PERFORMANCE STANDARDS

Sec. 50-505. - Compliance with division provisions.

This article permits specific uses in specific districts; and these performance standards are designed to limit, restrict, and prohibit the effects of those uses outside their premises or district. All structures, land, air, and waters shall, hereafter, in addition to their use and site regulations, comply with the performance standards of this division.

Sec. 50-506. - Air pollution.

No person or activity shall emit any fly ash, dust, particulate matter, fumes, vapors, mists, or gases in such quantities that would constitute a nuisance to surrounding property owners. Dust and other types of pollution borne by the wind from such sources as storage areas, yards, and roads within lot boundaries shall be kept to a minimum by appropriate landscaping, paving, fencing, or other acceptable means.

Sec. 50-507. - Hazards of flammable or explosive materials.

All activities involving the manufacturing, utilization, processing, or storage of flammable or explosive materials shall be provided with adequate safety devices against the hazard of fire and explosion and with adequate firefighting and fire-suppression equipment and devices that are standard in the industry and approved by the village fire chief. All materials that range from active to intense burning shall be manufactured, utilized, processed, or stored only within completely enclosed buildings which have incombustible exterior walls and an automatic fire extinguishing systems. Storage of flammable and explosive material shall be in accordance with the requirement of Wis. Admin. Code ch. SPS 310 and the requirements of NFPA 30.

Sec. 50-508. - Glare and heat.

No activity shall emit glare or heat that is visible or measurable outside its premises except activities which may emit direct or sky reflected glare which shall not be visible outside their district. All operations producing intense glare or heat shall be conducted within a completely enclosed building. Exposed sources of light shall be shielded so as not to be visible outside their premises.

Sec. 50-509. - Water quality; protection.

(a)

No activity shall locate, store, discharge, or permit the discharge of any treated, untreated, or inadequately treated liquid, gaseous, or solid materials of such nature, quantity, obnoxiousness, toxicity, or temperature that might run off, seep, percolate, or wash into surface water or subsurface water so as to contaminate, pollute, or harm such waters or cause nuisances such as objectionable shore deposits, floating or submerged debris, oil or scum, color, odor, taste, or unsightliness or be harmful to human, animal, plant, or aquatic life.

In addition, no activity shall withdraw water or discharge any liquid or solid materials so as to exceed, or contribute toward the exceeding of, the minimum standards set forth in Wis. Admin. Code ch. NR 102.

(c)

If a well is located in the village or is located close enough to the village to potentially adversely affect the local groundwater aquifer or local surface water sources and has the withdrawal capacity to exceed 70 gallons per minute, special consideration for the protection of water quality will be made. The effect that the well has on groundwater levels, surface water levels and their water quality must be documented to the satisfaction of the village board. Water quality sampling and testing, groundwater and surface water level measurements and possibly aquifer modeling will be necessary to adequately document the effects of wells with the potential for this high-capacity withdrawal.

(d)

The special concern for water quality protection will extend to all existing and proposed wells with a withdrawal capacity greater than 70 gallons per minute. A fee as set from time to time by resolution will be required to complete review of the submitted water quality and water level data. In addition, a fee as set from time to time by resolution will be required to complete processing of the well permit and inspection of the well by the village. Furthermore, if aquifer modeling is required to document the effects of the proposed well, all expenses for review of the model will be borne by the applicant.

Sec. 50-510. - Radioactivity, electrical disturbances, intensified sound, and vibrations.

No activity shall emit radioactivity, electrical disturbances, intensified sound, or vibrations outside its premises that affect the use of neighboring premises or the public health, safety or general welfare. The village shall make any judgments regarding these disturbances on the basis of information supplied by experts in these areas.
