CHAPTER 5

RESIDENTIAL DISTRICTS

10-5A-1: USES:

   A.   Permitted Uses: It shall be unlawful to use or permit the use of any building or premises in an R-1 one-family residential district for any purpose other than the following:
Gardening and other horticultural uses where no building is involved.
One-family detached dwellings.
Accessory buildings and uses customarily incidental to the above uses not involving the conduct of a business.
Temporary buildings for construction purposes for a period not to exceed one year.
   B.   Uses By Special Permit:
Churches.
Home occupations as defined in section 10-1-3 of this title.
Nursery schools or daycare centers provided there is a minimum of one hundred (100) square feet of outdoor play area for each child to be on the premises and the play area is fenced and screened with plantings from any adjoining lot.
Nursing home.
Public libraries or parks.
Roadside stands for sale of produce.

10-5A-2: BUILDING HEIGHT:

No building erected or enlarged shall exceed two and one-half (21/2) stories or thirty five feet (35') in height. (Ord. 78b, 7-1-1958)

10-5A-3: YARD AND LOT REQUIREMENTS:

No building shall be erected or enlarged unless the following yards and lot areas are provided and maintained in connection with such building, structure or enlargement:
   A.   Yards:
      1.   Front Yard: Each lot upon which a dwelling is constructed shall have a front yard of not less than thirty feet (30') in depth except as follows: The front yard depth for a principal building located on a lot within seventy feet (70') measured along the street line from the front corners of the lot under consideration, to any portion of two (2) or more lots in the same block and which lots are occupied by dwellings that front on the same street as the proposed principal dwelling shall be the average front yard depth of such existing dwellings. In computing such front yard depths, existing buildings with front yard depths greater than fifty feet (50') shall be assumed to have a front yard depth of fifty feet (50'), and a building with a front yard depth less than twenty feet (20') shall be assumed to have a depth of twenty feet (20').
      2.   Side Yards:
         a.   Interior Lots: On interior lots, there shall be a side yard on each side of a main building of not less than seven feet (7') or ten percent (10%) of the average lot width, whichever is less, but in no case less than five feet (5').
         b.   Corner Lots: On corner lots, the side yard requirement shall be the same as for interior lots; except, that there shall be maintained a side yard of not less than ten feet (10') on the side adjacent to the street which intersects the street upon which the building or structure maintains frontage.
      3.   Rear Yard: There shall be a rear yard having a depth of not less than ten feet (10').
      4.   Yard Encroachments: Accessory buildings shall not encroach upon the front, side and rear yards as required by this subsection.
   B.   Lot Coverage: Not more than forty percent (40%) of the area of a lot may be covered by main buildings, structures, or accessory buildings. (Ord. 78b, 7-1-1958)
   C.   Lot Area: Every dwelling hereafter erected or structurally altered as a one-family dwelling shall be on a lot having an area of not less than seven thousand five hundred (7,500) square feet and a width of seventy five feet (75'); provided, however, that where a lot has less area and width, but is a single tract and the title thereof has been platted and recorded before the effective date hereof, said lot may be improved with a one-family dwelling or structure and accessory buildings, provided the lot coverage is within seventy five percent (75%) of that required by the terms of subsection B of this section; and provided further, that the total lot area is not less than four thousand (4,000) square feet. 10-5A-4: MOBILE HOMES PROHIBITED:

   A.   It shall be unlawful to place a mobile home on any premises in an R-1 one-family residential district.
   B.   Any mobile home currently in an R-1 one-family residential district shall be considered a nonconforming structure subject to the provisions of section 10-3-5 of this title. (Ord. 347, 6-5-2012)

Boarding or lodging house.
Churches.
Home occupations as defined in section 10-1-3 of this title.
Nursery schools or daycare centers provided there is a minimum of one hundred (100) square feet of outdoor play area for each child to be on the premises and the play area is fenced and screened with plantings from any adjoining lot.
Nursing home.
Public libraries or parks.
Roadside stands for sale of produce.

10-5B-2: BUILDING HEIGHT:

No buildings shall hereafter be erected or structurally altered to exceed two and one-half (21/2) stories or thirty five feet (35'). (Ord. 78b, 7-1-1958)

10-5B-3: YARD AND LOT REQUIREMENTS:

No building shall be erected nor shall any existing structure be enlarged or altered for multiple-family use unless the following yards and lot areas are provided and maintained in connection with such structure, alteration or enlargement:
   A.   Yards:
      1.   Front yard: The same regulations shall apply as required in the R-1 one-family residential district.
      2.   Side yards: The same regulations shall apply as required in the R-1 one-family residential district.
      3.   Rear yard: The same regulations shall apply as required in the R-1 one-family residential district.
      4.   Yard encroachments: The same regulations shall apply as required in the R-1 one-family residential district.
   B.   Lot Coverage: Not more than fifty percent (50%) of the area of a lot may be covered by main buildings, structures, or accessory buildings.
   C.   Lot Area:
      1.   Every building hereafter erected or structurally altered as a multiple dwelling, apartment or row dwelling of more than two (2) dwelling units shall provide a lot area per dwelling unit of not less than one thousand five hundred (1,500) square feet.
      2.   No building hereafter erected or structurally altered in the R-2 multiple-family district shall have a total lot area of less than five thousand five hundred (5,500) square feet, nor a lot width at the established building line of less than fifty feet (50'); except, that one-family dwellings may be erected or structurally altered on lots having an area of not less than five thousand (5,000) square feet and a width at the established building line of forty feet (40'); provided, however, that where a lot having less area and width, but is a single tract and the title thereof has been platted and recorded prior to the effective date hereof, said lot may be improved with a dwelling or structure, provided the lot coverage is within seventy five percent (75%) of that required by the terms of subsection B of this section; and provided further, the total lot area is not less than four thousand (4,000) square feet. 10-5B-4: MOBILE HOMES PROHIBITED:
