CHAPTER 3

GENERAL ZONING PROVISIONS

10-3-1: ZONING DISTRICTS AND MAP:

   A.   Districts Established: In order to classify, regulate, and restrict the location of trades and industries, and the location of buildings designed for specific uses; to regulate and limit the height and bulk of buildings; to regulate and limit the intensity and use of lots; and to regulate and determine the area of yards, courts and other open spaces within and surrounding buildings, the village is hereby divided into districts of which there shall be four (4) in number as follows:

Multiple-family residential district

Business and light industry district

Heavy industry district
 
   B.   Zoning Map: The boundaries of designated districts are shown upon the map made a part of this title, which map is designated as the "Zoning Map Of The Village Of Shannon". The zoning map is made a part of this title and on file in the office of the village clerk, and all notations, references and other information shown thereon are a part of this title and have the same force and effect as if the zoning map and all such notations, references, and other information shown thereon were fully set forth or described herein. 10-3-2: COMPLIANCE WITH PROVISIONS:

   A.   No building shall be erected or structurally altered for any purpose other than that provided herein for the district in which it is located.
   B.   No building shall be erected or altered or moved to exceed in height the limit established herein for the district in which such building is located.
   C.   No lot area shall be so reduced or diminished that the yards or other open spaces shall be smaller than prescribed by this title, nor shall the density of population be increased in any manner, except in conformity with the area regulations herein established for the district in which such building is located. 10-3-3: ACCESSORY BUILDINGS:

Accessory buildings, except as otherwise permitted in this title, shall be subject to the following regulations:
   A.   An accessory building shall not be erected prior to the establishment of the principal use or the construction of the principal building.
   B.   No accessory building shall be used for dwelling purposes. (Ord. 78b, 7-1-1958)

10-3-4: ADDITIONAL USE AND HEIGHT REGULATIONS:

The regulations set forth in this section qualify or supplement, as the case may be, the district use and height regulations appearing elsewhere in this title:
   A.   Public, semipublic, or public service buildings, hospitals, institutions or schools, when permitted in a district, may be erected to a height not exceeding sixty feet (60'), and churches and temples may be erected to a height not exceeding fifty feet (50').
   B.   Single-family dwellings and multiple dwellings may be increased in height by not more than ten feet (10') when the front, side and rear yards are increased over the yard requirements of the district in which they are located by one foot (1') for each additional foot of building height above the height limit otherwise provided in the district in which the building is built.
   C.   Chimneys, cooling towers, elevator bulkheads, grain elevators, fire towers, monuments, stacks, stage towers, scenery lots, tanks, water towers, ornamental towers and spires, church steeples, radio and television towers or necessary mechanical appurtenances may be erected to a height in accordance with the existing or hereafter adopted ordinances of the village. 10-3-5: NONCONFORMING USES AND STRUCTURES:

   A.   The lawful use of land or buildings existing at the effective date hereof may continue, although such use does not conform to the regulations specified by this title within the district in which such land or building is located, subject to the following conditions and specifications:
      1.   Any nonconforming use of land or buildings which has ceased by discontinuance or abandonment for a period of six (6) months shall thereafter conform to the provisions of this title.
      2.   No nonconforming use of a building may be moved to any other part of a parcel of land upon which same was conducted at the effective date hereof.
      3.   No nonconforming building shall be enlarged or structurally altered except to make it a conforming building. A nonconforming use of a building existing at the effective date hereof may be extended throughout the building, provided no structural alterations except those required by ordinance or law are made therein.
      4.   The use of a nonconforming building may be changed to a more restricted classification or a use of equal character, but not to a less restricted classification.
   B.   The provisions of subsection A of this section shall also apply to nonconforming uses in districts hereafter changed by amendment to this title. (Ord. 78b, 7-1-1958)
