The Exceptional Use District (EU) is intended to provide for agricultural uses and to permit certain uses which are not addressed in any other adopted district and which are of a nature as to warrant individual consideration and regulation due to unique demands placed upon the public health, safety and general welfare and the requirements of location and development that generally are peculiar to these uses.
The Exceptional Use District (EU) is a holding district for recently annexed land into the Municipality until a development plan is submitted. Any change to the current use of the annexed property is required to go through the rezoning process of Chapter 1181.
1163.02 PERMITTED USES.
Land or buildings in the Exceptional Use District shall be used only for the following purposes:
(a) Single family residential dwellings.
(b) Agricultural Production. The farming and production of agricultural products including, but not limited to seed crops, flowers, plants, fruits, and landscape materials.
(c) Recreation. Indoor and outdoor active recreational or programmatic uses/facilities, including non-illuminated sports courts and fields, intended to provide for broad- scale, activities amenities and features to serve the community at large.
1163.03 CONDITIONAL USES.
The following uses may be allowed in the Exceptional Use District (EU) subject to approval in accordance with Chapter 1181:
(a) Cemeteries. Cemeteries, mausoleums, or crematories on sites no less than twenty (20) acres. All graves or burial lots shall be set back not less than twenty-five (25) feet from any street right-of-way line. All required yards shall be landscaped and maintained in good order. A plan for perpetual care of the grounds shall be required.
1163.04 DEVELOPMENT STANDARDS.
In addition to the provisions of Chapter 1165, the following standards for the arrangement and development of land and buildings are required in the Exceptional Use (EU) District:
(a) Minimum Lot Area. Five acres.
(b) Minimum Lot Width. One hundred and fifty (150) feet.
(c) Minimum Front Yard. The minimum front yard setback shall be no less than fifty (50) feet measured from the street right-of-way.
(d) Minimum Side Yard. For main and accessory structures, the required side yard shall be not less than twenty-five (25) feet on each side.
(e) Minimum Rear Yard. For main and accessory structures, the required rear yard shall be not less than twenty-five (25) feet.
(f) Maximum Lot Coverage and Intensity of Use. No lot shall be covered more than thirty-five percent (35%) by the structure.
(g) Maximum Height of Structures. No structure shall exceed fifty feet in height.
