CHAPTER 3

ZONING DISTRICTS AND MAP

9-3-1: CREATION OF USE DISTRICTS:

The following use districts are hereby created and established: (Ord. 190, 3-19-1973)
   1-R 42,000 square feet (inclusive of road easements) single- family residential district
   R-1 42,000 square feet single-family residential district
   R-1A 60,000 square feet single-family residential district
   R-2 80,000 square feet single-family residential district
   R-3 200,000 square feet single-family residential district
   R-4 Golf course and country club residential district
   B-1 Neighborhood business district
   Mixed use planned unit developments in the B-1 neighborhood business district
   O and R1 office and research district one
   O and R/C office and research compatible district
   Transitional business overlay district
   B-2 Business compatible district
   Wireless telecommunications overlay district
   P-1 Public lands district
   P-2 Wildlife preserves district
   SL Sanitary landfill district
   SS Automobile service stations district

9-3-2: OFFICIAL ZONING MAP:

The village shall cause to be printed by March 31 of each year, a map clearly showing existing zoning uses, divisions and restrictions, regulations and classifications of the village. Said map, together with everything shown thereon and all amendments thereto, shall be as much a part of this chapter as though fully set forth and described herein. The said map shall be filed with the office of the village clerk, and shall be available for public reference. If there are no changes in the map from year to year, no new map need be published. If changes do occur, they shall be reflected in the new and corrected map published by March 31 following the changes. Any person desiring a copy of such map, which shall be the official zoning map, shall pay the sum of ten dollars ($10.00) for each copy thereof to the village. The boundaries of the wireless telecommunications overlay district shall be as shown on an overlay district appendix to the official zoning map. Such overlay district appendix shall be a part of the official zoning map. (Ord. 190, 3-19-1973; amd. Ord. 99-3-4, 3-16-1999)

9-3-3: ZONING OF ANNEXED TERRITORY:

Any additions to the incorporated area of the village shall be automatically classified according to the classification shown on the master plan of the village. Said master plan, together with everything shown thereon and all amendments thereto, shall be as much a part of this chapter as though fully set forth and described herein. The said master plan shall be filed with the office of the village clerk and shall be available for public reference. If changes occur in the said master plan, they shall be reflected in the new and corrected plan published by March 31 following the changes. If there are no new changes in the plan from year to year, no new plan need be published. Any person desiring a copy of such master plan, which shall be the official master plan, shall pay the sum of ten dollars ($10.00) for each copy thereof to the village, and such fees collected shall be used to defray the cost of publication. 9-3-4: ALTERNATIVE ZONING:

Where any land area is shown on either the official zoning map or the master plan of the village to have two (2) or more use district designations, they shall be interpreted as alternative uses permissible for the subject land uses and not as cumulative permissible uses. The first listed shall be deemed the preferred use. (Ord. 190, 3-19-1973)
