LANDSCAPING

§ 9.01 Applicability.

These landscaping requirements shall be applicable to construction of new structures for which a building permit is required for any commercial and industrial uses, and expansion of structures used for commercial and industrial uses.

§ 9.02 Exemptions from Landscape Requirements.

Construction or expansion of existing structures in the downtown area shall be exempt from landscape requirements.

§ 9.03 Landscape Area Required.

Construction projects subject to this section shall provide landscape areas calculated as follows:
A. 
Commercial/Industrial uses:
A minimum of ten percent (10%) of net area being improved shall be landscaped.

§ 9.04 Miscellaneous Requirements.

A. 
Landscape areas adjacent to vehicle use areas shall be protected by wheel stops, curbs or other physical barriers.
B. 
Landscape areas shall be located outside the exterior perimeter of the footprint of a building or structure.
C. 
A minimum of seventy-five percent (75%) of the landscaping requirement shall be located in the front yard between the building line and the front property line.
D. 
Landscape areas located within the street and alley right-of-ways shall not be credited towards meeting the minimum ten percent (10%) landscaping requirement.

§ 9.05 Installation and Maintenance.

A. 
All landscape materials shall be installed in sound workmanship manner and according to accepted good planting procedures.
B. 
All landscaping shall be completed prior to the issuance of a certificate of occupancy by the City.
C. 
The owner of the structure, or his manager or agent, shall be responsible for the maintenance of the landscaping, which shall be maintained so as to present a healthy, neat and orderly appearance at all times and shall be kept free from refuse and debris. All planted areas shall be provided with readily available water supply and watered regularly to ensure continuous healthy growth and development. Maintenance shall include the replacement of all dead plant material.
D. 
The owner of the structure, or his manager or agent, shall be responsible for the irrigation of all landscaping and plant materials, utilizing one or a combination of the following methods: a. an automatic underground irrigation system (conventional spray, bubbler, and the like); b. an automatic water-saving irrigation system (drip, porous pipe, leaky pipe, and the like); or, c. a hose attachment within one hundred (100) feet of all required landscaping and plant materials.
E. 
No irrigation shall be required for undisturbed natural areas or undisturbed existing trees.
F. 
Low water use and drought tolerant plants, trees and grass are encouraged.
