§ 420-16 Boards and commissions.
§ 420-17 Community Development Department.
A.
The Community Development Department is hereby created by the Village Board of Trustees for the purpose of administering all planning, zoning, and related inspection functions required by statute and enforcing all planning, zoning, and related ordinances enacted by the Village Board and any other ordinance designated by the Village Board to be enforced by the Community Development Department.
B.
Community Development Director/Zoning Administrator.
(1)
Selection and term. The Village Board of Trustees has created the position of Community Development Director as a permanent position. The term of office shall be indefinite. The Village Board of Trustees shall determine qualifications for the position of Community Development Director. Such qualifications shall include, at a minimum, requirements with respect to expertise in the areas of planning, zoning, geography or urban affairs and past related work experience. The Community Development Director shall also act as the Village Zoning Administrator.
(2)
Duties. The Community Development Director shall serve as the Village Planner and the Village Zoning Administrator and have the following duties:
(a)
To administer and enforce the zoning, shoreland, floodplain, and land division and development control ordinances enacted by the Village Board of Trustees so as to manage and promote the public health, safety, convenience and general welfare of the citizens of the Village pursuant to the appropriate statutes and ordinances.
(b)
To give all legal notices required by state statutes and the aforementioned ordinances.
(c)
To investigate alleged violations of the zoning, shoreland, floodplain, and land division and development control ordinances and give notice thereof to the owner of the subject property and assist in necessary prosecutions and make, as often as necessary, all necessary inspections of structures, lands and waters to certify compliance with the aforementioned ordinances and report uncorrected violations to the Village Attorney in a manner specified by him and assist the Village Attorney in any action involving the Community Development Department.
(d)
To provide zoning information, assistance and advice to the public.
(e)
To maintain, by parcel number where feasible, the appropriate records and indexes for all zoning permits, inspections, complaints, public hearings, legal notices and zoning map and text amendments and other official actions.
(f)
To attend policy formulation meetings and make recommendations to the Village Plan Commission, Zoning Board of Appeals and Village Board and set public hearings as required by the Wisconsin State Statutes, as amended from time to time, or the Village Code.
(g)
To make all necessary studies required for the improvement of land use in the Village and studies relevant to the imposition of conditions for obtaining a conditional use permit.
(h)
To supervise the operations of the Village Assistant and Deputy Zoning Administrators and recommend job descriptions for positions within the office and fill such positions.
(i)
To review applications and issue all zoning- and development-related permits.
(j)
To prepare all necessary resolutions and reports for the Village Plan Commission, the Village Zoning Board of Appeals and the Village Board of Trustees that relate to planning, development and zoning matters.
(k)
To make determinations and requests of similar or like uses allowed in a particular zoning district.
(l)
To collect and account for all fees and other moneys paid and received by the Department.
(m)
To prepare, maintain, file and record, by parcel number where feasible, all records, maps, photographs, studies, reports, surveys, tapes and indexes required for the efficient and proper administration and enforcement of the aforementioned ordinances.
(n)
Provide planning assistance and review of transportation plans and other related studies.
(3)
Powers. The Community Development Director shall have the following powers:
(a)
To receive, review and act upon (either granting with conditions or denying) all zoning, use and other permit applications authorized by the aforementioned ordinances.
(b)
To prohibit the use or construction of any structure or the use of any land or water until proper zoning and/or land development permits has been obtained.
(c)
To suspend or revoke any permit issued by the Community Development Department, the Plan Commission, Zoning Board of Appeals or Village Board, where so delegated, upon noncompliance with the terms of the permit and/or this chapter.
(d)
To commence, subject to the Village Attorney's approval, any legal action in the name of the Village to ensure enforcement of the terms of the aforementioned ordinances.
(f)
To gain entry to premises, buildings and structures for the purpose of investigating applications for permits and for the purpose of determining compliance with any permit issued pursuant to any of the aforementioned ordinances or provisions of this chapter during reasonable hours or any other time authorized by the court. If entry is refused after presentation of proper identification, a special inspection warrant may be procured in accordance with § 66.0119, Wis. Stats.
(4)
Assistants and deputies. Assistant Zoning Administrators and Deputy Zoning Administrators may be appointed by the Community Development Director and confirmed by the Village Administrator. Deputies may also serve in the capacity of Village Building Inspectors at the discretion of the Village Board. The Village Community Development Director may also appoint additional deputies from the Director's staff so as to fulfill the functions of the Community Development Department.
