ARTICLE I

General Provisions

§ 310-1 Title.

The official title of this chapter shall be the "Zoning Ordinance of the City of Oil City."

§ 310-2 Effective date.

This chapter shall take effect on January 8, 2014.

§ 310-3 Purpose and authority.

This chapter is adopted by virtue of the authority granted to the City under Article VI of the Pennsylvania Municipalities Planning Code, Act 247 of 1968, as amended. The provisions of this Zoning Ordinance are designed:
A. 
To promote, protect and facilitate one or more of the following: the public health, safety, morals, general welfare, coordinated and practical community development, proper density of population, civil defense, disaster evacuation, airports and national defense facilities, the provision of adequate light and air, police protection, vehicle parking and loading space, transportation, water, sewage, schools, public grounds, and other public requirements; as well as
B. 
To prevent one or more of the following: overcrowding of land, blight, danger and congestion in travel and transportation, loss of health, life or property from fire, flood, panic or other dangers; and
C. 
To be in accordance with an overall program and with consideration for the character of the municipality, its various parts and suitability of the various parts for particular uses and structures.

§ 310-4 Community development objectives.

The zoning regulations and districts set forth in this chapter are made in accordance with a Comprehensive Plan for the general welfare of the City and are intended to achieve, among others, the following purposes:
A. 
To support and encourage order and beauty in the development of Oil City's environment for the convenience and pleasure of present citizens and future residents through sound land development practices.
B. 
To encourage future land development to complement a harmonious and efficient pattern of future City growth.
C. 
To encourage innovation in residential development and renewals so that the demand for housing may be met by greater variety and type, design and layout of dwellings.
D. 
To preserve strategic properties suitable for industrial development for the establishment of diversified industry within the City.
E. 
To guide commercial development in such a way as to minimize adverse influence on adjacent streets and highways and to maintain and protect existing commercial uses.
F. 
To protect property values to ensure a suitable, attractive and efficient community environment.
G. 
To encourage developers to incorporate adequate public facilities and open spaces in neighborhood design.
H. 
To protect the natural environment of Oil City from air, land and water pollution.
I. 
To provide for rational residential development at densities consistent with the welfare of the City.
J. 
To implement the objectives of the Oil City Comprehensive Plan.
K. 
To implement the objectives of the Oil City Waterways Study.

§ 310-5 Compliance.

No structure shall be located, erected, demolished, constructed, moved, altered externally, converted or enlarged, nor shall any structure or land be used or be designed to be used, except in full compliance with all the provisions of this chapter and after the lawful issuance of all permits and certifications required by this chapter. Except that the City of Oil City will be exempt from the provisions of this chapter in the exercise of its municipal functions. Any use not specifically permitted is prohibited.

§ 310-6 Interpretation of regulations.

Whenever the provisions of this chapter are at variance with any other lawfully adopted rules, regulations or ordinances, the more restrictive requirements shall govern. (See Municipalities Planning Code, Section 603.1.[1])
