NONCONFORMING USES

Sec. 55-159.- Existing uses; changing use to a more restrictive classification.

Any lawful use of a building existing at the effective date of the ordinance from which this article is derived may be continued, even though such use does not conform to the provisions hereof. If no structural alterations are made, nonconforming use of a building may be changed to another nonconforming use of the same or of a more restrictive classification. Whenever a nonconforming use has been changed to a more restricted use or to a conforming use, such use shall not thereafter be changed to a less restricted use. The nonconforming use of a building may be extended throughout those parts thereof which were manifestly arranged or designed for such use at the time of adoption of the ordinance from which this article is derived.

Sec. 55-160. - Discontinued use.

Whenever a nonconforming use is discontinued for a period of 12 consecutive months, any future use of the structure shall conform to the regulations of the district in which it is located.

Sec. 55-161. - Structure damage.

Where the structure in which a nonconforming use is carried on is damaged to the extent of more than 50 percent of its fair market value, it shall not be restored for use, except in conformity with the regulations of the district in which it is located.

Sec. 55-162. - Expansion, extension of use prohibited.

A nonconforming use of land existing at the effective date of the ordinance from which this article is derived may be continued; provided, however, that no such nonconforming use of land shall be in any way expanded or extended, either on the same or adjoining property. If such nonconforming use of land, or any portion thereof is discontinued for a period of 12 consecutive months, any future use of the land shall conform to the regulations of the district in which it is located.
