Administration

Sec. 16-2-10. - Duties of Zoning Administrator.

All permits, certifications and stop orders required by this Chapter shall be issued by the Zoning Administrator, who shall have the authority to make all decisions and investigations necessary to properly carry out the provisions of this Chapter. The Zoning Administrator shall determine whether a use is similar to those uses listed, unless his or her decision is reversed by the Planning Commission. No required permit, certificate or order shall be issued by the Zoning Administrator if, in his or her judgment, the requirements of this Chapter have not been met. No oversight or dereliction on the part of the Zoning Administrator or on the part of any official or employee of the City shall legalize or authorize the violations of any of the provisions of this Chapter.

Sec. 16-2-20. - Right of entry.

The Zoning Administrator shall, if possible, first secure permission of the occupant before entering upon any premises for the purpose of making any inspection necessary to the conduct of his or her duties in the administration and enforcement of this Chapter.

Sec. 16-2-30. - Zoning permits.

Permits shall be secured from the Zoning Administrator prior to the construction, moving, conversion, extension, enlargement or structural alteration of buildings or other structures, including fences.

(1)

Application forms. Application for a zoning permit shall be made to the Zoning Administrator on forms provided for that purpose.

(2)

Premises diagram. Each application shall include a diagram of the premises containing:

a.

The dimensions of the lot or parcel of land.

b.

The location of relevant lot boundary lines determined by existing survey pins, except that the Zoning Administrator may waive this requirement where the Zoning Administrator's personal inspection of the property discloses that the exact location of the lot lines is not at issue for the issuance of the permit.

c.

The location and dimension of each structure on the premises, including the proposed project.

d.

The distance from the outermost extensions of the proposed project to the relevant lot lines.

Application fee. A nonrefundable zoning permit application fee as set forth in the City's Fee Schedule shall be submitted with the completed application form. The City Council may amend this fee from time to time by resolution or ordinance.

(4)

Issuance. If, in the opinion of the Zoning Administrator, the proposal, as set forth in the application and verified by personal inspection of the Zoning Administrator, is in conformance with the provisions of this Chapter, the Zoning Administrator shall issue a zoning permit.

(5)

Disapproval. If, in the opinion of the Zoning Administrator, the proposal, as set forth in the application and verified by personal inspection of the Zoning Administrator, is not in conformance with the provisions of this Chapter, the Zoning Administrator shall refuse to issue a zoning permit and shall state in writing, on the application or an attachment to the application, the reason for such disapproval.

Null or void permits.

a.

Any permit issued in violation of any provision of this Chapter shall be null and void and may not be construed as waiving any provision of this Chapter.

b.

A zoning permit, once issued under the provisions of this Chapter, shall be valid for 12 months. Where the applicant fails to commence construction within the 12-month limit, the zoning permit shall be null and void.

Sec. 16-2-40. - Stop orders.

Whenever any building work is being done contrary to the provisions of this Chapter or land or structures are being used contrary to this Chapter, the Zoning Administrator shall order the work or use stopped by notice in writing served on any person engaged in doing or causing such work to be done or such use to be continued, and any such person and all others engage in doing or causing such work to be done or such use to be continued shall forthwith stop such work or use until authorized by the Zoning Administrator to proceed with the work or continue the use.

Sec. 16-2-50. - Appeals.

Any person denied a permit or certificate or issued a stop order may appeal such action of the Zoning Administrator to the Planning Commission within 30 days from the date of such action by the Zoning Administrator.
