenty-four (24) hour care in a protected living environment for no more than eight (8) persons with physical or mental disabilities and up to two (2) house parents or caregivers.
GROUP RESIDENTIALThe use of a site for occupancy by groups of more than five (5) persons, not defined as a family, on a weekly or longer basis. Typical uses include fraternity or sorority houses, dormitories, residence halls and boarding or lodging houses. The term "group residential" does not include "group homes".
GUTTERA shallow channel usually set along a curb or the pavement edge of a road for purposes of catching and carrying runoff water.
HAZARDOUS OPERATIONActivities that present the potential for serious hazards to human life and health. Typical uses include arsenals, atomic reactors, explosives and fireworks manufacture, hazardous waste disposal, medical waste disposal and radioactive waste handling.
HAZARDOUS SUBSTANCEAny substances or materials that, by reason of their toxic, caustic, corrosive, abrasive or otherwise injurious properties, may be detrimental or harmful to the health of any person handling or otherwise coming into contact with such material or substance.
HEALTH CLUBA facility where members or non-members use equipment or space for the purpose of physical exercise.
HEIGHTThe vertical distance of a structure measured from the average established grade at the street lot line or from the average natural ground level, if higher; or if no street grade has been established, to the highest point of the roof's surface if a flat surface; to the deck line of mansard roofs; and to the mean height level between the eaves and ridge for hip or gable roofs. In measuring the height of a building, the following structures shall be excluded: chimneys, cooling towers, telecommunication towers, ornamental cupolas, domes or spires, elevator bulk heads, penthouses, tanks, water towers, and parapet walls not exceeding four (4) feet in height.
HELIPORT OR HELIPADAn area, either on the ground or on a building, used as a landing pad for helicopters to pick up or discharge passengers or cargo.

HOTEL OR MOTELA facility used, maintained or advertised as a place where sleeping accommodations, in rooms without individual kitchens, are supplied for short-term rent to transient guests. Typical uses include hotels and motels.
IDEOLOGICAL AND NON-COMMERCIAL SIGNA sign which does not name or advertise a product, service or business but only expresses a viewpoint, non-commercial message, opinion or idea. This includes commemorative plaques, historic markers, holiday decorations, political signs, political or fraternal flags or emblems or protective signs which are commonly associated with safeguarding the permitted uses of a premise, including, but not limited to, vicious dog, no trespassing, neighborhood watch and authorized parking only.

IMPERVIOUS SURFACEAny part of a lot that is covered by buildings, structures, parking areas, driveways and any other surfaces which reduce or prevent absorption of stormwater.
IMPOUNDMENTA body of water, such as a pond, confined by a dam, dike, floodgate or other barrier.
IMPROVEMENTStreet work, utilities, sidewalks, drainage structures and other physical modifications which are to be installed or constructed by the subdivider for the benefit of the lot owners and for the proper development of the community as a condition precedent to the approval and acceptance of the final plat.
INFUSED PREROLLA consumable or smokable Marijuana product, generally consisting of: (1) a wrap or paper; (2) dried flower, buds, and/or plant material; and (3) a concentrate, oil or other type of Marijuana extract, either within or on the surface of the product. Infused Prerolls may or may not include a filter or crutch at the base of the product.

KENNELAn establishment licensed to operate a facility housing dogs, cats or other household pets and where grooming, breeding, boarding, training or selling of animals is conducted as a business.
LANDFILLA disposal facility employing an engineered method of disposing of solid waste, including demolition and construction debris.
LANDSCAPING MATERIALSLandscape materials include lawns, trees, plants and other natural and decorative features. In addition, it can include non-living materials such as mulch, brick, concrete, stone, cobbles, wood blocks, gravel and sand.
LATERAL SEWERSPipes conducting sewage from individual buildings to larger pipes called trunk or interceptor sewers that usually are located in street rights-of-way.
LAUNDRY SERVICEA use that is primarily engaged in the large-scale washing or cleaning of laundry, rugs and similar materials. This definition does not include laundromat or dry cleaning pickup stations.
LOADING SPACEAn off-street space or berth on the same lot with a building or contiguous to a group of buildings for the temporary parking of a commercial vehicle while loading or unloading merchandise or materials.
LOTA parcel of property that complies with the minimum lot area and setback standards of this Unified Development Code which is developed or intended to be developed as a unit under single ownership or control. A lot may consist of one (1) or more lots of record, one (1) or more portions of a lot or lots of record or any combination thereof.
LOT AREAThe total horizontal area within the lines of a lot.
LOT, CORNERA lot situated at the intersection of two (2) or more streets.
LOT DEPTHThe horizontal distance between the front and rear lot lines measured along the median between the two (2) side lot lines.
LOT, ENDA lot on either end of a row of lots and intended for a town house attached on one (1) side to another town house and with a yard on the opposite side.
LOT FRONTAGEThat portion of a lot extending along a street line.
LOT, FRONT OFThe front of a lot shall be considered to be that side of the lot which fronts on a street. In the case of a corner lot, the narrowest side fronting on the street shall be considered to be the front of the lot. In case the corner lot has equal frontage on two (2) or more streets, the lot shall be considered to front on that street which the greatest number of lots front.
LOT LINE, FRONTThe lot line separating a lot from the street. On a corner lot, the shortest lot line abutting a street is the front lot line; on a through lot, both lot lines abutting the streets are the front lot lines; on a flag shaped lot, the front lot line is also that lot line most parallel to the front lot line abutting the street.
LOT LINE, REARAny lot line not a front or side lot line. The rear lot line for a triangular shaped lot shall be a line ten (10) feet long drawn between the lot's side lot lines and parallel to the front lot line.

MAINTENANCE GUARANTEEAny security that may be required and accepted by a governmental agency to ensure those necessary improvements will function as required for a specific period of time.
MANUFACTURED HOME DEVELOPMENTA site with required improvements and utilities for the long-term placement of manufactured homes for dwelling purposes. Services and facilities for residents of the development may also be included on the site.
MANUFACTURED HOUSING UNITA transportable, factory-built structure that is manufactured in accordance with the Federal Manufactured Housing Construction and Safety Standards Act of 1974 (42 U.S.C. Section 5401) and that is designed to be used as a single dwelling unit.
MANUFACTURING AND ASSEMBLYAn establishment engaged in the manufacture, predominately from previously prepared materials, of finished products or parts, including processing, fabrication, assembly, treatment and packaging of such products and incidental storage, sales and distribution of such products, but excluding basic industry.
MARGINAL ACCESS STREETA service street that runs parallel to a higher-order street which, for purposes of safety, provides access to abutting properties and separation from through traffic. May be designed as a residential access street or subcollector as anticipated daily traffic dictates.
MARIJUANA or MARIHUANACannabis indica, Cannabis sativa, and Cannabis ruderalis, hybrids of such species, and any other strains commonly understood within the scientific community to constitute marijuana, as well as resin extracted from the plant and Marijuana-Infused Products. "Marijuana" or "Marihuana" do not include industrial hemp as defined by Missouri Statute, or commodities or products manufactured from industrial hemp.

A Medical Marijuana Cultivation Facility's authority to process Marijuana shall include the production and sale of Prerolls, but shall not include the manufacture of Marijuana-Infused Products.

MEDICAL MARIJUANA DISPENSARY FACILITYA facility licensed by the Missouri Department of Health and Senior Services to acquire, cultivate, process, package, store on-site or off-site, sell, transport to or from, and deliver Marijuana, Marijuana seeds, Marijuana vegetative cuttings (also known as clones), Marijuana-Infused Products, and drug paraphernalia used to administer Marijuana as provided for in this Code to a qualifying patient, a primary caregiver, anywhere on the licensed property or to any address as directed by the patient or primary caregiver, so long as the address is a location allowing for the legal possession of Marijuana, another Medical Marijuana Dispensary Facility, a medical Marijuana Testing Facility, a Medical Marijuana Cultivation Facility, or a Medical Marijuana-Infused Products Manufacturing Facility. Medical Marijuana Dispensary Facilities may receive transaction orders at the dispensary in person, by phone, or via the internet, including from a third party. A Medical Marijuana Dispensary Facility's authority to process Marijuana shall include the production and sale of Prerolls, but shall not include the manufacture of Marijuana-Infused Products.

MEDICAL SERVICEA use providing therapeutic, preventive or corrective personal treatment services on an out-patient basis by physicians, dentists and other practitioners of the medical or healing arts and the provision of medical testing and analysis services. Typical uses include clinics and offices for doctors of medicine, dentists, chiropractors, osteopaths, optometrists, blood banks and medical laboratories.
MICROBUSINESS DISPENSARY FACILITYA facility licensed by the Missouri Department of Health and Senior Services to acquire, process, package, store on-site or off-site, sell, transport to or from, and deliver Marijuana, Marijuana seeds, Marijuana vegetative cuttings (clones), Marijuana-Infused Products, and drug paraphernalia used to administer Marijuana as allowed by law to a qualifying patient or primary caregiver, as defined by law, or to a consumer, anywhere on the licensed property or to any address as directed by the qualifying patient, primary caregiver, or consumer and consistent with the limitations of Article
XIV of the Missouri Constitution and as otherwise allowed by law, a Microbusiness Wholesale Facility, or a Marijuana Testing Facility. Microbusiness Dispensary Facilities may receive transaction orders at the dispensary directly from the consumer in person, by phone, or via the internet, including from a third party. A Microbusiness Dispensary Facility's authority to process Marijuana shall include the creation of Prerolls.

MICROBUSINESS WHOLESALE FACILITYA facility licensed by the Missouri Department of Health and Senior Services to acquire, cultivate, process, package, store on-site or off-site, manufacture, transport to or from, deliver, and sell Marijuana, Marijuana seeds, Marijuana vegetative cuttings (clones) and Marijuana-Infused Products to a Microbusiness Dispensary Facility, other Microbusiness Wholesale Facility, or Marijuana Testing Facility. A Microbusiness Wholesale Facility may cultivate up to two hundred fifty (250) flowering Marijuana plants at any given time. A Microbusiness Wholesale Facility's authority to process Marijuana shall include the creation of Prerolls and Infused Prerolls.

MINOR SUBDIVISIONA subdivision of land of not more than five (5) lots, provided that such subdivision does not involve a planned development, any new street or the extension of a utility or other municipal facility.
MOBILE HOMEA transportable, factory-built structure that was manufactured prior to the enactment of the Federal Manufactured Housing Construction and Safety Standards Act of 1974 (42 U.S.C. Section 5401) and that is designed to be used as a single dwelling unit.
MOBILE HOME DEVELOPMENTA site with required improvements and utilities for the long-term placement of mobile homes for dwelling purposes. Services and facilities for residents of the development may also be included on the site.
MODULAR HOMEA factory-built transportable structure which bears the seal of the State of Missouri Public Service Commission or is built to the UBC Basic Code as adopted by the City of Oak Grove and which does not have its own running gear and is designed to be used as a dwelling unit with a permanent foundation.
MOUNTABLE CURBA low curb with a flat slope designed to be crossed easily without discomfort.
MULTI-FAMILYThe use of a site for three (3) or more dwelling units within a single building. Typical uses include triplexes, four-plexes, apartments and residential condominiums.
NEW CONSTRUCTIONFor the purposes of determining insurance rates, structures for which the "start of construction" commenced on or after the effective date of an initial FIRM or after December 31, 1974, whichever is later, and includes any subsequent improvements to such structures.
NON-CONFORMING STRUCTUREAny structure that does not meet the limitations on structure size and location on a lot for the district in which such structure is located and for the use to which such structure is being put at the time the structure was established.
NON-CONFORMING USEA use of land that does not comply with the use regulations for its zoning district but which complied with applicable regulations at the time the use was established.
OFFICE, GENERALA use providing executive, management, administrative or professional services, but not medical or dental services or the sale of merchandise, except as incidental to a permitted use. Typical uses include real estate, insurance, property management, investment, employment, travel, advertising, law, architecture, design, engineering, accounting and similar offices.
OFF-SITELocated outside the lot lines of the lot in question but within the property (of which the lot is a part) that is the subject of a development application or on a contiguous portion of a street or right-of-way.
ON-SITELocated on the lot in question.
OPEN SPACEAny occupied space on a lot that is unobstructed to the sky except for the ordinary projection of cornices and eaves. Open space shall not include areas covered by structures, decks, porches, parking areas, driveways, internal streets and other forms of impervious surfaces. Water bodies that are not subject to public ownership shall also be included as open space.
ORDINARY MAINTENANCE AND REPAIRWhere the purpose of the work is stabilization or is normal, customary and routine affecting the exterior of the structure or the outside of the site.
OUTDOOR DISPLAYThe placement of products in their finished state for public viewing as a means of advertising. Such products may include automobiles, portable buildings, outdoor furniture and other similar items. Landscape materials such as mulch, rock and plant material may be displayed as part of a finished landscape but may not be displayed in bulk.
OUTDOOR STORAGEThe placement of raw materials prior to manufacture or sale. Items may include lumber, fencing or bulk landscape materials.
OWNERThe property owner of record according to the County Recorder of Deeds.
PARKING AREA, OFF-STREETA permanently surfaced, dust-free area (concrete, asphaltic concrete or other comparable surface) enclosed or unenclosed for the short-term storage of automobiles.

PARKS AND RECREATIONA park, playground or community facility, owned by or under the control of a public agency or property owners' association, that provides opportunities for active or passive recreational activities.

PEAK HOUR TRIPSTotal number of trip ends generated by a site during the hour when the adjacent street carries the maximum number of trips or during the hour when the site generates the maximum number of trip ends.
PEDESTRIAN WAYA separate right-of way dedicated to or reserved for public use by pedestrians which crosses blocks or other tracts of land to facilitate pedestrian access to adjacent streets and properties.
PERFORMANCE GUARANTEEAny security that may be accepted by a municipality as a guarantee that the improvements required as part of an application for development are satisfactorily completed.
PERSONAny individual, corporation, association, firm, partnership, institution or legal entity, singular or plural.
PLANNED UNIT DEVELOPMENTAn area of a minimum contiguous size, as specified by ordinance, to be planned, developed, operated and maintained as a single entity containing one (1) or more structures to accommodate commercial, office or residential uses or all in any combination thereof and appurtenant common area and other uses incidental to the predominant uses.
PLATA map or maps of a subdivision or site plan.
PORCHA roofed, open area usually attached to or part of and with indirect access to or from a building. A porch becomes a room when the space enclosed is heated or air conditioned or, if glazed, when the percentage of the window area to wall area of the porch, not attached to the building, is less than seventy-five percent (75%).

RECREATION AND ENTERTAINMENT, INDOORA use offering recreation, entertainment or games of skill to the public for a fee or charge and that is wholly enclosed in a building. Typical uses include bowling alleys, indoor theaters, bingo parlors, pool halls, billiard parlors and video game arcades.
RECREATION AND ENTERTAINMENT, OUTDOORA use offering recreation, entertainment or games of skill to the public for a fee or charge wherein any portion of the activity takes place in the open. Typical uses include archery ranges, batting cages, golf driving ranges, drive-in theaters and miniature golf courses.
RECREATIONAL VEHICLE[Ord. No. 1807 §3, 11-17-2014]
1. A vehicular-type unit designed for temporary living quarters for recreational, camping, or travel use, which either has its own motive power or is mounted on or drawn by another vehicle.
a. DEPENDENT RVAn RV not containing sanitary facilities and/or devices for connecting the facilities to a community waste disposal system.
b. INDEPENDENT RVAn RV containing sanitary facilities and devices for connecting the facilities to a community waste disposal system.
2. The term "recreational vehicle" shall include, but not be limited to, the following:
a. TRAVEL TRAILERA vehicular, portable structure built on a chassis and drawn by a motorized vehicle and which is designed to be used as a temporary dwelling for travel, recreational and vacation uses;
b. CAMPERA structure designed to be mounted on a truck chassis for use as a temporary dwelling for travel, recreational and vacation uses;
c. MOTOR HOMEA portable, temporary dwelling to be used for travel, recreational and vacation uses and which is constructed as an integral part of a self-propelled vehicle;
d. CAMPING TRAILERA folding structure mounted on wheels and designed for travel, recreational and vacation uses;
e. PARK TRAILERA trailer-type unit that is primarily designed to provide temporary living quarters for recreational, camping or seasonal use, that meets the following criteria:
(1) Built on a single chassis, mounted on wheels;
(2) Having a gross trailer area not exceeding four hundred (400) square feet (37.15 square meters) in the setup mode; and
(3) Certified by the manufacturer as complying with ANSI A119.5;
f. Tents. An enclosed structure or shelter fabricated entirely or in major part of cloth, canvas, plastic or similar material which is erected for periods not exceeding thirty (30) days for recreational or vacation purposes. For the purpose of this Code, a tent shall be considered as a dependent camping vehicle.
RECREATIONAL VEHICLE PARKLand used or intended to be used for occupancy by recreational vehicles for transient living purposes, including the use of camping spaces for tents.
RECREATIONAL VEHICLE SALES AND SERVICEA use engaged in the retail sale of recreational vehicles from the premises along with incidental service or maintenance activities within completely enclosed buildings and an outdoor area used or intended to be used for storage of recreational vehicles displayed for sale.

RECREATIONAL VEHICLE SPACEA designated and defined parcel of land within a recreational vehicle park intended for temporary location of a recreational vehicle as a dwelling unit.

REPAIR SERVICEA use primarily engaged in the provision of repair services to individuals and households, but excluding vehicle repair services. Typical uses include appliance repair shops.
RESEARCH SERVICEA use engaged in conducting basic and applied research, including production of prototype products when limited to the minimum scale necessary for full investigation of the merits of a product, excluding production of products used primarily or customarily for sale or for use in non-prototype production operations.
RESTAURANT, FAST-FOODA use primarily engaged in the sale of food and non-alcoholic beverages in a ready-to-consume state. The design or principal method of operation is that of a fast-food or drive-in restaurant offering quick food service; where orders are generally not taken at the customer's table; where food is generally served in disposable wrapping or containers; and where food and beverages may be served directly to the customer in a motor vehicle.
RESTAURANT, GENERALA use where the principal business is the sale of food and beverages in a ready-to-consume state.
RETAIL SALES AND SERVICEA use engaged in the sale or rental of goods and services, excluding uses more specifically defined.
RETENTION BASINA pond, pool or basin used for the permanent storage of water runoff.
RIGHT-OF-WAYA strip of land occupied or intended to be occupied by a street, crosswalk, railroad, road, electric transmission line, gas pipeline, water main, sanitary or storm sewer main, shade trees or for another special use.
ROADWAYThe actual road surface area from curbline to curbline, which may include travel lanes and parking lanes. Where there are no curbs, the roadway is that portion between the edges of the paved or hard surface width.
SAFETY SERVICEA facility for conduct of public safety and emergency services, including fire and Police protection services and emergency medical and ambulance services.
SALE OR LEASEAny immediate or further transfer of ownership, including contract of sale or transfer of an interest in a subdivision or part thereof, whether by meters and bounds, deed, contact, plat, map or other written instrument.

SERVICE STATION, AUTOMOTIVEA use primarily engaged in the retail sale of gasoline or other motor fuels to automobiles and passenger vehicles, along with accessory activities such as the sale of lubricants, accessories or supplies, the lubrication of motor vehicles and the minor adjustment or repair of passenger motor vehicles. Uses involved primarily in the sale of diesel fuel, gasoline or other fuels to tractor trucks and uses that feature parking, storage or servicing of tractor trucks or semi-trailers shall be classified as "Truck Stop Service Stations".
SERVICE STATION, TRUCK STOPA use primarily engaged in the sale of diesel fuel, gasoline or other fuels to tractor trucks, along with accessory activities such as the sale of lubricants, accessories or supplies or the servicing of tractor trucks or semi-trailers. A truck stop service station may include, as an accessory use, the parking and storage of tractor trucks or semi-trailers.
SETBACKThe required minimum horizontal distance between the lot line and the nearest front, side or rear line of the building, as the case may be.
SEWERAny pipe conduit used to collect and carry sewage or stormwater runoff from the generating source to treatment plant or receiving streams.
SHORT-TERM LOAN SERVICE shall include1. PAYDAY LOAN BUSINESSThe business of making loans for a period of thirty (30) days or less in duration, intended to coincide with the period from one payday of the borrower to the next, and in principle amounts of five hundred dollars ($500.00) or less.
2. TITLE LOAN BUSINESSA business that primarily lends money with the pledge of personal property as collateral, evidenced by a certificate of title issued by the State of Missouri, and regulated under Sections 367.500 through 367.533, RSMo., as from time-to-time amended.
SIDEWALKA paved path provided for pedestrian use and usually located at the side of a road within the right-of-way.
SIGHT TRIANGLEA triangular-shaped portion of land established at street intersections in which nothing is erected, placed, planted or allowed to grow in such a manner as to limit or obstruct the sight distance of motorists entering or leaving the intersection.
SIGNAny medium, including its structure and component parts, that is used or intended to be used to attract attention for identification, announcement or advertising purposes. This definition applies to all signs with letters, emblems or logos of more than three (3) inches in height. Signs on vending machines will be counted in the allowable sign area. If located against the building facade, they will not be counted as a freestanding sign.
SIGN AREAThe area of the face of the sign within a perimeter that forms the outside shape, but excluding the necessary supports or uprights that the sign may be placed unless these supports or uprights are designed as part of the sign. If the sign consists of more than one (1) section or module, all areas will be totaled. The area of an irregularly shaped sign shall be computed using the actual sign face surface. In the case of an irregularly shaped sign or a sign with letters and/or symbols directly affixed to or painted on the wall of a building or a window, the area of the sign shall be the entire area within a single continuous rectilinear perimeter of not more than eight (8) straight lines enclosing the extreme limits of writing, representation, emblem or any figure or similar character, together with any logo material or color forming an integral part or backdrop of the display or used to differentiate such sign from the backdrop or structure.
SIGN, ATTACHEDAny sign substantially and permanent attached to, applied on, structurally connected to, painted on, engraved on, etched on or supported by any part of a building.
SIGN, BACK-TO-BACKA sign with copy on two (2) parallel faces that are facing in opposite directions not separated by more than twelve (12) inches. The area of a back-to-back sign is calculated on one (1) face only.
SIGN BANNERA sign having the character, letters, illustrations or ornamentation applied to cloth, or lightweight fabric material for advertising a product, business, service, show, property, or carnival.
SIGN, BILLBOARDAny sign with a sign area in excess of three hundred fifty (350) square feet that advertises or directs attention to a business, commodity, service or entertainment conducted, sold or offered at a location other than the premise that the sign is located.
SIGN, CHANGEABLE COPYA sign such as a manual, electronic or electric controlled time and temperature sign, message center or reader board, whether electronic, electric or manual, where copy changes. Any sign may be, or include as part of it, a changeable message sign.
SIGN, DETACHEDAny sign other than an attached sign and including any inoperable vehicle or any trailer located for the primary purpose of advertising.
SIGN, DIRECTIONALAny sign that serves solely to designate the location of or direction to any premise or area.
SIGN, FLATAny sign that the back is attached flat against any part of a building or structure and that does not extend outward more than six (6) inches or any sign painted upon any building or structure or upon a window thereof.
SIGN, ILLUMINATEDA sign lighted by electricity or any other source of power. A sign with an artificial light source incorporated internally or externally for the purpose of illuminating the sign.
SIGN, MONUMENTA freestanding sign mounted on an enclosed, structural base which base length is equal to or greater than the length of the sign face, which base depth is not narrower than the structure containing the sign face or twelve (12) inches, whichever is greater, and which total overall height does not exceed eight (8) feet.
SIGN, NON-CONFORMINGAny sign that was in existence and displayed on the effective date of this Sign Code but that does not conform to the requirements and limitations hereof or any sign that was lawfully in existence and displayed on the effective date of any amendment to this Sign Code but that does not conform to such amendment.
SIGN, ON-PREMISEAny sign designating the name of the owner or occupant of the premises upon which the sign is placed, or identifying such premises, or advertising goods manufactured or produced, or services rendered on or listing the sale or lease of the premises upon which the entire sign is located.
SIGN, POLEA sign supported by a sign structure in the ground and that is wholly independent of any building, other than the sign structure, for support.
SIGN, PORTABLEAny sign not permanently attached to the ground or other permanent structure or a sign designed to be transported by means of wheels.
SIGN, PROJECTINGAny sign attached to any part of a building or structure and that extends outward more than six (6) inches. Canopies and awnings shall not be considered projecting signs if they do not contain signage information. However, when they do provide signage information, canopies and awnings shall constitute projecting signs.
SIGN, SPECIAL EVENTA sign that carries a message regarding a special event or function that is of general interest to the community and does not include for-profit business promotional activities that are strictly commercial in nature. Such signs may include banners or seasonal decorations and may be placed within the right-of-way.
SIGN STRUCTUREAny words, numbers, figures, devices, designs or trademarks by which anything is made known, such as are used to designate an individual, a firm, profession, business or a commodity and which are visible from any public street. Any device that supports, has supported or is designed to support a sign, including any decorative cover, exclusive of any copy.
SIGN, TEMPORARY (PORTABLE SIGNS)A sign which either:
1. Is not permanently attached to any structure building, motor vehicle or the ground;
2. Is intended for a limited display period covering a special event; or
3. Is designed and constructed to be movable from one location to another.
SIGN, WINDOWAny sign advertising sales of specials attached to any window visible from a public right-of-way. Window signs must be located inside the window and shall be limited to only temporary advertisement of sales or specials. When a sign is permanently painted on or otherwise attached or applied to the window area so as to be visible to the general public, then such sign shall be included in the total allowable sign area for the building. Window signs shall not be placed on door windows or other windows needed to be clear for pedestrian safety.
SITE PLANAn accurately scaled development plan that illustrates the existing conditions on a land parcel, as well as depicting details of a proposed development.
SKETCH PLANA rough plan of a proposed subdivision or other development.
SOLID SCREENINGA device or materials used to conceal one (1) element of a development from other elements or from adjacent or contiguous development. Screening may include one (1) or a combination of the following materials of sufficient mass to be opaque or that shall become opaque after twelve (12) months and which shall be maintained in an opaque condition: solid fences, walls, berms, plantings or other features. A chain link fence with plastic or wooden inserts shall not be considered solid screening.
SOLID WASTE COLLECTION/PROCESSINGIncinerators, processing facilities, materials recovery facilities, solid waste transfer stations or any facility where municipal solid wastes are salvaged, sorted, processed or treated.
STOCKYARDA non-farm-based facility used or intended to be used for selling or holding livestock.
STORYThat portion of a building included between the surface of any floor and the surface of the next floor above it or, if there is no floor above it, then the space between such floor and the ceiling next above it.
STORY, FIRSTThe lowest story in a building that qualifies as a story as defined herein, except that a floor level in a building having only one (1) floor level shall be classified as a story, provided such floor level is not more than four (4) feet below grade, as defined herein, for more than fifty percent (50%) of the total perimeter or not more than eight (8) feet below grade, as defined herein, at any point.
STREETA public or private way used or intended to be used for passage or travel by motor vehicles. Streets are further classified by the functions they perform as follows:
STREET, COLLECTORA street which collects and distributes traffic to and from local and arterial street systems and is primarily intended to provide for low-to-moderate volume, low speed and short length trips while also providing access to abutting property.
STREET GRADEThe highest altitude of the street vertically under any portion of the sign or its supports.
STREET, LOCALA street primarily providing direct access to abutting properties and designed to accommodate low-volume, low-speed traffic (typically less than five hundred (500) vehicles per day).
STREET, PRIMARY ARTERIALA street primarily intended to provide for high-volume, moderate-speed traffic (normally carrying ten thousand (10,000) to fifteen thousand (15,000) vehicles per day) and moderate to extended trip length traffic movement between major activity centers. Access to abutting property is subordinate to major traffic movement and is subject to the necessary control of entrances and exits.
STREET, SECONDARY ARTERIALA street that interconnects, augments and feeds the primary arterial system and is intended for moderate-volume, moderate-speed traffic (with a volume range of five thousand (5,000) to ten thousand (10,000) vehicles per day) and short to moderate trip lengths. Access to abutting property is partially controlled.
STREET WIDTHThe horizontal distance between the outside edges of a street's pavement, including any curbing and guttering, measured at right angles to the street's centerline.
STRUCTUREAnything constructed or erected, the use of which requires permanent or temporary location on or in the ground, including, but not without limiting the generality of the foregoing: houses, buildings, barns, backstops for tennis courts, bridges, fences, pergolas, parking lots, gazebos, radio and television antennae, signs, solar collectors, microwave antennae including supporting towers, roads, ruins or remnants (including foundations), swimming pools, walkways, septic systems or any similar item.
STUDIO, TELEVISION OR FILMA use primarily engaged in the provision of recording or broadcasting services accomplished through the use of electronic mechanisms.
SUBDIVIDERA person, firm, corporation, partnership or association which causes land to be divided into a subdivision for itself or for others.
SUBDIVISIONThe division of tract of land into two (2) or more lots or parcels for the purpose of transfer of ownership or building development or, if a new street is involved, any division of a parcel of land. However, the division of land shall not be considered to be a subdivision when the smallest parcel created is more than forty (40) acres in area. The term "subdivision" includes resubdivision and the term "resubdivision", as used herein, shall include any further subdivision of a lot or parcel of land previously subdivided for sale, use or other purpose which vary from the latest, approved plat of the same.
SURVEYORA professional land surveyor registered in the State of Missouri.
TEMPORARY PROMOTIONAL USEAn activity which may commonly be described as carnival rides or amusement park rides as accessory uses to an existing and legally conforming business use or uses and for the purposes of promoting business sales and/or raising funds for community service organizations or for the purpose of promoting any special event, any community educational campaign, any membership drive or any other similar promotion and which activity is established for a fixed period of time with the intent to discontinue such activity upon the expiration of the time period.
TERRACEA level, landscaped area directly adjacent to a principal building at or within three (3) feet of the finished grade and not covered by a permanent roof or enclosed by temporary or permanent walls.
TOWERA structure with a fixed location which is designed primarily with the objective of obtaining an elevation above other objects to support an antenna or other device for receiving or transmitting radio, television, microwave or other telecommunications or signals. This definition does not apply to utility poles.
TRANSIT FACILITYA facility used or intended to be used as an area for loading, unloading and interchange of transit passengers. Typical uses include bus terminals, rail stations and passenger-related mass transit facilities.
TRANSITIONAL LIVING CENTERState licensed group-care homes for juvenile delinquents, halfway houses providing residence, rehabilitation and counseling to persons on release from a more restrictive custodial confinement and residential rehabilitation treatment centers which also may provide out-patient rehabilitation for alcohol and other drug abuse.
TRANSPORTATION FACILITYA facility certified by the Missouri Department of Health and Senior Services to house operations involving the transport of Marijuana product to or from a Marijuana Facility or Medical Marijuana Facility; or to a qualifying patient, primary caregiver, or consumer.

TRIP ENDSThe total number of all trips entering plus all trips leaving a designated site over a given period of time.
UNINHABITABLELands that are subject to flooding or otherwise deemed uninhabitable/unusable in their natural state by the Planning Commission and City Council shall not be platted for residential use or for any other use that might create a danger to health, safety or property, or which might increase the flooding hazard within or outside the subdivision. Such lands shall be set aside for recreational use or shall be retained in their natural state as open space; provided however, that such lands may be platted and developed if the features making the lands uninhabitable/unusable can reasonably be removed without destruction of adjacent or nearby property or desirable natural features of the land and if necessary approval is obtained from the Planning and Zoning Commission and the City Council. In all platting adjacent to such area, adequate provisions for access to said areas, as determined by the City Engineer, shall be provided.
USABLE OPEN SPACEAn area that is intended to provide light and air and is designed for either environmental, scenic or recreational purposes. Usable open space may include, but is not limited to, lawns, decorative plantings, walkways, active and passive recreational area, playgrounds, fountains, swimming pools, wooded areas and watercourses. Usable open space shall not include, but is not limited to, manmade reservoirs or dams, retention or detention ponds, driveways, parking lots or other surfaces intended for vehicular travel. Usable open space shall also not include any other manmade elements that will take away or cause to take away from the original lot area.
USEThe conduct of an activity or the performance of a function or operation on a site or in a building or facility.
UTILITY, MAJORGenerating plants; electrical switching facilities and primary substations; water and wastewater treatment plants; water tanks; and similar facilities of agencies that are under public franchise or ownership to provide the public with electricity, gas, heat, steam, communication, rail transportation, water, sewage collection or other similar service. The term "utility" shall not be construed to include corporate or general offices, gas or oil processing, manufacturing facilities, postal facilities or other uses defined in this Section.
UTILITY, MINORServices and facilities of agencies that are under public franchise or ownership to provide services that are essential to support development and that involve only minor structures, such as poles and lines.
VARIANCE (STRUCTURE OR USE)A waiver from compliance with a specific provision granted to a particular property owner because of the practical difficulties or unnecessary hardship that would be imposed by the strict application of that provision of this Unified Development Code. The granting of variances on zoning is the responsibility of the Board of Zoning Adjustment.
VARIANCE (SUBDIVISION)A waiver from compliance with a specific provision granted to a particular property owner because of the practical difficulties or unnecessary hardship that would be imposed by the strict application of that provision of this Unified Development Code. A recommendation for approval of a variance is made by the Planning and Zoning Commission and final approval is granted by the Board of Aldermen by acceptance of the final plat.
VEHICLEAny mechanical device on wheels in or by which any person or property is or can be transported or drawn on a highway, except devices moved by human power or used exclusively on stationary rails or trucks.
VEHICLE AND EQUIPMENT SALESA use engaged in the retail or wholesale sale or rental from the premises of motorized vehicles or equipment, along with incidental service or maintenance activities. Typical uses include new and used automobile and truck sales, automobile rental, boat sales, motorcycle sales, moving trailer rental and farm equipment and machinery sales and rental.
VEHICLE/EQUIPMENT STORAGE YARDAn outdoor area used or intended to be used for long-term storage of vehicles and equipment, other than a commercial parking lot or accessory parking to a principal use.
VEHICLE REPAIR, GENERALA use primarily engaged in painting of or body work to motor vehicles or heavy equipment. Typical uses include paint and body shops.
VEHICLE REPAIR, LIMITEDA use providing automobile repair or maintenance services within completely enclosed buildings, but not including general vehicle repair services.
VIBRATIONThe effect produced by any physical process characterized by a periodic and usually rapid, oscillatory motion sufficient to cause annoyance or discomfort, however, excluding blasting operations for quarries and temporary construction activities.
VOCATIONAL SCHOOLA use providing education or training in business, commercial trades, language, arts or other similar activity or occupational pursuit and not otherwise defined as a college or university or school.
WAREHOUSE, RESIDENTIAL STORAGEAn enclosed storage facility containing independent, fully enclosed bays that are leased to individuals exclusively for long-term storage of household goods or personal property.
WAREHOUSING AND WHOLESALEA use primarily engaged in the storage or sales of materials, equipment or products to wholesalers or retailers. Typical uses include cold storage, warehousing and long-term storage facilities, but excluding residential storage warehouses and sales of goods to the general public.
WATERCOURSEA running stream of water; a natural stream fed from permanent or natural sources, including rivers, creeks and streams. It must flow in a definite channel, having a bed or banks. It must be something more than surface drainage over the land.
WELDING OR MACHINE SHOPA workshop where machines, machine parts or other metal products are fabricated. Typical uses include machine shops, welding shops and sheet metal shops.
WORKING DAYSThe days of the week, excluding Saturdays, Sundays and recognized holidays, during which normal business is conducted by the City of Oak Grove. If only days are stated, then Saturdays, Sundays and holidays shall be included.
YARDAn open space located on the same lot as and that lies between the principal or accessory building or buildings and the nearest lot line. Such yard is unoccupied and unobstructed from the ground upward except as otherwise noted provided herein.
YARD, FRONTAn open space extending the full width of the lot between the nearest principal building and the front lot line and measured perpendicular to the front lot line. The minimum front yard required in each district of this Chapter shall be unoccupied and unobstructed from the ground upward except as otherwise provided herein.
YARD, REARAn open space extending the full width of the lot between the nearest principal building and the rear lot line and measured perpendicular to the rear building line. The minimum rear yard required in each district of this Chapter shall be unoccupied and unobstructed from the ground upward except as otherwise provided herein.
YARD, SIDEAn open space extending from the front yard to the rear yard between the nearest principal building and the side lot line and measured perpendicular from the side lot line. The minimum side yard required in each district of this Chapter shall be unoccupied and unobstructed from the ground upward except as otherwise noted.
ZERO LOT LINEThe location of a building on a lot in such a manner that one (1) or more of the building sides is directly on the lot line.
