(a)
Purpose. The standards of the R-1 District are designed to retain and provide areas of low- to medium-density development characteristically used for single-family dwelling units.
(b)
Uses by right. A use by right is any of the following uses:
(1)
Accessory building or structure.
(2)
Parks.
(3)
Redevelopment, rehabilitation or restoration of a property where a change in use is not being made.
(4)
Schools.
(5)
Single-family dwelling.
(c)
Uses by review. A use by review is any of the following uses, which are permitted only upon issuance of a special use permit by the Planning Commission:
(1)
Alternative energy structure.
(2)
Bed and breakfast.
(3)
Church.
(4)
Clinic.
(5)
Club.
(6)
Condominium.
(7)
Extended care facility.
(8)
Family care home.
(9)
Grazing.
(10)
Home for the developmentally disabled.

(d)
Lot area. No parcel of land, at the time of the passage of the zoning ordinance codified herein, can henceforth be divided for sale in units of less than 8,000 square feet.

Lot dimensions. No parcel of land shall be less than 70 feet in width and 100 feet in depth.

(11)
Service stations, gasoline.
(12)
Supermarkets.
(c)
Uses by review. A use by review is any of the following uses, which are permitted only upon issuance of a special use permit by the Planning Commission:
(1)
Any use not listed as a use by right except for junk yards, which are prohibited in this zone district.
(2)
Alternative energy structure.
(3)
Communication facility.
(4)
Medical marijuana businesses.

(d)
Lot area. No parcel existing in single ownership at the time of the passage of the zoning ordinance codified herein shall be divided for sale in units smaller than 5,000 square feet.

(1)

Storage. All items held for sale or repair, with the exception of titled vehicles and farm equipment, shall be stored in a fully enclosed building or adequately shielded from public view by a minimum of a six-foot-tall fence during nonbusiness hours.

(k)

(l)
(1)
Residential units may be located on the second floor and all floors above the second floor of a building provided
a.
That the fire code enforcement officer and building inspector inspect each residential unit located on the second floor and floors above the second floor of a building prior to the unit's initial occupation as a residential unit; and
b.
That no residential unit located on the second floor and any floor above the second floor of a building shall be occupied or used as a residential unit until said unit is in compliance with the fire code and all building and building maintenance codes then in effect and a certificate of occupancy has been issued by the building inspector.
(2)
Conflict. All ordinances or parts of ordinances in conflict with this ordinance are hereby repealed or amended to the extent necessary to conform with this chapter.
(3)
Severability. Should any section, clause or provision of this ordinance be declared to be invalid by a court of competent jurisdiction, such decision shall not affect the validity of this ordinance as a whole, or any part thereof, other than the part declared to be invalid.

(4)
Auto storage.
(5)
Beer, ale and liquor, wholesale.

(7)
Cafes and cafeterias.
(8)
Can, wholesale.
(9)
Cement products, retail and wholesale.
(10)
Concrete batching or "ready mix" plants.
(11)
Contractors' equipment and supplies, retail and wholesale.

The emission of heat, glare, radiation or fumes by this use shall not emit any obnoxious or dangerous degree of heat, glare, radiation or fumes beyond any point of any boundary line of the lot on which the use is located.

(1)
Residential units may be located on the second floor and all floors above the second floor of a building provided
a.
That the fire code enforcement officer and building inspector inspect each residential unit located on the second floor and floors above the second floor of a building prior to the unit's initial occupation as a residential unit; and
b.
That no residential unit located on the second floor and any floor above the second floor of a building shall be occupied or used as a residential unit until said unit is in compliance with the fire code and all building and building maintenance codes then in effect and a certificate of occupancy has been issued by the building inspector.
(2)
Conflict. All ordinances or parts of ordinances in conflict with this ordinance are hereby repealed or amended to the extent necessary to conform with this chapter.
(3)
Severability. Should any section, clause or provision of this ordinance be declared to be invalid by a court of competent jurisdiction, such decision shall not affect the validity of this ordinance as a whole, or any part thereof, other than the part declared to be invalid.

The emission of heat, glare, radiation or fumes by this use shall not emit any obnoxious or dangerous degree of heat, glare, radiation or fumes beyond any point of any boundary line of the lot on which the use is located.
