GENERAL PROVISIONS
§ 27-101 Long Title.

The long title of this Ordinance is as follows: “An Ordinance Repealing Parts of the Selinsgrove Zoning Ordinance of 1967, as amended, Replacing Said Ordinance With an Ordinance Permitting, Prohibiting, Regulating, Restricting, and Determining the Uses of Land, Watercourses, and Other Bodies of Water; the Size, Height, Bulk, Location, Erection, Construction, Repair, Maintenance, Alteration, Razing, Removal and Use of Structures as Well as Courts, Yards, and Other Open Spaces and Distances to Be Left Unoccupied by Uses and Structures; the Density of Population and Intensity of Use; the Location and Size of Signs; Creating Zoning Districts and Establishing the Boundaries Thereof; Continuing the Office of Zoning Officer; Continuing a Zoning Hearing Board; and Providing for the Administration, Amendment, and Enforcement of the Ordinance, Including the Imposition of Penalties.”
§ 27-102 Short Title.

This Chapter shall be known and may be cited as the “Selinsgrove Borough Zoning Ordinance.”
§ 27-103 Purposes.

This Chapter has been prepared in accordance with the Borough Comprehensive Plan and with the Pennsylvania Municipalities Planning Code, 53 P.S. §10101 et seq., and with consideration for the character of the Borough, its various parts and the suitability of its various parts for particular uses and structures and is enacted for the following purposes:
A.
To promote, protect and facilitate any or all of the following: the public health, safety, morals and general welfare; coordinated and practical community development and proper density of population; emergency management preparedness and operations, airports and national defense facilities; the provisions of adequate light and air; access to incident solar energy; police protection; vehicle parking and loading space; transportation; water; sewerage; schools; recreational facilities; public grounds; the provision of a safe, reliable and adequate water supply for domestic, commercial, agricultural or industrial use; and other public requirements; as well as preservation of the natural, scenic and historic values in the environment and preservation of forests, wetlands, aquifers and floodplains.
B.
To prevent one or more of the following: overcrowding of land; blight; danger and congestion in travel and transportation; and the loss of health, life or property from fire, flood, panic or other dangers.
C.
To preserve prime agriculture and farmland considering topography, soil type and classification, and present use.
D.
To provide for the use of land within the Borough for residential housing of various dwelling types encompassing all basic forms of housing, including single-family and two-family dwellings, a reasonable range of multi-family dwellings in various arrangements, mobile homes and mobile home parks, provided that this Chapter shall not be deemed invalid for the failure to provide for any other specific dwelling type.
E.
To accommodate reasonable overall community growth, including population and employment growth and opportunities for development of a variety of residential dwelling types and nonresidential uses.
F.
To provide, through a comprehensive planning process, a basis upon which to make pertinent decisions about such issues as natural resources, environmental qualities, housing, transportation, community facilities and services and the economy.
§ 27-104 Statement of Community Development Objectives.

The statement of community development objectives is hereby supplied by reference to Part II of the Selinsgrove Borough Comprehensive Plan (1975), entitled “Statement of Purpose, Goals, and Objectives,” on six pages of that document.
§ 27-105 Interpretation of Provisions.

In interpreting and applying the provisions of this Chapter, they shall be held to be the minimum requirements for the promotion of health, safety, morals and the general welfare of the Borough and its citizens. It is not intended by this Chapter to interfere with or abrogate or annul any rules or regulations previously adopted or permits previously issued by the Borough which are not in conflict with and provisions of this Chapter, nor is it intended by this Chapter to interfere with or abrogate or annul any easement, covenants, building restrictions or any other agreements between parties; provided, however, that where this Chapter imposes a greater restriction upon the use of the buildings or premises or upon the height of the building or requires a larger open space than is imposed or required by such ordinance, rules, regulations or permits or by easements, covenants, building restrictions or agreements, the provisions of this Chapter shall control.
§ 27-106 Effect on Other Ordinances.

No uses shall be permitted in any district which directly violate any Borough ordinance.
