Procedure. The zoning administrator, upon receipt of a complaint filed by the zoning or building departments, convenes and holds a public hearing to consider and receive relevant evidence and testimony regarding the revocation of a conditional use granted in accordance with the provisions of this chapter. No hearing shall take place without written notice of the date, time, place and purpose of such public hearing and the nature of the complaint having been first served on the owner of the property or grantee of the conditional use. Service of a complaint and notice of hearing shall be by certified mail, postage prepaid, return receipt requested not less than fifteen nor more than thirty days prior to the date of the revocation hearing. The property owner or grantee of the conditional use shall have an opportunity to appear at the hearing, to be represented by counsel and to present evidence on his own behalf. Additional notices of the public hearing may be given in the manner provided in this chapter, governing notices for conditional uses. The public hearing shall be conducted and hearing records maintained in the manner prescribed by this chapter, as well as Article 11, Division 13, of the Illinois Municipal Code. Upon conclusion of the hearing, the zoning administrator may recommend to the corporate authorities of the village that the conditional use heretofore granted be revoked if, from the testimony and evidence presented at the hearing, it is determined, by a preponderance of the evidence, that any one or more of the following grounds exist to revoke the conditional use:
i. Approval for the conditional use was obtained by fraud;
ii. The conditional use is being or has been exercised contrary to the conditions of the ordinance granting the conditional use, or in violation of any applicable licenses, permits, regulations, laws or ordinances of the state of Illinois or the village of Riverdale; or
iii. The conditional use granted has been exercised in such a manner so as to be detrimental to the public health or safety or so as to constitute a public nuisance.
