Section 165.22 of this chapter shall be enforced by the Building Inspector.
1. Issuance of certificates of occupancy and compliance by the Building Inspector shall authorize the applicant to use and occupy the land, building, or structure in question in the manner and for the purposes stated in the application. The application must describe the intended use, occupancy, or change of use with sufficient detail to allow the Building Inspector to determine compliance with all applicable City Codes. If the Building Inspector determines that a proposed use, occupancy or change of use does not comply, the Building Inspector shall deny the application.
2. The Building Inspector may make such additional inspections as he or she deems necessary to assure compliance with City Code. If at any time the Building Inspector determines that a use or occupancy does not so comply, he or she shall revoke the aforementioned certificate and require that the nonconforming use cease.
3. If the Building Inspector denies or revokes a certificate of occupancy and compliance, he or she shall notify the owner or party in possession of the property as soon as practicable by written notice of the action, stating the reasons therefor.
4. Fees. Prior to the issuance of a certificate of occupancy and compliance, the applicant shall pay to the City Treasurer an appropriate sum as established from time to time by resolution of the City Council.
5. In instances where a building permit is required for the same premises, then certificates of occupancy and compliance shall be applied for coincidentally with the application for a building permit. Fees for a certificate of occupancy shall be considered incidental to the building permit fees.
6. A record of all certificates shall be kept on file in the office of the City Clerk and copies shall be furnished on request to any person having a proprietary or tenancy interest in the building affected.
