CHAPTER 1161

Districts; District Map

1161.01 DISTRICTS ESTABLISHED.

   (a)    The City is divided into three types of districts:
      (1)    R districts - residential
      (2)    C districts - commercial
      (3)    M districts - industrial
   (b)    The three types of districts are further divided into the following specific districts:
      (1)    RS-1 Residential
       (2)    RS-1A Residential
      (3)    RS-2 Residential
       (4)    RS-3 Residential
      (5)    RD Residential
       (6)    RA Residential
      (7)    C-1 Neighborhood Commercial
      (8)   C-2 General Commercial
      (9)    C-3 Central Commercial
      (10)    C-4 Planned Commercial
      (11)    M-1 Light Industrial
      (12)    M-2 General Industrial
      (13)    M-3 Restricted Industrial

1161.02 DISTRICT BOUNDARIES.

   (a)    The boundaries of the districts are shown upon the map, which map is designated as the District Map. The District Map and all notations, references and other information shown thereon are a part of the Zoning Ordinance and have the same force and effect as if the District Map and all the notations, references and other information shown thereon were all fully set forth or described herein, the original of which District Map is properly attested and is on file with the Council Clerk.
   (b)    Whenever any street, alley or other public way is vacated by official action of Council, the zoning district adjoining each side of such street, alley, or public way shall be automatically extended to the appropriate property line and all area included in the vacation shall then and henceforth be subject to all appropriate regulations of the extended districts.
   (c)    Territory annexed to the City after the effective date of the Zoning Ordinance shall continue to be governed by the zoning regulations which governed the territory annexed immediately prior to the annexation, as enacted by a Board of County Commissioners under Ohio R.C. 303.01 to 303.25, or enacted by a Board of Township Trustees under Ohio R.C. 519.02 to 519.25, as the case may be.

   (d)    All territory annexed to the City which is unzoned at the time of annexation shall remain unzoned until such time as the Planning Commission and Council act to zone such annexed territory. A moratorium for construction and/or land development shall exist for a maximum period of 120 days unless Council acts within such 120 day moratorium.

   (e)    As soon as practicable after the annexation of territory to the City, proceedings shall be instituted by the Planning Commission to include the annexed territory in one or more of the zoning districts defined in this chapter, and as amended.

1161.03 INTERPRETATION OF DISTRICT BOUNDARIES.

   Where uncertainty exists with respect to the boundaries of the various districts as shown on the District Map, the following rules apply:
   (a)    The district boundaries are either streets or alleys unless otherwise shown, and where the districts designated on the Map are bounded approximately by street or alley lines, the street or alley shall be constructed to be the boundary of the district.
   (b)    Where the district boundaries are not otherwise indicated, and where the property has been or may hereafter be divided into blocks and lots, the district boundaries shall be construed to be the lot lines, and where the districts designated on the District Map are bounded approximately by lot lines, the lot lines shall be construed to be the boundary of the districts unless the boundaries are otherwise indicated on the Map.
   (c)    In subdivided property, the district boundary lines on the Map shall be determined by use of the scale appearing on the Map.
