ARTICLE I

Scope and Purposes

§ 245-1 Scope.

This chapter, hereby enacted for the Town of Saugerties, New York, shall regulate or restrict the height and size of buildings; the percentage of a lot that may be occupied; the size of yards, courts and open spaces; the density of population and the location and use of buildings, structures and land for trade, industry, residence or other purposes as empowered by the Town Law of the Consolidated Laws of the State of New York. In order to accomplish the purpose of this chapter and to further the Comprehensive Plan for the entire Town, the Town shall be divided into several districts, the regulations of which shall be administered uniformly within each district.

§ 245-2 Purposes.

This chapter is created in accordance with and as a means of effectuating a comprehensive plan for protecting and promoting public health, safety, comfort, convenience, economy, and general welfare. Specifically, this chapter is intended to carry out the following goals, among others:
A. 
To promote the use of land for its most appropriate, reasonable and beneficial purposes;
B. 
To promote the character, rights, and stability of established residences and businesses;
C. 
To conserve and enhance the value of land, farms, viewscapes, and buildings;
D. 
To provide for an affordable and diverse choice of housing options;
E. 
To provide an attractive landscape that enhances the physical environment of the Town, and to promote appropriate scale and design of land and buildings;
F. 
To improve design, convenience, and safety of transportation facilities, and to enhance traffic circulation for vehicles, bicycles, and pedestrians, and for parking and loading/unloading facilities;
G. 
To promote efficiently spaced development which meets community needs, protects natural, agricultural, historic, and cultural resources, and preserves open space;
H. 
To protect and promote enjoyment of the Town's natural, agricultural, historic, and cultural resources;
I. 
To provide adequate light, air, space and landscaping to all buildings and to prevent overcrowding of structures;
J. 
To assure privacy for residences;
K. 
To protect rivers, streams, creeks, wetlands, ponds, lakes, and other bodies of water;
L. 
To form attractive and landscaped vehicular corridors and gateways through and approaching the Town;
M. 
To protect and construct greenways and wildlife corridors throughout the Town contiguous with adjoining corridors;
N. 
To provide and retain permeable surfaces and to utilize all available means to reduce stormwater runoff and to protect the water table and aquifers;
O. 
To encourage preservation, renovation, and use of existing structures whenever possible, with special consideration for designated historic landmarks; and
P. 
To facilitate the proper administration and appropriate and effective enforcement of this chapter.

§ 245-3 Noninterference with other laws.

This chapter is not intended to abrogate, render invalid, or interfere with the application and administration of any other lawful statute, ordinance, regulation, easement, private agreement, covenant, deed restriction, or other legal relationship, public or private. Wherever any lawful statute, ordinance, regulation, easement, private agreement, covenant, deed restriction, or other legal relation — public or private — imposes controls which are inconsistent with any provisions of this chapter, then those provisions which are the most restrictive or impose higher standards shall take precedence.
