AND BOUNDARIES

§ 154.025 ZONING DISTRICTS.

   In order to achieve the purposes of this chapter as set forth in this chapter, the town zoning area is hereby divided into the zoning districts listed below:
   (A)   R-1 Residential District;
   (B)   R-2 Residential District;
   (C)   R-3 Residential District;
   (D)   MH Manufactured Home Residential District;
   (E)   NB Neighborhood Business District;
   (F)   CB Central Business District;
   (G)   HB-1 Highway Business District;
   (H)   HB-2 Highway Business District;
   (I)   I-1 Industrial District;
   (J)   I-2 Industrial District;
   (K)   I-3 Industrial District; and
   (L)   MU Mixed Use District.

§ 154.026 DISTRICT BOUNDARIES.

   The boundaries of the zones are shown upon the map accompanying the ordinance codified in this chapter and made a part hereof, entitled “Zoning District Map, Town of Rose Hill, North Carolina.” The Zoning Map and all the notations, references, and all amendments thereto, and other information shown thereon is hereby made a part of this chapter the same as if the information set forth on the map were all fully described and set out herein. The Zoning Map properly attested is on file in the office of the Town Clerk and is available for inspection by the public.

§ 154.027 CONSIDERATION GIVEN TO BOUNDARY DELINEATIONS.

   In the creation, by this chapter, of the respective zones, the Town Board has given due and careful consideration to the peculiar suitability of each and every zone for the particular regulations applied thereto, and the necessary, proper, and comprehensive groupings and arrangements of the various uses and densities of population in accordance with a well-considered plan for the development of the town.

§ 154.028 DISTRICT BOUNDARIES ESTABLISHED.

   The boundaries of the zones as are shown upon the map adopted by this chapter are hereby adopted and the provisions of this chapter governing the use of land and buildings, the height of buildings, building site areas, the sizes of yards about buildings, and other matters as hereinafter set forth are hereby established and declared to be in effect upon all land included within the boundaries of each and every zone shown upon the map.

§ 154.029 INTERPRETATION OF DISTRICT BOUNDARIES.

   (A)   Generally. Where uncertainty exists as to boundaries of any zone shown on the map, the following rules shall apply.
   (B)   Specifically.
      (1)   Where the zone boundaries are indicated as approximately following street lines, alley lines, and lot lines, the lines shall be construed to be the boundaries.
      (2)   In unsubdivided property or where a zone boundary divides a lot, the location of the boundary, unless the same is indicated by dimensions, shall be determined by use of the scale appearing on the map.
      (3)   In case any further uncertainty exists, the Board of Adjustment shall interpret the intent of the map as to location of the boundaries.
      (4)   Where any street or alley is hereafter officially vacated or abandoned, the regulations applicable to each parcel of abutting property shall apply to that portion of the street or alley added thereto by virtue of the vacation or abandonment.
