CHAPTER 6

BUSINESS DISTRICTS

10-6A-1: INTENT:

The neighborhood convenience shopping center district is intended to provide convenience shopping for persons in close proximity to residential areas. Permitted uses shall be those which are necessary to satisfy basic shopping needs which occur daily or frequently and so require facilities in relative proximity to places of residence. These facilities shall be in the form of a shopping center. (Ord. 93-695, 6-15-1993)

10-6A-2: PERMITTED USES:

No building, structure or parcel of land shall be used and no building or structure shall be erected, altered or enlarged which is arranged, intended or designed for other than a shopping center which includes any of the following uses:
   Bakeries.
   Banks and financial institutions.
   Candy and ice cream stores.
   Civic buildings.
   Drugstores.
   Dry cleaning establishments and laundries employing not more than 10 persons.
   Eating establishments, including outdoor cafes.
   Food stores, grocery stores and meat markets.
   Gift shops.
   Hardware stores.
   Health and fitness uses, maximum floor area of 7,500 SF.
   Instructional uses, maximum floor area of 7,500 SF.
   Massage uses, when accessory to personal care uses and health and fitness uses.
   Offices - business or professional; medical or dental.
   Package liquor stores.
   Personal care uses.
   Shoe and clothing repair stores.
   Tattoo uses, when accessory to personal care uses.
   Variety stores.
   Wearing apparel shops.
   Other uses which are of the same general character as the above permitted uses as determined by the zoning officer, but specifically prohibiting those uses which are first permitted in the B-2 or B-3 district. (Ord. 93-695, 6-15-1993; amd. Ord. 20-1988, 9-22-2020)

10-6A-3: CONDITIONAL USES:

The following conditional uses may be permitted in specific situations in accordance with the procedures outlined in section 10-12-4 and chapter 11 of this title, as appropriate:
   Art studio.
   Daycare centers and nursery schools.
   Drinking establishments.
   Drive-in banking facility.
   Drive-through pharmacy.
   Planned unit developments.
   Public and private utility facilities.

10-6A-4: REQUIRED CONDITIONS:

The following conditions shall be required:
   A.   Shopping Centers: Each B-1 district shall be developed as a shopping center containing more than 1 business establishment.
   B.   Entertainment And Dancing: Eating and drinking establishments shall not include entertainment and dancing.
   C.   Maximum Floor Area: Each store in the shopping center shall be restricted to a maximum gross floor area of 30,000 square feet, exclusive of any floor area devoted to off street parking or loading facilities.
   D.   Site Plan Review: The site plan for the shopping center shall be reviewed by the plan commission which shall report its findings to the village board.
   E.   Consumer Businesses: All business establishments shall be retail or service establishments dealing directly with consumers. All goods produced on the premises shall be sold at retail on the premises where produced.
   F.   Conducting Of Business: All business, servicing or processing, except for off street parking or loading, shall be conducted within completely enclosed buildings. The normal service and sales offered at eating and drinking establishments are excluded from this provision. The village board may waive this provision by designating certain days on which business establishments may conduct their businesses outside the building or structure.
   G.   Outside Storage: All outside storage areas of goods, materials and products are prohibited. Dumpster and rubbish containers shall be screened in accordance with section 10-3-24 of this title. Lighting of the facility shall be directed away from surrounding properties.
   H.   Compliance: Processes and equipment employed within the B-1 district shall comply with the provisions of chapter 7, article D of this title.
   I.   Screening: Screening by fences or landscaping of at least 75 percent opacity shall be provided within all side and rear yards that abut a residential district. (Ord. 93-695, 6-15-1993)

10-6A-5: SITE AND STRUCTURE REQUIREMENTS:

   A.   Lot Area: Minimum area for each B-1 district shall be 20,000 square feet and the maximum area shall be 10 acres.
   B.   Lot Width: There are no lot width requirements in the B-1 district.
   C.   Yards: The minimum yards required in the B-1 district shall be as follows:
      1.   Front Yard:
         a.   Generally: A required front yard of not less than 30 feet.
         b.   Through lots: In cases where the required front yard is greater than the required rear yard, the required front yard setback shall apply.
      2.   Side Yards: On each zoning lot upon which a structure is built, there shall be a required side yard on each side of the main structure of the following:
         a.   Abutting residential districts: An interior side yard of not less than 10 feet and a corner side yard of not less than 30 feet.
         b.   Abutting nonresidential districts: An interior side yard of not less than 10 feet. An interior side yard may be reduced to 0 feet between 2 uses that are connected. A corner side yard of not less than 30 feet.
      3.   Rear Yard: On each zoning lot upon which a structure is built, there shall be a required rear yard for each main structure of the following:
         a.   Abutting residential districts: A required rear yard of not less than the established rear yard requirements for the adjoining residential district.
         b.   Abutting nonresidential districts: A required yard of not less than 20 feet.
   D.   Height Limitations; Bulk Regulations: The maximum floor area ratio for all buildings and structures in the B-1 district shall be 0.5, and the maximum height shall be 3 stories not to exceed 40 feet.
   E.   Lot Coverage: Not more than 85 percent of the lot area may be occupied by principal and accessory buildings and impermeable surfaces combined. At least 15 percent of the remaining lot area shall be open, landscaped area, in which, at minimum, 7 percent of this open, landscaped area shall be provided in the required front yard.
   F.   Signs: In accordance with chapter 10 of this title.
   G.   Off Street Parking And Loading: In accordance with chapter 8 of this title. (Ord. 93-695, 6-15-1993)

10-6B-1: INTENT:

The B-2 community shopping center district is intended to accommodate the needs of a much larger consumer population than is served by the neighborhood convenience shopping center district. A wider range of uses and structure sizes is permitted for both daily and occasional shopping. These facilities shall be in the form of a shopping center. (Ord. 93-695, 6-15-1993)

10-6B-2: PERMITTED USES:

No building, structure or parcel of land shall be used and no building or structure shall be erected, altered or enlarged which is arranged, intended or designed for other than a shopping center which includes any of the following uses:
   Any permitted use in the B-1 district, except dwelling units.
   Animal grooming service.
   Animal hospitals.
   Antique shops.
   Art shops or galleries, but not including auction rooms.
   Bicycle sales, rental and repair stores.
   Blueprinting and photostating establishments.
   Book and stationery stores.
   Business machine stores, sales and service.
   Camera and photographic supply stores.
   Carpet and rug stores, retail sales only.
   Catering establishments.
   China and glassware stores.
   Clinics - medical and dental.
   Clothing and costume rental stores.
   Coin and philatelic stores.
   Commercial kitchen, as accessory to bakery or eating establishment only, operating no earlier than 7:00am or later than midnight.
   Custom dressmaking establishments.
   Dairy product establishments, but not including processing or bottling.
   Department stores and discount stores.
   Drinking establishments.
   Dry goods stores.
   Electrical appliance stores including radio and television sales and repair.
   Employment agencies.
   Frozen food stores, including locker rental in conjunction therewith.
   Furniture stores, including upholstering when conducted as part of the retail operations and secondary to the principal use.
   Furrier shops, including the incidental storage and conditioning of furs.
   Garden supply, tool and seed stores.
   General retail.
   Hearing aid stores.
   Hobby shops, for retail of items to be assembled or used away from the premises.
   Household appliance stores.
   Interior decorating shops, including upholstering and making of draperies, slipcovers and other similar articles, when conducted as a part of the retail operations and secondary to the principal use.
   Jewelry stores, including watch repair.
   Leather goods and luggage stores.
   Locksmith shops.
   Mail order, catalog stores.
   Millinery shops.
   Musical instrument sales and repair.
   Office machine sales and servicing and supply stores.
   Optician - sales, retail.
   Orthopedic and medical appliance stores.
   Paint, glass and wallpaper stores.
   Pet shops.
   Phonographic record and sheet music stores.
   Photography studios, including the developing of film and pictures when conducted as part of the retail business on the premises.
   Picture framing, when conducted for retail trade on the premises only.
   Repair, rental, servicing of any article the sale of which is a permitted use in the district.
   Secondhand stores and rummage shops.
   Sewing machines sales and service.
   Shoe stores.
   Sporting goods stores.
   Tailor shops.
   Theaters, indoor.
   Ticket agencies.
   Tobacco shops.
   Toy shops.
   Travel bureaus and transportation ticket offices.
   Undertaking establishments and funeral parlors.
Other uses which are of the same general character as the above permitted uses, as determined by the zoning officer, but specifically prohibiting those uses which are first permitted in the B-3 district. 10-6B-3: CONDITIONAL USES:

The following conditional uses may be permitted in specific situations in accordance with the procedures outlined in section 10-12-4 and chapter 11 of this title, as appropriate:
   Amusement establishments, including, but not limited to, bowling alleys, pool halls, dance halls, skating rinks.
   Daycare centers and nursery schools.
   Drive-through banking facility.
   Drive-through pharmacy.
   Massage uses.
   Physical culture and services.
   Planned unit developments.
   Public and private utility facilities.

10-6B-4: REQUIRED CONDITIONS:

The following conditions shall be required:

   B.   Consumer Businesses: All business establishments shall be retail or service establishments dealing directly with consumers. All goods produced on the premises shall be sold at retail on the premises where produced.
   C.   Conducting Of Business: All business, servicing or processing, except for off street parking or loading, shall be conducted within completely enclosed buildings. The normal services and sales offered at automobile service stations and eating and drinking establishments and the retail sales of motor vehicles are excluded from this provision. The village board may waive this provision by designating certain days on which business establishments may conduct their businesses outside the building or structure; provided, however, that the sale and storage of seasonal merchandise at retail shall be permitted in accordance with the provisions of section 10-3-23 of this title.
   D.   Outside Storage: All outside storage areas of goods, materials and products are prohibited. Dumpsters and rubbish containers shall be screened in accordance with section 10-3-24 of this title. Lighting of the facilities shall be directed away from the surrounding properties; provided, however, that the sale and storage of seasonal merchandise at retail shall be permitted in accordance with the provisions of section 10-3-23 of this title.
   E.   Compliance: Processes and equipment employed within the B-2 district shall comply with the applicable provisions of chapter 7, article D of this title.
   F.   Screening: Screening by fences or landscaping of at least 75 percent opacity shall be provided within all side and rear yards abutting a residential district. (Ord. 93-695, 6-15-1993)

   E.   Lot Coverage: No more than 85 percent of the lot area may be occupied by principal and accessory buildings and impermeable surfaces combined. At least 15 percent of the remaining lot area shall be open, landscaped area, in which, at minimum, 7 percent of this open, landscaped area shall be provided in the required front yard.
   F.   Signs: In accordance with chapter 10 of this title.

10-6C-1: INTENT:

The B-3 general commercial district is intended to accommodate those retail and wholesale commercial activities which are considered roadside commercial uses and which may be incompatible with the predominantly retail uses permitted in other business districts and whose service area is not confined to any 1 neighborhood. 10-6C-2: PERMITTED USES:

No building, structure or parcel of land shall be used and no building or structure shall be erected, altered or enlarged which is arranged, intended or designed for other than 1 of the following uses:
   Any permitted use in the B-1 and B-2 districts except dwelling units.
   Auction rooms.
   Building and related trades, including, but not limited to, carpenter shops, air conditioning, plumbing and heating shops, wallpaper and paper hanging shops, furniture upholstering and paint shops.
   Clubs, lodges and meeting places for other organizations.
   Electrical showrooms and shops.
   Exterminating shops.
   Greenhouses and nurseries.
   Pawnshops.
   Plumbing showrooms and shops.
   Recording or sound studios.
   Repair, rental or servicing of any article, the sale of which is a permitted use in the district.
   Schools, trade or vocational.
   Taxidermists.
   Tattoo uses.
   Warehouses and storage facilities, but excluding motor freight terminals and miniwarehouses and self-storage facilities.

10-6C-3: CONDITIONAL USES:

The following conditional uses may be permitted in specific situations in accordance with the procedures outlined in section 10-12-4, 10-3-34, and chapter 11 of this title, as appropriate:
   Adult-Use Cannabis Dispensing Organization.
   Any conditional use in the B-1 and B-2 districts, except those that are now permitted uses in the B-3 district.
   Amusement establishments, including, but not limited to, bowling alleys, pool halls, dance halls, electronic game rooms, mechanical amusement arcades and skating rinks.
   Amusement parks, including, but not limited to, permanent carnivals, kiddie parks and other similar outdoor amusements.
   Art studio.
   Automobile fueling stations.
   Building material and products, sales, storage and accessory manufacturing of building components, subject to the following:
      The provisions of this title relating to use, height, bulk, parking, fencing, screening and lighting shall be applicable except as provided for in this section, as follows:
      A. Height of any building or structure shall not exceed 40 feet.
      B. 2 off street parking spaces for each 1,000 square feet net of enclosed sales area shall be provided.
      C. Maximum floor area ratio for all buildings and structures shall be 2.0.
      D. Lighting of the facility shall be directed away from surrounding properties.
      E. Such other conditions as the village board shall find to be necessary to protect the public health, welfare and safety.
   Bus stations.
   Car washes.
   Contractor or construction offices, shops and yards.
   Drive-through facilities including, but not limited to, banks, restaurants, cleaners and drugstores.
   Health and fitness uses, floor area greater than 7,500 SF.
   Instructional uses, floor area greater than 7,500 SF.
   Machinery sales.
   Mobile home sales and rental.
   Model homes and garage displays.
   Physical culture services.
   Printing and publishing establishments.
   Railroad stations.

10-6C-4: REQUIRED CONDITIONS:

The following conditions shall be required:
   A.   Dwelling Units Not Permitted: Dwelling units, other than those located in a hotel or motel or watchmen's quarters located on the premises where employed, shall not be permitted.
   B.   Conducting Of Business: All business, servicing or processing, except for off street parking or loading, shall be conducted within completely enclosed buildings. The normal services and sales offered at automobile service stations and eating and drinking establishments and retail sales of boats, motor vehicles, trailers, campers, mobile homes, model homes and garages are excluded from this provision. The village board may waive this provision by designating certain days on which business establishments may conduct their businesses outside the building or structure; provided, however, that the sale and storage of seasonal merchandise at retail shall be permitted in accordance with the provisions of section 10-3-23 of this title. Dumpsters and rubbish containers shall be screened in accordance with section 10-3-24 of this title. Lighting of the facility shall be directed away from surrounding properties; provided, however, that the sale and storage of seasonal merchandise at retail shall be permitted in accordance with the provisions of section 10-3-23 of this title. 10-6D-1: INTENT:

The B-4 automotive service district is intended to provide certain land and structures for automotive service type use and automobile associated uses such as drive-ins. The district is intended to be located only along major thoroughfares where adequately sized and properly located parcels of land will allow for adequate setbacks, clear vision and safe ingress and egress. Frontage roads should be provided where possible. (Ord. 93-695, 6-15-1993)

10-6D-2: PERMITTED USES:

The building, structure or parcel of land shall be used and no building or structure shall be erected, altered or enlarged which is arranged, intended or designed for other than one of the following uses:
   A.   Generally:
      Automobile accessories stores.
      Automobile fueling stations.
      Automobile repair facility.
      Boat dealers.
      Camper sales.
      Drive-in restaurants.
      Mobile home dealers.
      Motor vehicle dealers.
      Motorcycle sales.
      Tire, battery and accessory dealers.
      Used car lots.
   B.   Personal service establishments, which perform services on the premises, such as:
      Drive-in cleaners.
      General repair shops.
      Undertaking establishments and funeral parlors.
   C.   Business service establishments, which perform services on the premises, such as:
      Automobile diagnostic centers or clinics.
      Automobile driving instruction.
      Automobile rentals.
      Automobile repair shops.
      Automobile undercoating services.
      Equipment rental and leasing services.
      Motorcycle service and repair.
      Repair services.
      Taxicab stands.
      Tire retreading and repair shops.
      Towing services.
   D.   Public, quasi-public and governmental buildings and facilities, as follows:
      Ambulance service.
      Bus passenger stations.
      Public service or municipal garages.
   E.   Residential uses, such as:
      Hotels and/or motels, but not including mobile home parks. (Ord. 93-695, 6-15-1993; amd. Ord. 06-1373, 7-25-2006)

10-6D-3: CONDITIONAL USES:

The following conditional uses may be permitted in specific situations in accordance with the procedures outlined in section 10-12-4, 10-3-34, and chapter 11 of this title, as appropriate:
   Adult-use cannabis craft grower organization (co-location with adult-use cannabis dispensing organization only).
   Adult-use cannabis dispensing organization.
   Adult-use infuser organization (co-location with adult-use cannabis dispensing organization only).
   Art studio.
   Automobile laundries or car washes.
   Drive-in banking facilities.
   Planned unit developments.
   Residence of the proprietor of a commercial use.
   Schools, trade or vocational.

10-6D-4: REQUIRED CONDITIONS:

The following conditions shall be required:
   A.   Performance Standards: All activities shall conform with the performance standards established in chapter 7, article D of this title.
   B.   Outdoor Sales: All outdoor sales space shall be provided with a permanent, durable and dustless surface and shall be graded and drained as to dispose of all surface water. (Ord. 93-695, 6-15-1993)
   C.   Outdoor Storage: All outdoor storage facilities for fuel, raw materials and products shall be enclosed by a fence, wall or plant materials adequate to conceal such facilities from adjacent properties and the public right of way. All outdoor storage shall be placed on a paved surface. (Ord. 05-1307, 8-9-2005)
   D.   Waste Materials: No materials or wastes shall be deposited upon a lot in such a form that they may be transferred off the property by natural causes or forces.
   E.   Lighting: All exposed sources of light shall be shielded wherever necessary to avoid casting direct light that will create a nuisance in a residential district.
   F.   Screening: Where a commercial use abuts or is across the street from a residential district, adequate screening shall be provided. (Ord. 93-695, 6-15-1993)

10-6D-5: SITE AND STRUCTURE REQUIREMENTS:

   C.   Yards: The minimum yards required in the B-4 district shall be as follows:
      1.   Front Yard:
         a.   Generally: A required front yard of not less than 30 feet.
         b.   Through Lots: In cases where the required front yard is greater than the required rear yard, the required front yard setback shall apply.
      2.   Side Yards: On each zoning lot upon which a structure is built, there shall be a required side yard on each side of the main structure of the following:
         a.   Abutting residential districts: An interior side yard of not less than 10 feet and a corner side yard of not less than 30 feet.

10-6E-1: INTENT:

It is the intent of this district to act as a transitional zone between intensive business areas and residential neighborhoods. This district should contain office, residential, institutional and support commercial facilities. (Ord. 93-695, 6-15-1993)

10-6E-2: PERMITTED USES:

No building, structure or parcel of land shall be used and no building or structure shall be erected, altered or enlarged which is arranged, intended or designed for other than 1 of the following uses:
   Animal hospital.
   Banks and financial institutions.
   Civic buildings.
   Cultural institutions.
   Hospitals and sanatoriums.
   Massage uses, when accessory to personal care or heath and fitness uses.
   Nursery schools, preschools and daycare centers.
   Offices - business or professional; medical or dental.
   Parks, playgrounds and forest preserves.
   Religious institutions.
   Schools, K-12.

10-6E-3: CONDITIONAL USES:

The following conditional uses may be permitted in specific situations in accordance with the procedures outlined in section 10-12-4 and chapter 11 of this title, as appropriate:
   Convalescent and nursing homes.
   Dwelling units.
   General retail.
   Health and fitness uses.
   Instructional uses.
   Planned unit developments.
   Public and private utility facilities.
   Schools, college or university.
   Schools, trade or vocational.
   Services, including, but not limited to, personal care, laundries, clothes cleaning and laundry pick up stations, shoe repair, tailor shops, appliance repair shops, electricians' shops and similar stores or shops for the conduct of business. 10-6E-4: REQUIRED CONDITIONS:

The following conditions shall be required:
   A.   Business, Servicing Or Processing: All business, servicing or processing, except off street parking or loading, shall be conducted within completely enclosed buildings. The village board may waive this provision by designating certain days on which business establishments may conduct their businesses outside the building or structure; provided, however, that the sale and storage of seasonal merchandise at retail shall be permitted in accordance with the provisions of section 10-3-23 of this title.    B.   Outside Storage Areas: All outside storage areas of goods, materials, equipment, and other products shall be enclosed with fences or landscaping of at least 75 percent opacity and have a paved surface. Lighting of the facility shall be directed away from surrounding properties; provided, however, that the sale and storage of seasonal merchandise at retail shall be permitted in accordance with the provisions of section 10-3-23 of this title.    C.   Processes And Equipment: Processes and equipment employed within the OCI district shall comply with the applicable provisions of chapter 7, article D of this title.
   D.   Screening: Screening by fences or landscaping of at least 75 percent opacity shall be provided within all side and rear yards abutting residential districts. (Ord. 93-695, 6-15-1993)

10-6E-5: SITE AND STRUCTURE REQUIREMENTS:

   A.   Lot Area: There are no area requirements in the OCI district.
   B.   Lot Width: There are no lot width requirements in the OCI district.
   C.   Yards: The minimum yards required in the OCI district shall be as follows:
      1.   Front Yard:
         a.   Generally: A required front yard of not less than 30 feet.
         b.   Through Lots: In cases where the required front yard is greater than the required rear yard, the required front yard setback shall apply.
      2.   Side Yards: On each zoning lot upon which a structure is built, there shall be a required side yard on each side of the main structure of the following:
         a.   Abutting residential uses: An interior side yard of not less than 10 feet and a corner side yard of not less than 30 feet.
         b.   Abutting nonresidential uses: An interior side yard of not less than 10 feet. A side yard may be reduced to 0 feet between 2 uses that are connected. A corner side yard of not less than 30 feet.
      3.   Rear Yard: On each zoning lot upon which a structure is built, there shall be a required rear yard for each main structure of the following:
         a.   Abutting residential uses: A required rear yard of not less than the established rear yard requirements for the adjoining residential district.
         b.   Abutting nonresidential uses: A required rear yard of not less than 20 feet.
   D.   Bulk Regulations: The maximum floor area ratio for all buildings and structures in the OCI district shall be 2.0.
   E.   Lot Coverage: Not more than 85 percent of the lot area may be occupied by principal and accessory buildings and impermeable surfaces combined. At least 15 percent of the remaining lot area shall be open, landscaped area, in which, at minimum, 7 percent of this open, landscaped area shall be provided in the required front yard.
   F.   Signs: In accordance with chapter 10 of this title.
