The purpose of the R-4 zone is to provide higher density residential areas with their associated necessary public services and activities. It is also to provide an orderly transition from less intensive, lower density uses to more intensive, higher density uses.

Accessory buildings and uses customarily incidental to any permitted use.

Accessory dwelling unit (see Section 15-13-39 for ADU requirements).

Adult daycare.

Agriculture.

Bed and breakfast inn, subject to the following standards:

   A.   Two (2) parking spaces shall be provided for the host family, plus one space for each guestroom;

   B.   Proprietor or owner must occupy the property;

   C.   Meals may only be served to overnight guests; and

   D.   Signs are limited to nameplate signs not exceeding two (2) square feet in residential zones. In addition, a freestanding identification sign not to exceed four (4) square feet is permitted. If illuminated, only indirect spotlighting is allowed, thus prohibiting backlighted signs.

Boarding and lodging house; provided that no boarding or lodging house shall be located within one thousand feet (1,000'), measured in a straight line between the closest property lines of the lots or parcels of any of the following similar facilities:

   A.   Any other boarding or lodging house,

   B.   A protective housing facility,

   C.   A transitional housing or rehabilitation/treatment facility,

   D.   A residential facility for persons with disability or residential facility for the elderly of more than five (5) people, or

   E.   An assisted living facility.

Church, synagogue or similar permanent building used for regular religious worship.

Cottage lots on the west side of Harrison Boulevard between 24th Street and 25th Street (see Section 15-13-42 for requirements).

Daycare center.

Educational institution.

Golf course, except miniature golf course.

Greenhouse, noncommercial only.

Group dwelling with eight (8) or fewer dwelling units in accordance with Chapter 10.

Home occupation.

Household pets.

Library or museum, public or nonprofit.

Multiple-family dwelling with eight (8) or fewer dwelling units, in accordance with the requirements of Section 15-13-27.

Pigeon loft for the housing of racing pigeons (only allowed on single-family residential lots), in accordance with the standards contained in Section 15-13-19.

Protective housing facility lodging up to fifteen (15) individuals, excluding support staff.

Public building, public park, recreation grounds and associated buildings.

Rehabilitation/treatment facility (see Section 15-13-26 for facility requirements).

Residential facilities for elderly persons (see Section 15-13-25 for facility requirements).

Residential facility for persons with a disability (see Section 15-13-15 for facility requirements).

Residential garage sales or yard sales.

Short-term rental (see Section 15-13-38 for requirements).

Single-family dwelling.

Temporary building for use incidental to construction work. Such building shall be removed upon the completion or abandonment of the construction work.

Transitional housing facility (see Section 15-13-26 for facility requirements).

Two-family dwelling, in accordance with the requirements of Section 15-13-27.

The following uses shall be permitted only when authorized by a conditional use permit as provided in chapter 7 of this title:

Assisted living facility (see section 15-13-26 of this title for facility requirements).

Cemetery with customary incidental uses, including, but not limited to, mortuary, mausoleum, crematory, staff housing, service shops and chapel.

Educational institution with housing.

Group dwelling with nine (9) or more dwelling units in accordance with chapter 10 of this title.

Multiple-family dwelling with nine (9) or more dwelling units, in accordance with the requirements of section 15-13-27 of this title.

Nursing home.

Planned residential unit development (PRUD), in accordance with chapter 8 of this title.

Private park, playground or recreation area, but not including privately owned commercial amusement business.

Privately operated concession or amusement business in a public park.

Protective housing facility lodging from sixteen (16) to a maximum of thirty (30) individuals, excluding support staff.

Public utility substation.

Retirement home.

   A.   Minimum Lot Area:

      1.   One building dwelling, 6,000 square feet for single-family, plus 1,500 square feet for each additional dwelling unit.

      2.   Other main building, 7,500 square feet. For nursing home or retirement home an additional 500 square feet for each guest or patient accommodation in excess of four. For transitional housing, rehabilitation/treatment facility, or assisted living facilities an additional 750 square feet for each resident in excess of four.

      3.   Corner lot, 7,000 square feet.

   B   Minimum Lot Width: Minimum lot width, 60 feet; corner lot, 70 feet; Area between 27th Street and 31st Street and Wall Avenue to Grant Avenue minimum lot width, 40 feet; corner lot, 60 feet.

   C   Minimum Yard Setbacks:

      1.   Front: Front, 20 feet, except average where 50% of the frontage is developed, but not less than 15 feet.

      2.   Side:

         a.   For any dwelling, nursery school, office, clinic, boarding house or lodging house, six feet with total of two side yards not less than 16 feet, plus one foot each side for each one foot any main building is over 35 feet high. For any single-family dwelling in the area between 27th Street and 31st Street and Wall Avenue to Grant Avenue, five feet on one side and nine feet on the other side with total of two side yards not less than 14 feet.

         b.   Other main building, 20 feet each side plus one foot each side for each one foot the main building is over 35 feet high.

         c.   Accessory building, eight feet, except one foot if located at least six feet from rear of main building, but not closer than eight feet to dwelling on adjacent lot.

      3.   Corner Lot: Side facing street on corner lot, 15 feet, except average where 50% of the frontage is developed, but not less than 10 feet.

      4.   Rear:

         a.   Main building, 30 feet.

         b.   Accessory building, one foot [(1')], except six feet [(6')] where accessory building rears on side yard of adjacent corner lot.

   D.   Building Height:

      1.   Minimum, one story.

      2.   Maximum, none.

   E.   Lot Coverage: No building or group of buildings with their accessory building shall cover more than 50% of the lot area.

   F.   Landscaped Area: At least 30% of the lot area shall be landscaped.

   G   Special Regulations: In no case shall the ratio of total floor area in the building to the total lot area exceed two to one.

   H.   Landscaping: For single-family dwellings, all yard areas except those areas where accessory buildings, permitted parking and accessways are specifically allowed are required to be landscaped and maintained. For new single-family construction the landscaping shall be installed within 18 months of the time of the first occupancy of the dwelling. For duplex and multiple-family requirements see Subsection 15-13-16.F.

   I.   Brick Painting Limitations: Buildings that are located between Adams Avenue and Harrison Boulevard and 20th Street to 30th Street are:

      1.   prohibited from painting or covering exterior brick except as provided in Subsection 2.b.

      2.   painting or sealing of unpainted brick may be approved by the planning commission if an evaluation is submitted to the planning commission that has been reviewed by the director providing information that:

         a.   painting or sealing of the brick is required to provide a protective surface that will limit the continued erosion of the brick;

         b.   the paint or sealant used will preserve the brick; and

         c.   the color of the paint or sealant will match the existing brick color.
