ARTICLE III

District Regulations

§ 310-8 Regulations within each zoning district.

Within each zoning district lands, buildings and structures shall be used, and buildings and structures shall be erected, altered or enlarged only for any of the uses permitted by right in the zone district, or, after Council approval, for a conditional use. The principal permitted uses (allowed by right), accessory uses and conditional uses for each zone district are listed below. Accessory uses may only be constructed concurrent with or later than the principal use they serve.

§ 310-9 Agricultural Zone District (A).

A. 
Permitted uses:
(1) 
Single-family dwelling.
(2) 
Church and supporting facilities (social hall, educational buildings, parsonage and parking).
(3) 
Public or parochial elementary or secondary school.
(4) 
Governmental or public utility structures, facilities and rights-of-way.
(5) 
Agricultural operations of all kinds.
(6) 
Livestock, including, but not limited to, pigs, chickens, horses, ponies, mules, sheep, goats, cows, donkeys and alpacas.
(7) 
Agricultural exhibition grounds.
(8) 
Commercial nursery for plant materials.
(9) 
Commercial stable or kennel.
(10) 
Cemetery.
(11) 
Agricultural research and development.
(12) 
Forestry.
B. 
Permitted accessory uses:
(1) 
Residential garage.
(2) 
Housing for domestic pets.
(3) 
Recreation facilities.
(4) 
Garden equipment shed.
(5) 
Greenhouse, either for raising plants or for solar heating.
(6) 
Farm buildings for storage of equipment, produce and/or animals.
(7) 
Roadside stand for seasonal sale of farm produce.
(8) 
Livestock, including, but not limited to, pigs, chickens, horses, ponies, mules, sheep, goats, cows, donkeys and alpacas.
C. 
Conditional uses:
(1) 
Home occupation.
(2) 
Small business venture.
(3) 
Convalescent or retirement home.
(4) 
Planned residential development.
(5) 
Nonprofit community club.
(6) 
Veterinary hospital.
(7) 
Commercial or private recreation activities.
(8) 
Mobile home park.
(9) 
Long-distance transmission lines.
(10) 
Second dwelling on an undivided lot.
(11) 
Extraction of natural resources.
(12) 
Man camps pursuant to Chapter 168, Housing, Article III, Temporary Housing; Man Camps, of this Code.
D. 
Minimum area requirements:
(1) 
Lot area: 32,670 square feet (3/4 acres).
(2) 
Lot width: 100 feet.
(3) 
Front yard depth: 40 feet.
(4) 
Side yard depth: 10 feet.
(5) 
Rear yard depth: 40 feet for principal permitted or conditional uses; 10 feet for accessory uses.
(6) 
Where public or community sewer systems approved by the State DEP will serve the property the following minimum requirements pertain:
(a) 
Lot area: 22,000 square feet.
(b) 
Lot width: 70 feet.
(c) 
Front yard depth: 40 feet.
(d) 
Side yard depth: 10 feet.
(e) 
Rear yard depth: 20 feet for permitted or conditional uses; 10 feet for accessory uses.

§ 310-10 Residential Zone District (R).

A. 
Permitted uses:
(1) 
Single-family dwelling.
(2) 
Two-family dwelling.
(3) 
Church and supporting facilities (social hall, educational buildings, parsonage and parking).
(4) 
Public or parochial elementary or secondary school.
(5) 
Governmental or public utility structures, facilities and rights-of-way serving Prospect Borough and/or immediately surrounding area.
(6) 
Agricultural operations except commercial slaughtering.
(7) 
Conversion of a single-family dwelling to two apartments.
(8) 
Forestry.
(9) 
No-impact home-based business.
B. 
Permitted accessory uses:
(1) 
Residential garage.
(2) 
Housing for domestic pets, excluding kennels.
(3) 
Recreation facilities.
(4) 
Garden equipment shed.
(5) 
Greenhouse, either for raising plants or for solar heating.
(6) 
Farm buildings for storage of equipment, produce and/or animals.
C. 
Conditional uses:
(1)

Retail sales store:
(a) 
Appliance sales and service.
(b) 
Automotive supplies.
(c) 
Baking with goods made on the premises and sold there.
(d) 
Clothing sales.
(e) 
Department store selling principally wearing apparel and household furnishings.
(f) 
Drugstore or pharmacy.
(g) 
Flower shop including greenhouses.
(h) 
Furniture sales and home furnishings.
(i) 
Garden supplies.
(j) 
Grocery sales or delicatessen.
(k) 
Hardware sales.
(l) 
Jewelry and watch sales and repair.
(m) 
Restaurant without drive-through service.
(n) 
Sporting goods and fishing and hunting supplies.
(5) 
Personal services outlets:
(a) 
Bank or savings-and-loan institution.
(b) 
Barbershop or beauty shop.
(c) 
Catering service.
(d) 
Dry-cleaning pickup.
(e) 
Funeral home.
(f) 
Medical or dental office or clinic.
(g) 
Repair of household equipment.
(6) 
Business or professional offices.
(7) 
Feed mills.
(8) 
Off-street parking lots.
(9) 
Forestry.
B. 
Permitted accessory uses:
(1) 
Parking lot and servicing area.
(2) 
Apartments above retail, service or office uses on the first floor, provided that public sewer and water services are provided to the lot.
(3) 
Apartment of the owner or operator of a business in the same structure as the business.
(4) 
Residential garage.
(5) 
Housing for domestic pets, excluding kennels.
(6) 
Recreation facilities.
(7) 
Garden equipment shed.
(8) 
Greenhouse, either for raising plants or for solar heating.
C. 
Conditional uses:
(1) 
Any enclosed commercial uses similar in character to and compatible with the permitted retail sales, personal services or office uses listed as permitted.
(2) 
Convalescent or retirement home.
(3) 
Automobile service station.
(4) 
Laundromat.
(5) 
Hotel.
(6) 
Restaurant with drive-through service.
(7) 
Beverage distributor.
(8) 
Book or novelty sales.
(9) 
Truck garage, including office, repair and/or service shop and equipment storage. Said uses shall be limited to the occupant's owned and/or leased trucks and equipment.
D. 
Minimum area requirements:
(1) 
Lot area: 32,670 square feet (3/4 acre).
(2) 
Lot width: 100 feet.
(3) 
Front yard depth: 20 feet.
(4) 
Side yard depth: five feet.
(5) 
Rear yard depth: 20 feet for principal permitted or conditional uses; 10 feet for accessory uses.
(6) 
Where public or community sewer systems approved by the State DEP will service the property the following minimum requirements pertain:
(a) 
Lot area: 22,000 square feet.
(b) 
Lot width: 70 feet.
(c) 
Front yard depth: 20 feet.
(d) 
Side yard depth: 20 feet.
(e) 
Rear yard depth: 20 feet for permitted or conditional uses; 10 feet for accessory uses.

§ 310-12 Highway Commercial District (HC).

Appliance sales and service.

Automobile service station.
(3) 
Automotive supplies.
(4) 
Automobile, truck or farm equipment sales and service with or without used vehicle sales as an incidental part of the business.

Bakery with goods made on the premises and sold there.
(6) 
Bank or savings-and-loan institution.
(7) 
Beverage distributor.
(8) 
Beauty shop or barber.
(9) 
Bowling alley or skating rink.
(10) 
Department store selling principally wearing apparel and home furnishings.
(11) 
Drugstore or pharmacy.
(12) 
Flower shop, including greenhouses.
(13) 
Furniture sales or home furnishing.
(14) 
Garden and agricultural supplies.
(15) 
Grocery sales or delicatessen.

Apartment of the owner or operator of a business in the same structure as the business.

Conditional uses:
(1) 
Any commercial use similar in character and compatible with the permitted uses.
(2) 
Single-family dwelling on a lot existing at the date of adoption of this chapter when such lot is too small, too awkward in shape or too remote in access to the highway to be suitable for a permitted use.
(3) 
Book or novelty sales.
D. 
Minimum area requirements:
(1) 
Lot area: 32,670 square feet (3/4 acres).
(2) 
Lot width: 150 feet.
(3) 
Front yard depth: 50 feet.
(4) 
Side yard depth: 10 feet.
(5) 
Rear yard depth: 20 feet.
(6) 
Where public or community sewer systems approved by the State DEP will service the property the following minimum requirements pertain:
