PUBLIC HEARINGS

Sec. 50-359. - Notices; Class 1 or Class 2.

Notice of any public hearing which the village board, planning and zoning commission, or zoning board of appeals is required to hold under the terms of this article shall specify the date, time and place of hearing, and the matter to be presented at the hearing. Pursuant to Wis. Stats. ch. 985, the notice may be published as a Class 1 notice or Class 2 notice.

The notice of public hearing for a variance or appeal before the zoning board of appeals shall be published in a newspaper of general circulation in the village as a Class 1 notice, that is, published once at least one week (seven days) before the public hearing. Notice of the public hearings shall be mailed to all parties-in-interest at least ten days before the hearing. Parties-in-interest shall be defined as the applicant, the clerk of any village whose boundaries are within 1,000 feet of any lands included in the application and the owners of all lands included in the application and all lands lying within 300 feet of lands included in the application. The failure to give any notice to any property owner shall not invalidate the action taken by one of the aforementioned bodies.

The notice of public hearing for a zoning amendment (text or map) or a conditional use permit shall be published in a newspaper of general circulation in the village as a Class 2 notice that is published at least once each week for two consecutive weeks, the last publication of which shall be at least one week (seven days) before the public hearing. Notice of the public hearings shall be mailed to all parties-in-interest at least ten days before the hearing. Parties-in-interest shall be defined as the applicant, the clerk of any village whose boundaries are within 1,000 feet of any lands included in the application and the owners of all lands included in the application and all lands lying within 300 feet of lands included in the application. The failure to give any notice to any property owner shall not invalidate the action taken by one of the aforementioned bodies.
