CHAPTER 3

DISTRICT ESTABLISHMENT

10-3-1: DISTRICT CLASSIFICATIONS:

To effectuate the Comprehensive Plan adopted by the City, lands within the incorporated boundaries of the City are hereby classified into the following categories, which are further described in subsequent sections and so indicated on the Zoning Map.

10-3-2: TEXT AND OFFICIAL MAP:

This title shall consist of the text thereof and that certain map or maps identified by the approving signature of the City Council and marked and designated as "Zoning Map", which is placed on file with the City Clerk. The map has been examined and duly considered in detail by the City Council and adopted as part of this title. This title and each and all its terms and mapped details is to be read and interpreted in the light of the contents of the maps and their relationship to the Comprehensive Plan. If any conflict between the maps and the text of this title is deemed to arise, the text of this title shall prevail, and any conflict shall be interpreted by the Administrator; subject to appropriate appeals process. 10-3-3: DISTRICT BOUNDARIES:

The boundaries of the various districts shown on the Zoning Map are, unless otherwise indicated, streets, alleys, lot lines, or other lines of demarcation as shown on the map. Where a street layout, property line or other boundary on the ground varies from that shown on the Zoning Map, and where property or other boundary lines do not exist or are not shown on the Zoning Map, the designations shown on the map shall be applied and interpreted by the Administrator by map scale or other method so as to carry out the intent and purpose of the Zoning Map for that district. All interpretations are subject to the appeals process. (Ord. 597, 8-6-2018)

10-3-4: DIVIDED ZONING:

When divided zoning on a single lot occurs, either zone is acceptable for the entirety of that lot with the declared use encumbering the entirety of the lot and making it subject to the applicable zoning standards. (Ord. 597, 8-6-2018)

10-3-5: ZONING UPON ANNEXATION:

Prior to annexation of an unincorporated area, the Council shall request and receive a recommendation from the Planning and Zoning Department on the proposed Comprehensive Plan and Zoning Code changes for the unincorporated area. The City Council shall follow the notice and hearing procedures provided in section 10-15-5 of this title. Concurrently or immediately following the adoption of an Ordinance of Annexation, the Council shall amend the Comprehensive Plan and Zoning Code. (Ord. 597, 8-6-2018)

10-3-6: CLASSIFICATION OF NEW USES WITHIN ZONE DISTRICTS:

It is recognized that new, unanticipated types of land uses will be proposed in Priest River. To provide for such changes and contingencies, when a use is proposed that is not listed as a prohibited, permitted, or conditional use in a zone district, the Planning and Zoning Administrator shall decide that:
   A.   The use falls within the same standard classification pursuant to the Standard Industrial Classification Manual or the North American Industry Classification System (www.naics.com/search.htm), as amended, modified or superseded, as a listed permitted or conditional use in a current zone district and that it may be processed in the same fashion as the listed use; or
   B.   The use does not fall within the same standard classification pursuant to the Standard Industrial Classification Manual or the North American Industry Classification System, as amended, modified or superseded, as a listed permitted or conditional use in a current zone district, and thus is a prohibited use in that district; or
   C.   The use is unique in nature and an amendment to this title is necessary to allow for its placement within the appropriate zone district. (Ord. 597, 8-6-2018)
