ARTICLE 37

- MUNICIPAL SOLID WASTE LANDFILL USES

Section 1. - Purpose and intent.

The purpose of this Article is to regulate and identify general standards applicable to municipal solid waste landfill uses, regardless of ownership, authorized in more than one zoning district, in a manner consistent with sound planning and zoning principles, and in conformity with the laws of the Commonwealth of Virginia.

Section 2. - Term defined.

The term "Municipal Solid Waste Landfill" shall mean a sanitary landfill and related facilities authorized to accept nonhazardous municipal solid waste, industrial waste and construction demolition debris waste, as defined by and pursuant to the Virginia Waste Management Act.

Section 3. - Solid waste facilities, structures, and uses.

Solid waste facilities, structures, and uses, as that phrase is used herein, shall include but not be limited to, Municipal Solid Waste Landfills, solid waste transfer stations, accessory uses incidental thereto, including maintenance and office facilities, whether publicly or privately owned.

Section 4. - Districts in which municipal solid waste landfill uses may be located.

Land in the M-1, M-2, of A Districts, on which is located a Municipal Solid Waste Landfill owned by the City of Petersburg, Virginia as of the date of enactment of this Article 37, may be used for the construction, operation and maintenance of "solid waste facilities, structures and uses," as described in Section 3 above, which uses shall be permitted by right, provided that a host agreement is in place in compliance with the requirements of Section 10.1-1408.1.B.7 (as may be amended) of the Virginia Waste Management Act.

Section 5. - Standards for municipal solid waste landfills.

Any such Municipal Solid Waste Landfill shall be subject to the oversight and regulation of the Virginia Department of Environmental Quality.

Upon completion of the operations, the Municipal Solid Waste Landfill shall be properly closed in accordance with the regulations set forth in the Virginia Waste Management Act.

Section 6. - Reference to additional regulations.

The regulations contained in this Article are supplemented by the following regulations:

Article 19. Off-street parking regulations;

Article 20. Off-street loading regulations;

Article 21. Sign regulations;

Article 22. Height, area and bulk regulations;

Article 23. Supplementary use regulations; and

Article 25. Supplementary height, area and bulk regulations.
