ARTICLE VII

MISCELLANEOUS PROVISIONS

Sec. 55-689.- Annexation.

All territory annexed to the city shall automatically become a part of R-1 single-family residence district until definite boundaries and regulations are recommended by the city plan commission and adopted by the common council; provided, however, the common council shall adopt definite boundaries and district regulations within 90 days from the date of annexation.

Sec. 55-690. - Certificate of occupancy.

(a)

No vacant land shall be occupied or used and no building hereafter erected, altered or moved shall be occupied until a certificate of occupancy shall have been issued by the building inspector or zoning administrator. Such certificate shall show that the building or premises or part thereof and the proposed use thereof are in conformity with the provisions of this chapter. Such permit shall be issued only when the building or premises and the proposed use thereof conform with all the requirements of this chapter.

(b)

Under such rules and regulations as may be established by the common council, the building inspector or zoning administrator may issue a temporary certificate of occupancy for part of a building.

(c)

Upon written request from the owner, the building inspector or zoning administrator shall issue a certificate of occupancy for any building or premises existing at the time of the adoption of the ordinance from which this article is derived, certifying, after inspection, the extent and kind of use made of the building or premises and whether or not such use conforms to the provisions of this article.

Sec. 55-691. - Official map.

(a)

Adoption. There is hereby established and adopted an official map of the city pursuant to Wis. Stats. § 62.23(6).

(b)

Official map. The official map shall be dated June 8, 1976, shall be designated official map of the city, shall be in the custody of the city clerk/treasurer, and shall be filed at city hall. Such official map may be combined with the official zoning map of the city.

(c)

Filing. The city clerk/treasurer shall file a certificate with the county register of deeds stating that the city has adopted an official map.

Sec. 55-692. - Official map changes.

The official map of the city is hereby changed and amended within the city limits as follows:

Proposed Grossman Drive extension, from Grossman Drive South to its intersection with Business Highway 51 and Highway 29, is deleted in its entirety.

Sec. 55-693. - District changes.

District changes are as follows:

(1)

The following territory in said city, now in the "R-1" District is hereby designated to be and become hereafter a part of the "C-1" District:

The West 160' of the following described property: Lot 4 Ex N. 22' of Blk. 2 of the Village of Schofield Plat in the City of Schofield.

The following territory in said city, now in the "R-1" District is hereby designated to be and become hereafter a part of the "C-1" District:

The East 82.5 foot × 239.95 foot portion of the following described property: Part of the Southeast ¼ of the Southeast ¼ of Section 12, Township 28 North, Range 7 East, commencing at the center of Grand Avenue 237 feet Southerly of its intersection with the North line of said forty, Southerly along the center of Grand Avenue 7 rods East, 18 rods Northerly parallel with Grand Avenue 15 rods West 5 rods Northerly parallel with Grand Avenue 15 rods West 5 rods to a point 11 rods East of the East line of Grand Avenue, Southerly parallel with Grand Avenue 8 rods West 13 rods to beginning, except Vol. 216M-56 M347-46 M358-1081.

Parts of Lots 1, 2, 3 and 4 of Block 4 of Mylrea's Acre Lots, Parcel 1 & 2 of Certified Survey Map No. 3509, Vol. 13, page 104 of CSM in Marathon Co. Register of Deeds. Lots located in the City of Schofield, Wisconsin.

The following territory in said city, now in "R-1" District is hereby designated to be and become hereafter a part of the "C-1" District:

Part of the North one-half (N½) of the Northwest fractional one-quarter (NWF¼), and part of the South one-half (S½) of the Northwest fractional one-quarter (NWF¼), all in Section 18, Township Twenty-eight (28) North, Range Eight (8) East, City of Schofield, Marathon County, Wisconsin. The boundary of the parcel begins at the northeast corner of Outlot 9 in Herman Kuehl's subdivision, hence 501.70 feet southwest along a line that is south 1 degree 9 minutes West, hence 102.60 feet East, hence 719.90 feet Northeast along a line that is North 0 degrees 51 minutes East, hence 147.66 feet Southwest along a line that is South 88 degrees 11 minutes West, hence 190.86 feet southeast along a line that is South 88 degrees 11 minutes West, hence 190.86 feet Southeast along a line that is North 7 degrees 32 minutes East, hence Southeast 73.15 feet along a line that is South 71 degrees 24 minutes East to the point of beginning.

The following territory in the city, now in the "R-1 Single Family Residence" District is hereby designated to be a Uniform Development District (UDD):

A part of lot six (6) and lots two (2) and three (3) of Certified Survey Map No. 8270 recorded in Volume 32 of CSM, page 38, Marathon County Register of Deeds Office and a part of lot six (6) and lot one (1) of Certified Survey Map No. 8270, recorded in Volume 32 of CSM, page 38, Marathon County Register of Deeds Office, Marathon County, Wisconsin.

The following described premises, which was zoned R-1 Single Family Residence District, shall continue to be conditionally designated a part of the Unified Development District as set forth in section 55-395, et seq. of the Code of Ordinances of the City of Schofield and which pursuant to subsection 55-395(c) is permitted as a conditional use in all zoning districts. The premises is legally described as follows:

Lot one (1) of Certified Survey Map No. 16278 recorded in the office of the Register of Deeds for Marathon County, Wisconsin, in volume 75 of Certified Survey Maps on page 77; being Lots two (2) and three (3) in Block seven (7); also part of Lots one (1), two (2) and three (3) in Block one (1); the School Lot; the vacated Cemetery Lot; and the vacated portion of School Street; all being a part of the Original Plat of the Village of Schofield, Marathon County, Wisconsin; subject to easements of record.

The above described parcel of land contains 35,972 square feet or 0.826 acres, more or less;

Said parcel is subject to all easements, restrictions and righst-of-way of record;

The UDD District designation is hereby removed from the following legally described property which shall hereinafter revert back to and be designated as part of the R-1 Residential District Zoning District of the City:

Of a parcel of land described in Document No. 1801942 being a part of Charles Crossing Condominium and part of Parcel 3 of Certified Survey Map No. 14240 located in part of the Southeast 1/4 of the Southeast 1/4, Section 13, Township 28 North, Range 7 East, City of Schofield, Marathon County, Wisconsin, described as follows:

Beginning at the Southwest corner of said Parcel 3 of Certified Survey Map No. 14240 recorded in Volume 63 of Certified Survey Maps on Page 67 as Document No. 1437643 and the Southwest corner of Charles Crossing Condominium; Thence North 15°42'36" East along the East line of Lot 1 of Certified Survey Map No. 17059, recorded in Volume 80 of Certified Survey Maps on Page 121 as Document No. 1687746, 120.00 feet; Thence South 74°02'33" East, 175.07 feet; Thence North 20°16'48" East, 194.75 feet to the South right-of-way line of Charles Street; Thence South 72°33'52" East along said South right-of-way line, 60.07 feet to the Westerly right-of-way line of Chicago Milwaukee St. Paul and Pacific Railroad; Thence South 20°16'48" West along said westerly right-of-way, 313.53 feet to the North line of Parcel 1 of said Certified Survey Map No. 14240; Thence North 74°02'33" West along said North line, 225.66 feet to the point of beginning.

That the above described parcel of land contains 39,292 square feet or 0.902 acres, more or less;

That said parcel is subject to all easements, restrictions and rights-of-way of record.

The following described property shall be and the same is hereby designated to become hereafter a part of the C-1 First Commercial District. Said property is legally described as follows:

Lots 1, 2, and 3, of certified survey Map No. 18842, recorded as Document No. 1826569, located in the Northeast quarter of the Northeast quarter of Section 13, Township 28 North, Range 07 East, City of Schofield, Marathon County, Wisconsin.

Said parcel contains ±122,973 square feet or 2.823 acres more or less, including those lands lying between the meander line and Lake Wausau.

That said parcel is subject to all easements, restrictions and rights-of-way of record including a 12.00 foot wide driveway easement as described and recorded in Volume 413 of deeds on page 406 and subject to flowage rights as described in Volume 161 of deeds on page 504 and Volume 207 of deeds on page 535.

Sec. 55-694. - Comprehensive plan.

(a)

Pursuant to Wis. Stats. §§ 62.23 and 66.1001(4), the City of Schofield is authorized to prepare, adopt and amend its comprehensive plan as defined and provided for in Wis. Stats. § 66.1001.

(b)

The common council by the enactment of Ordinance No. 55-694, formally adopted the document entitled "City of Schofield Comprehensive Plan 2006" in May of 2006.

(c)

The common council amended Ordinance No. 55-694 entitled "City of Schofield Comprehensive Plan; Goals, Objectives, Policies and Implementation; Revision September 2017" and so amended the comprehensive plan for the city.

(d)

The common council again amended Ordinance No. 55-694 entitled "City of Schofield Comprehensive Plan; Goals, Objectives, Policies and Implementation; Revision February 2021" and so amended the comprehensive plan for the city.

(e)

After due public notice and hearing, the common council, by a majority vote of the entire commission recommends to the common council the adoption of amendments to the comprehensive plan.

(f)

The common council hereby approves the amended comprehensive plan as submitted by the plan commission which shall hereafter be entitled and known as, the comprehensive plan hereafter shall be "City of Schofield Comprehensive Plan; Goals, Objectives, Policies, and Implementation; Revision August 2022."

(g)

The city clerk is hereby directed to send a copy of the comprehensive plan amendment adopted hereto to the parties listed in Wis. Stat. § 66.1001(4)(b).
