Site Development

§ 310-21 Grading.

A. 
Earth movement shall result in finished grades that do not exceed two horizontal to one vertical unless a report prepared by a professional engineer verifies that specific steeper slopes in a particular location will not compromise the stability of the completed slope or areas above or below it or threaten adjacent streets or property.
B. 
Topsoil shall be removed and stockpiled before the start of grading.
C. 
Graded slopes shall be planted with a fast-catching grass cover as soon as grading is completed.
D. 
Where fill is used, it shall be thoroughly compacted, and keyed in to undisturbed earth at the edges of the fill.
E. 
Accompanying the application to Borough Council for any planned residential development or commercial development where site grading is proposed, there shall be submitted a cross section or drawings through the property to illustrate the proposed grading, indicating the steepness of proposed slopes. This section shall not apply to development of single- or two-family dwellings or to agricultural operations.

§ 310-22 Drainage.

A. 
Stormwater shall not be permitted, as a result of development undertaken after adoption of this chapter, to collect upon any property, or to pass from one property to another in a concentrated flow without benefit of a legal easement or to cross a public street on the surface.
B. 
In any planned residential development or commercial development, the application to Borough Council shall be accompanied by a plan to indicate how stormwater will be collected and removed from the property.
C. 
Council may require, where no subsurface storm drainage system is available and/or where areas are to be covered with structures and paved surfaces, that developers provide storm retention vessels on their properties of sufficient capacity to hold at least the flow from the 50-year storm of record (4.7 inches in 24 hours) for release at no greater flow than the 10-year rate (3.8 inches in 24 hours) into an approved drainage way or stream. Council may ask the Butler County Conservation District for assistance in determining the need for, and adequacy of, stormwater management facilities.

§ 310-23 Extraction of natural resources.

A. 
Council shall review any proposal to extract coal, sand, gravel, stone, oil or gas prior to commencement of such activity which may be permitted by Council in the Agricultural District only.
B. 
Council shall not approve an extraction activity unless or until all permits to operate on the site have been secured from the State DEP.
C. 
Council may attach conditions to approval, including the posting of a bond by the operator to protect local streets that will provide access to the site or the establishing of hours of operation.

§ 310-24 Flood-prone areas.

A. 
Areas identified as within the 100-year floodplain by the Federal Insurance Administration Flood Insurance Study for the Borough, shall not be developed with structures whose lowest floor elevation is less than 1 1/2 feet above the 100-year flood elevation at the proposed building site. If the structure is for nonresidential purposes, the lowest floor elevation may be below that level as long as the building is floodproofed up to 1 1/2 feet above the 100-year flood elevation.
B. 
Until definitive studies by the U.S. Army Corps of Engineers have established specific flood levels, the preliminary report by the Federal Insurance Administration and the highest known water level at a particular location shall be used to establish the 100-year flood level.
C. 
No new construction may encroach on any existing stream or drainageway or constrict its natural flow characteristics.
D. 
No flammable or toxic substance or buoyant containers shall be stored within the floodplain.[1]

§ 310-25 Sketch for site plan submission.

To accompany any request for amendment to the Zoning Map or for a conditional use or planned residential development submission. The list below will serve as a checklist during review of the plan or proposal. Sketch should be drawn to scale on a separate sheet and may be a site plan prepared by a registered engineer or architect. It should show the following, where applicable:
A. 
Property lines, described by bearings and distances.
B. 
Setback line from front, side and rear property lines.
C. 
Street or streets abutting the property.
D. 
Utilities in the street abutting the property.
E. 
Driveways from the street into the property.
F. 
Location of all buildings, existing to remain and proposed to be built on the property with length and width indicated.
G. 
The proposed use and height in stories of each building.
H. 
If a multiple use or multifamily building or buildings, the number of apartments or storerooms proposed in each building.
I. 
Location of off-street parking areas, showing the number of parking spaces in each area and driveway connections from abutting streets.
J. 
Proposed grading of the site, indicating area of the property affected, areas of cut and fill and percent of slope.
K. 
Landscape screening to protect adjacent residences.
L. 
Stormwater drainage plan.
M. 
Arrangement of proposed sanitary sewage and water supply lines in the property.
N. 
Location of any new streets or lots to be created on the property.
O. 
Scale of plan, date plan was prepared, North arrow.
P. 
Name, address, phone number and seal or registration number of preparer of the plan.
