CHAPTER 18

04 - General Provisions

18.04.010. - Title.

The ordinance codified in this title shall be known as the "Zoning Ordinance of the City of Post Falls, Idaho."

18.04.020. - Statutory authority.

The ordinance codified in this title is adopted pursuant to authority granted by title 67, chapter 65 of the Idaho Code and article 12, section 2 of the Idaho constitution, as amended or subsequently codified.

18.04.030. - Provisions deemed minimum requirements.

In their interpretation and application, the provisions of this title shall be held to be minimum requirements adopted for the promotion of the public health, safety and the general welfare. Whenever the requirements of this title conflict with the express requirements of any other locally adopted ordinance, the ordinance incorporating the most restrictive provisions shall prevail.

18.04.040. - Applicability.

This title shall apply, to the extent permitted by law, to all land and the Use thereof, within the incorporated boundaries of the City of Post Falls. Any land owned by a governmental agency shall be exempt from the provisions of this title only to the extent that such land or the Use thereof may not be lawfully regulated by the City of Post Falls.

18.04.050. - Compliance.

A.

It shall be lawful for any building or Structure to be moved, erected, altered, enlarged, or rebuilt if done in conformance with the provisions of this title.

B.

It shall be lawful for any Yard, Open Space, building, Structure or land to be used for any purpose if done in conformance with this title.

C.

Any Use not permitted by the provisions of this title is prohibited. The Zoning Administrator is authorized to classify unnamed Uses that are similar to named Uses, subject to administrative appeal procedures authorized herein.

D.

It shall be unlawful for any building or Structure to be moved, erected, altered, enlarged or rebuilt that does not adhere to the adopted flood damage prevention requirements in title 15, chapter 15.44, "Flood Damage Prevention," of this Code. This applies to areas that have been mapped and identified by the federal emergency management agency (FEMA) as being in a flood hazard area.

18.04.060. - Buildings under construction.

Any building or Structure for which a building Permit has been lawfully issued prior to the effective date hereof may be completed and used in accordance with the plans, specifications, and Permits on which the building Permit was granted, if construction is commenced and inspections are requested within one hundred eighty (180) days after the issuance of the Permit, and if construction is diligently pursued to completion.

18.04.070. - Applications for permits.

An application for a Permit governed by this title shall address the information necessary to determine compliance with this title and other applicable provisions of law. The Zoning Administrator is authorized to establish administrative procedures, develop application forms and administer the permitting process as necessary to demonstrate compliance with this title and applicable provisions of state law.
