CHAPTER 8

OFF-STREET PARKING AND LOADING

10-8-1: PURPOSE:

The purpose of this Chapter is to increase safety and lessen congestion in the public streets, to adequately provide for parking needs associated with the development of land and increased automobile usage, to set standards for the requirements of off-street parking and loading facilities according to the amount of traffic generated by each use and to eliminate the on-street storage of vehicles along major traffic routes. 10-8-2: GENERAL PARKING AND LOADING PROVISIONS:

   A.   Scope: The following provisions shall apply to off-street parking and loading:
      1.   For all buildings and structures erected and all uses of land established after the effective date hereof, accessory parking and loading facilities shall be provided as required by the regulations of the district in which such buildings or uses are located. However, where a building permit has been issued prior to the effective date hereof; and provided, that construction is started within one year of such effective date and diligently prosecuted to completion, parking and loading facilities as required herein need not be provided.
      2.   When the intensity of use of any building, structure or premises shall be increased through addition of dwelling units, gross floor area, seating capacity or other unit of measurement specified herein for required parking or loading facilities, parking and loading facilities as required herein shall be provided for such increase in intensity of use. However, no building or structure lawfully erected or use lawfully established prior to the effective date hereof shall be required to provide such additional parking or loading facilities, unless and until the aggregate increase in units of measurement shall equal not less than fifteen percent (15%) of the units of measurement existing upon the effective date hereof, in which event, parking and loading facilities as required herein shall be provided for the total increase.
      3.   Whenever the existing use of a building or structure shall hereafter be changed to a new use, parking and loading facilities shall be provided as required for such new use. However, if the said building or structure was erected prior to the effective date hereof, additional parking and loading facilities are mandatory only in the amount by which the requirements for the new use would exceed those for the existing use if the latter were subject to the parking and loading provisions of this Title.
   B.   Existing Parking and Loading Facilities: Accessory off-street parking or loading facilities which are located on the same lot as the building or use served and which were in existence on the effective date hereof or were provided voluntarily after such effective date shall not hereafter be reduced below, or if already less than, shall not herefurther be reduced below the requirements of this Title for a similar new building or use.
   C.   Permissive Parking and Loading Facilities: Nothing herein shall be deemed to prevent the voluntary establishment of off-street parking or loading facilities to serve any existing use of land or buildings; provided, that all regulations herein governing the location, design, improvements and operation of such facilities are adhered to.
   D.   Damage or Destruction: For any conforming or legally nonconforming building or use which is in existence on the effective date hereof, which is subsequently damaged or destroyed by fire, explosion or other causes and which is reconstructed or repaired, off-street parking or loading facilities need not be provided; except, that parking or loading facilities equivalent to any maintained at the time of such damage or destruction shall be restored or continued in operation. However, in no case shall it be necessary to restore or maintain parking or loading facilities in excess of those required by this Title for equivalent new uses or construction.
   E.   Control of Off-Site Parking Facilities: When required parking facilities are provided on land other than the zoning lot on which the building or use served by such facilities is located, they shall be and remain in the same possession or ownership as the zoning lot occupied by the building or use to which the parking facilities are accessory. Such off-site parking facilities shall not be authorized and an occupancy permit shall not be issued unless the Zoning Board determines that the common ownership or possession of the zoning lot and the site of the parking facilities are reasonably certain to continue and that the off-site parking facilities will be maintained at all times during the life of the proposed use or building.
   F.   Drainage of Paved Driveways and Parking Lots:
      1.   Whenever a driveway or parking lot is constructed and paved with concrete, asphalt, gravel or any other hard or bituminous surface, the person constructing said driveway or parking lot shall construct the area in such a manner that it affords adequate drainage of water away from the area toward either a Village storm sewer or curb and gutter or to another area specially designated and constructed to receive runoff.
      2.   Supervision of said driveways or parking lots to insure that they are constructed with proper drainage control and setback requirements shall be the responsibility of the village zoning officer, and no such driveway or parking lot shall be constructed or approved by the zoning officer until he has determined, in his discretion, that they are so properly constructed.
      3.   No driveway shall be less than five feet (5') from an interior lot line, measured from edge of driveway to the lot line at the closest point.
      4.   No driveway constructed upon a corner lot shall be closer than thirty feet (30') from the intersection of the right of way line and five feet (5') from any adjoining lot line.
      5.   A driveway constructed upon a cul-de-sac lot must maintain a minimum three foot (3') clearance from any adjoining lot line, measured from edge of driveway to the lot line at the closest point. If a hardship should arise whereby a three foot (3') clearance would be impossible to achieve, the zoning officer, after consulting with the village administrator, may vary the three foot (3') requirement.
   G.   Submission Of Plot Plans: Any application for a building permit or for a certificate of occupancy where no building permit is required shall include therewith a plot plan, drawn to scale and fully dimensioned, showing any parking or loading facilities to be provided in compliance herewith. 10-8-3: ADDITIONAL PARKING REGULATIONS:

   A.   Use Of Parking Facilities:
      1.   Off street parking facilities accessory to residential use and developed in any residential district in accordance with the requirements herein shall be used solely for the parking of passenger automobiles owned by occupants of the dwelling structures to which such facilities are accessory or by guests of said occupants. Under no circumstances shall required parking facilities accessory to residential structures be used for the storage of commercial vehicles or for the parking of automobiles belonging to the employees, owners, tenants, visitors or customers of a business or manufacturing establishment.
      2.   The parking area shall not be used for the repair, dismantling or servicing of any vehicles, equipment, materials or supplies.
   B.   Collective And Joint Parking Facilities: Separate off street parking space shall be provided for each use or the parking space required of two (2) or more uses located on the same zoning lot may be combined and used jointly; provided, however:
      1.   Collective Parking Facilities: Off street parking facilities for separate uses may be provided collectively, if the total number of spaces so provided is not less than the sum of the separate requirements for each such use, and provided that all regulations governing location of parking spaces, in relation to the use served, are observed. Further, no parking space or portion thereof shall serve as the required space for more than one use unless authorized by the planning and zoning commission.
      2.   Joint Use Parking Facilities: If groups of buildings contain uses which vary in their parking requirements, the number of parking spaces required shall be the sum of the individual requirements of each use. However, where peak parking requirements occur at distinctly different times of the day or at different times of the week, as determined by the village board, pursuant to the recommendation of the plan and zoning commission, joint parking facilities may be shared by two (2) or more uses if so authorized.
   C.   Parking In Yard:
      1.   Front Yards:
         a.   In the E-2, E-1, R-1-A, R-1, R-3, R-3-A, R-4 and R-5 zoning districts, no vehicle shall be parked in any front yard, except upon a driveway which is normally incidental to a single-family residence or other allowed use, and then only if authorized by the building and subdivision codes of the village 1 .          b.   In the B-1, B-2, B-3, B-4, OCI, ORI, I-2 and I-3 zoning districts, parking for passenger vehicles shall be permitted in the front yard but only if set back from all property lines by a ten foot (10') landscaped area, approved through the site plan review process, and improved with a village approved hard surface in accordance with the respective district's requirements.
      2.   Side Or Rear Yards: Parking may be located in the required side or rear yards of any zoning district; provided, that a five foot (5') landscaped area be used to separate the parking area from the lot line in all zoning districts except for classifications where single-family detached residences are allowed. In zoning districts where single-family detached residences are allowed, parking may be located in any required side or rear yard. In the business and industrial zoning districts, parking shall be approved through the site plan review process and improved with a village approved hard surface in accordance with the respective district's requirements.       3.   Adjacent To A Residential District:
         a.   In any district, on any lot devoted to other than single-family use, if any front lot line, side lot line or rear lot line separates the lots from or is across the street or alley from a lot in a residential district, the off street parking shall not be located closer to such lot line than the minimum front yard depth, side yard depth, side yard width or rear yard depth (as the case may be) prescribed by the district in which the off street parking area is located. In no case, however, shall this distance be less than twenty feet (20').
         b.   Further, all off street parking areas containing more than four (4) spaces shall be effectively screened on each side adjoining or fronting on any property situated in any residence district by a wall, fence or densely planted, compact hedge not less than five feet (5') nor more than seven feet (7') in height.       4.   Class J And Higher Vehicles 2 :
         a.   No vehicle, as defined by the Illinois vehicle code 3 , registered for an excess of twenty six thousand (26,000) pounds (class J and higher) may be parked on any lot in any residential (E-2, E-1, R-1-A, R-1, R-3, R-3-A, R-4, or R-5) zoned district, except for school buses during school hours on school days.    D.   Accessory Off Street Parking Facilities: The location of off street parking spaces in relation to the use served shall be as prescribed hereinafter. All distances specified shall be within walking distances between such parking spaces and a main entrance to the use served.
      1.   Residential District Uses: Parking spaces accessory to dwellings shall be located on the same zoning lot as the use served. Spaces accessory to uses other than dwellings may be located on a lot adjacent to, or directly across a street or alley from, the lot occupied by the use served, but in no case at a distance in excess of three hundred feet (300') from such use.
      2.   Maximum Number of Spaces: The total number of accessory parking spaces provided for single-family, two-family or multiple-family dwellings shall not exceed that required herein for such use or any equivalent new use by more than fifty percent (50%) or four (4) spaces, whichever is greater.
      3.   Business, Office and Manufacturing Uses: All required parking spaces shall be within one thousand feet (1,000') of the use served, except for spaces accessory to dwelling units which shall be within three hundred feet (300') of use served.
      4.   Floor Area Exemptions: When two (2) or more uses are located on the same zoning lot, only one exemption in terms of floor area shall be taken.
   E.   Units of Measurement: For purposes of this Chapter the following units of measurement shall apply:
      1.   Definitions: The following definitions shall apply:
   DWELLING UNIT: A room or group of rooms providing living quarters for a family or household.
   FLOOR AREA: In the case of offices, merchandising or service type of uses, "floor area" shall mean the gross floor area used or intended to be used by tenants and/or owners for service to the public as customers, patrons, clients and patients, including areas occupied by fixtures and equipment used for display or sale of merchandise. It shall not include areas used principally for nonpublic purposes such as storage, incidental repair, processing or packaging of merchandise, for show windows, for offices incidental to the management or maintenance of stores or buildings, for toilet or rest rooms, for utilities or for dressing rooms, fitting or alteration rooms.
   SEAT or BENCH: A "seat" shall be the space intended for one individual; in a place where patrons or spectators occupy benches, pews or other seating facilities, each twenty inches (20") of seating facilities shall be counted as one seat.
      2.   Employees: Parking spaces required on an employee basis shall be based on the maximum number of employees on the premises at any one time whether on duty or residing therein.
      3.   Fractions: When units of measurement result in the requirement of a fractional space, any fraction shall required one parking space.
   F.   Design and Development:
      1.   Parking Configurations 4 : Each off-street parking space and area shall be designated in accord with and have an area of not less than that required by the following table. Angle parking of a type not specified below is not permitted:

Each parking space shall have a vertical clearance of at least seven feet (7') and shall be of usable shape and condition.
      2.   Design and Development: Every parcel of land hereafter used as a public or private parking area greater than four (4) spaces, including a commercial parking lot and an automobile sales lot, shall be designed, developed and maintained in accordance with the following requirements:
         a.   Surfacing: All open off-street parking areas shall be improved with a compacted macadam base, not less than six inches (6") thick, surfaced with asphalt or concrete as specified by the Zoning Officer.
         b.   Screening and Landscaping: All open automobile parking areas shall be effectively screened on each side adjoining or fronting on any property situated on a residential district or any institutional premises by a wall, fence or densely planted compact hedge not less than five feet (5') nor more than seven feet (7') in height.
         c.   Lighting: Lighting facilities, if required, shall be so arranged and operated so that they neither unreasonably disturb occupants of adjacent properties nor interfere with traffic. All lighting used to illuminate off-street parking areas in residential districts shall be shaded so that no direct light is cast upon any property within the district.
         d.   Curbing And Parking: The plan commission may require that parking areas be equipped with curbs, wheel guards or bumper guards located along all exterior parking lot lines in such a manner so as to prohibit protrusion of any portion of a parked vehicle beyond established parking areas.
         e.   Entrance And Exit Points:
            (1)   Each required off-street parking space shall be open directly upon an aisle or driveway of such width and design as to provide safe and efficient means of vehicular access to such parking space. All off-street parking facilities shall be designed with appropriate means of vehicular access to a street or alley in a manner which will least interfere with traffic movements. No driveway across public property nor curb cut shall exceed a width of thirty feet (30').
            (2)   The parking area shall be provided with entrances and exits each of which shall not be less than twelve feet (12') in width nor more than thirty feet (30') in width, excluding any lane control island or other such device as may be commonly used to separate traffic.
         f.   Signs: Accessory signs are permitted on parking areas. (Ord. 93-695, 6-15-1993)

10-8-4: SCHEDULE OF PARKING REQUIREMENTS:

Off-street parking spaces shall be provided in accordance with minimum requirements as hereinafter set forth:

10-8-5: ADDITIONAL LOADING REGULATIONS:

Off street loading space shall be required and maintained in connection with any building or part thereof hereafter erected or altered which is to be occupied by uses requiring the receipt or distribution of materials or merchandise.
   A.   Use Of Loading Space: Off street loading shall not be used for the sale, repair, dismantling or servicing of any vehicles, equipment, materials or supplies, if such loading facilities are within five hundred feet (500') of a residential or business district.
   B.   Location:
      1.   Off street loading space shall be located on the same lot as the structure for which it is provided.
      2.   No permitted or required loading berth shall be located within twenty five feet (25') of the nearest point of intersection of any two (2) streets.
      3.   Off street loading space may occupy all or any part of any required yard space other than the front yard or side yard adjoining a street. The village board may authorize off street loading in front or side yards adjoining a street, if such authorization would not result in traffic hazards.
   C.   Landscaping: Off street loading spaces that adjoin or are across the street from property zoned for any residential use shall have a dense evergreen planting, fence, masonry wall or such other screening as may be determined by the village board. The village board shall also determine the height, location and density of the screening used to provide adequate protection to adjoining property. In making its determination, the village board shall consider the recommendation of the plan commission.
   D.   Design, Development And Maintenance: Every parcel of land hereafter used for off street loading space shall be designed, developed and maintained in accordance with the following requirements:
      1.   Surfacing: All off street loading berths shall be improved with a compacted macadam base, not less than seven inches (7") thick, surfaced with not less than two inches (2") of asphalt or five inches (5") of concrete.
      2.   Access And Maneuvering: Off street loading shall be provided with entrances and exits, each of which shall not be less than twelve feet (12') in width nor more than thirty six feet (36') in width, excluding any lane control island or other such device as may be commonly used to separate traffic, and shall be so designed as to provide adequate vehicular access and maneuvering space in a manner which does not unduly interfere with safe vehicular traffic movement.
      3.   Size: Unless otherwise specified, a required off street loading berth shall be at least twelve feet (12') in width by at least thirty feet (30') in length, exclusive of aisle and maneuvering space, and shall have a vertical clearance of at least fifteen feet (15').
      4.   Projections Of Vehicles Into Public Ways: No portion of a vehicle shall project into a street, alley or other public right of way while being loaded or unloaded.
      5.   Use Of Parking Spaces For Loading Requirements: Space allocated to any off street loading berth shall not, while so allocated, be used to satisfy the space requirements for any off street parking facilities or portions thereof.
      6.   Central Loading Facilities: Central loading facilities may be substituted for loading berths on the individual zoning lots, providing the following conditions are fulfilled:
         a.   Each zoning lot served shall have direct access to the central loading area without crossing streets or alleys at grade.
         b.   Total off-street loading berths provided shall meet the minimum requirements herein specified, based on the sum of several types of uses served. (Area of types of uses may be totaled before computing number of loading berths.)
         c.   No zoning lot served shall be more than five hundred feet (500') removed from the central loading area.
         d.   The tunnel or ramp connecting the central loading area with the zoning lot served shall not be less than seven feet (7') in width and have a clearance of not less than seven feet (7').
      7.   Below Minimum Required Facilities: Uses for which off-street loading facilities are required herein but which are located in buildings of less floor area than the minimum prescribed for such required facilities shall be provided with adequate receiving facilities, alley, service drive or open space serving that zoning lot. 10-8-6: SCHEDULE OF LOADING REQUIREMENTS:

At least the following amounts of off-street loading spaces shall be provided, plus an area or means adequate for maneuvering, ingress or egress:
A.
Residential Uses:
 
Multiple-family dwellings
1 off-street loading berth for all buildings containing 10,000 to 200,000 square feet of floor area, plus 1 additional loading berth for each additional 200,000 square feet of floor area thereof. Each such loading berth for buildings in excess of 100,000 square feet of floor area shall not be less than 12 feet in width by 65 feet in length.
B.
Commercial and Service Uses:

1 loading berth for buildings containing 8,000 to 100,000 square feet of floor area, plus 1 additional loading berth for each additional 100,000 square feet of floor area or fraction thereof.

1 loading berth for buildings containing 10,000 to 100,000 square feet of floor area, plus 1 additional loading berth for each additional 100,000 square feet of floor area or fraction thereof. Each such loading berth for buildings in excess of 100,000 square feet of floor area shall not be less than 12 feet in width by 65 feet in length.
 
Radio and television broadcast stations
1 loading berth for buildings containing 10,000 to 150,000 square feet of floor area, plus 1 additional loading berth for each additional 150,000 square feet of floor area or fraction thereof. Each such loading berth for buildings in excess of 20,000 square feet of floor area shall not be less than 12 feet in width by 65 feet in length.
 
Schools; business colleges and commercial trade
Theaters, indoor
1 loading berth for buildings containing 10,000 to 200,000 square feet of floor area, plus 1 additional loading berth for each additional 200,000 square feet of floor are or fraction thereof. Each such loading berth for buildings in excess of 100,000 square feet of floor area shall not be less than 12 feet in width by 65 feet in length.
 
Catalog sales and mail order establishments
Printing and publishing services
1 loading berth for buildings containing 5,000 to 40,000 square feet of floor area. For buildings containing 40,000 to 100,000 square feet of floor area 2 loading berths, plus 1 additional loading berth for each additional 100,000 square feet of floor area or fraction thereof. Each such loading berth for buildings in excess of 10,0000 square feet of floor area shall be not less than 12 feet in width by 65 feet in length.
 
Financial institutions; banks and savings and loan associations
1 loading berth for buildings containing 10,000 to 100,000 square feet of floor area. For each additional 100,000 square fee of floor area up to 500,000 square feet, 1 additional loading berth, plus 1 additional loading berth for each additional 500,000 square feet of floor area or fraction thereof in excess of 500,000 square feet. Each such loading berth for buildings in excess of 100,000 square feet of floor area shall not be less than 12 feet in width by 65 feet in length.
 
Motor vehicle and machinery sales
Retail stores (unless specified)

1 loading berth for buildings containing 10,000 to 100,000 square feet of floor area, plus 1 additional loading berth for each additional 100,000 square feet of floor area or fraction thereof. Each such loading berth for buildings in excess of 20,000 square feet of floor area shall not be less than 12 feet in width by 65 feet in length.
 
Banquet halls
Convention and exhibition centers
1 loading berth for buildings containing 10,000 to 150,000 square feet of floor area, plus 1 additional loading berth for each additional 150,000 square feet of floor area or fraction thereof. Each such loading berth for buildings in excess of 20,000 square feet of floor area shall be not less than 12 feet in width by 65 feet in length.
 
Community and/or recreational centers
1 loading berth for buildings containing 10,000 to 100,000 square feet of floor area. For each additional 100,000 square feet of floor area up to 500,000 square feet, 1 additional loading berth, plus 1 additional loading berth for each additional 500,000 square feet of floor area or fraction thereof in excess of 500,000 square feet. Each such loading berth for buildings in excess of 20,000 square feet of floor area shall not be less than 12 feet in width by 65 feet in length.
F.
Planned Unit Developments: Loading berths shall be provided on the basis of the required berths for each individual use.
G.
Other Uses: For all other uses, loading facilities shall be provided in accordance with the following schedule:

For each additional 200,000 square feet of floor area over 250,000 square feet of floor area, 1 additional loading berth, not less than 12 feet in width by 65 feet in length, shall be provided.
 
The Village Board may authorize a modification, reduction or waiver of the foregoing requirements, if it should find that, in the particular case appealed, the peculiar nature of the business, trade, industry or other use, or the exceptional situation or condition would justify such action. Prior to authorizing modification to these off-street loading requirements, the Village Board shall consider the recommendation of the Plan Commission. (Ord. 93-695, 6-15-93)
