Sec. 118-31.- General.

(a)

Scope. Unless other otherwise expressly stated, the following words and terms shall, for the purpose of this chapter, have the meaning shown in this chapter.

(b)

Interchangeability. Words used in the present tense include the future; words stated in the masculine gender include the feminine and the neuter; the singular number includes the plural and the plural, the singular.

(c)

Terms defined in other codes. Where terms are not defined in this code and are defined in the International Building Code or the International Mechanical Code, as amended, such terms shall have the meanings ascribed to them as in those codes.

(d)

Terms not defined. Where terms are not defined though the methods authorized by this section, such terms shall have ordinarily accepted meaning such as the context implies.

Sec. 118-32. - General definitions.

The following words, terms and phrases, when used in this chapter, shall have the meanings ascribed to them in this section, except where the context clearly indicates a different meaning:

Abut and abutting mean in actual contact at 1 point along the property line or district line.

Accessory building or structure means a detached building or a structure on the same lot and of a nature customarily incidental to the principal building or structure, the use of which is clearly incidental and subordinate to that of the dominant use of the principal building.

Accessory use. An accessory use is one which is incidental to and on the same lot as the principal use of the land or buildings.

Adjacent means to lie near or close to.

Adult use means any permitted or special use, which by the intent of civil and/or criminal statutes excludes access by minors to the establishment or to any part of the establishment or to any part of the establishment which would otherwise be open to the general public, except those listed as permitted uses.

Agricultural research and education means the use of land primarily for urban agricultural research and public education, including: a) the growing, harvesting, processing, storing, and sales of crops including fresh and dried herbs, fruits, vegetables, non-food ornamental plants, and compost; b) associated buildings and structures for agricultural product and machinery storage, production, and sales; c) associated classrooms, research labs, and office space; and d) wind energy and other alternative energy production facilities.

Alcoholic beverage production means specific food and beverage manufacturing facility that brews, distills, or vints alcoholic beverages.

Alley means any public right-of-way, with a width of not less than 16 feet and not more than 24 feet, which affords a secondary means of vehicular access to abutting properties. A street shall not be considered an alley.

Alteration means any change, addition, or modification in construction, occupancy, or use.

Amusement device means any mechanical, electronic and/or computer game machine and/or player-operated device available for the amusement of the general public. Such machines may be operated by the insertion of a coin, token or similar object. This definition shall not be construed to include coin-operated vending machines which merely dispense cigarettes, candy, gum, soft drinks, other food products, toys or other products.

Animal shelter means any place of business designated to provide for the kenneling of common household pets for the purpose of finding a permanent adoptive home for them. Pet supplies sales and pet services as well as educational, training, and fundraising activities are allowed in conjunction with the use.

Antenna means an apparatus, external to or attached to the exterior of a building, together with any supporting structure, for sending or receiving electromagnetic waves.

Antique and thrift shop means an establishment that primarily retails a general line of used goods.

Arterial means any regional arterial or village arterial as depicted or identified in the Comprehensive Plan.

Assisted-living facility means a facility that provides sleeping accommodations for at least 3 unrelated persons, at least 80 percent of whom are 55 years of age or older, in need of assistance with the activities of daily living, including personal, supportive, and intermittent health-related services available 24 hours a day, if needed, to meet the scheduled or unscheduled needs of a resident.

Auction house means an ongoing business conducted in an auction room (house, gallery or barn, etc.) where auction sales are conducted on a more or less regular basis throughout the year. Nonrecurring auctions, i.e., those not to be held more often than 1 time in 12 months, are subject to the licensing provisions of this Code.

Automated teller machine (ATM) means an electronic information device as defined in the Illinois Automated Teller Machine Security Act, 205 ILCS 695/1 et seq.

Automotive fuel station means any portion of property where flammable or combustible liquids or gases are dispensed for retail sale from fixed equipment into motor vehicles.

Automotive repair facility means an establishment that commercially repairs, services, adjusts, paints, or equips automobiles or other motor vehicles.

Bar and drinking place mean an establishment, also known as a bar, tavern, nightclub, or drinking place, that primarily prepares and serves alcoholic beverages for immediate consumption. These establishments may also provide limited food and entertainment (primarily music) services.

Basement means any story more than 50 percent below grade.

Beer, wine, and liquor store means an establishment that primarily retails packaged alcoholic beverages, such as ale, beer, wine, and liquor.

Block means a tract of land bounded by streets or by a combination of streets and public parks, cemeteries, railroad rights-of-way or other lines of demarcation. A block may be located in part beyond the boundary lines of the corporate limits of the Village.

Boat means a device used or capable of being used for navigation on water.

Boat trailer means a vehicle without motive power that is drawn by a motor vehicle, designed for carrying a boat, and constructed so that no part of its weight rests upon the towing vehicle.

Brew pub means an establishment that includes a microbrewery, microdistillery, or micro-winery in conjunction with a restaurant and a bar or drinking place.

Building means any structure having a roof supported by walls designed or built for the support, enclosure, shelter or protection of persons, animals, or property of any kind, and which is permanently affixed to the land.

Building, accessory. See Accessory building.

Building, completely enclosed, means a building separated on all sides from the adjacent open space, or from other buildings or structures, by a permanent roof and by exterior walls or party walls, pierced only by windows and normal entrance and exit doors.

Building, principal, means a nonaccessory building in which is conducted the principal use of the lot.

Building, temporary, means any building not designed to be permanently located at the place where it is or where it is intended to be temporarily placed or affixed.

Building height means the vertical distance above the lesser of the crown of the street or the top of the curb to the top of the roof, excluding steeples, church belfries, spires, chimneys, smokestacks, cooling towers and elevator bulkheads, parapet walls and building equipment penthouses only when such structures have a floor area less than ⅓ of the floor area of a typical floor. When a building is on a lot that faces on more than 1 street, the height shall be measured from the lesser of the average of the crowns of both streets or the average of the middle points of the top of the curbs to the top of the roof.

Business means an occupation, employment or enterprise which occupies time, attention, labor and materials, or wherein merchandise is exhibited or sold, or where services are offered.

Business support services means an establishment that provides any of the following: document preparation, mailing (except direct mail advertising), court reporting, stenotyping, or copying centers, which may provide photocopying, duplicating, blueprinting, or other copying services besides printing. They may provide a range of support activities, including mailing services, document copying, facsimiles, word processing, on-site PC rental, and office product sales. Electronic answering services, collections, or telemarketing as defined in this section shall not be considered business support services.

Cannabis dispensary means a facility operated by an organization or business that is registered by the Illinois Department of Financial and Professional Regulation or successor to acquire cannabis from a cultivation center, craft grower, processing organization, or another dispensary for the purpose of selling or dispensing cannabis, cannabis-infused products, cannabis seeds, paraphernalia, or related supplies and educational materials to purchasers or to qualified medical cannabis patients and caregivers, including a registered medical cannabis organization as defined in the Compassionate Use of Medical Cannabis Pilot Program Act or its successor Act that has obtained an Early Approval Adult Use Dispensing Organization License.

Car dealer means an establishment retailing automobiles and light trucks, motorcycles, sport utility vehicles, and passenger and cargo vans, including replacement parts and accessories.

Car wash means a facility, apparatus, or structure designed and used for the washing of motor vehicles.

Carport means a roofed automobile shelter with 2 or more open sides. Enclosed storage facilities may be provided as part of a carport.

Caterer means a single event-based food service that transports food via equipment and vehicles to events or prepares food at an off-premise site. Banquet halls with catering staff are not included in this subcategory.

Cemetery means sites or structures operated and reserved for the internment of human or animal remains and may include cremation services.

Child and youth services means an establishment that offers services such as adoption, foster care, drug prevention services, and life-skills training but does not provide residence or accommodation.

Child day care means an establishment primarily for the care of infants and preschool children that may offer prekindergarten education programs or care services for older children.

Cigarette and tobacco sales means the sale of cigarette and tobacco products within a grocery, pharmacy, liquor, or convenience store, limited to no greater than 20% or 100 linear feet of shelf space or display area, whichever is less, within the store, and in adherence to Chapter 26, Article VI of the Skokie Village Code. Cigarette and tobacco sales establishments are not permitted as a primary use.

Clinics and outpatient care centers means establishments that include physician offices, dentists, chiropractors, optometrists, therapists, treatment centers, or other similar health care professionals and services or that have several practitioners with different specializations practicing within the same establishment, without facilities for overnight lodging.

Club and lodge mean an association of persons, the facilities of which are restricted to members and their guests. Food and alcoholic beverages may be served on its premises, provided they are secondary and incidental to the promotion of some other common objective.

Collector's items shop means an establishment that specializes in the sale and resale of specialty merchandise such as autographs, cards, coins, stamps, and other similar goods.

Colleges and universities means junior colleges, colleges, universities, seminaries, and professional schools that furnish academic or technical courses and grant degrees, certificates, or diplomas at the associate, baccalaureate, or graduate levels, and other related uses except dormitories, which must be specifically listed as an accessory use in the district. The requirement for admission is at least a high school diploma or equivalent general academic training.

Commercial trailer means a commercial vehicle without motive power that is drawn by a motor vehicle, designed for carrying persons or property, and constructed so that no part of its weight rests upon the towing vehicle.

Commercial vehicle means a vehicle operated for the transportation of persons or property in the furtherance of any commercial or industrial enterprise, not including commuter vans, vehicles used for the purpose of ride-sharing arrangements, or noncommercially used recreational vehicles.

Community food services means establishments that collect, prepare, and deliver food for the needy. They may also distribute clothing and bedding, run collections for food and donations, or provide meals at fixed or mobile locations. Examples are food banks, meal delivery programs, and soup kitchens.

Computer services establishment means an establishment providing on-site use of personal computers for internet, e-mail, and other software access. Printing and copying services may also be provided. Computer services establishments may be operated in conjunction with other permitted uses.

Congregate living facility means any living facility or residential unit primarily for unrelated elderly or disabled persons. Paid professional support staff provided by a sponsoring agency living with the residents on a 24-hour basis or available in accordance with the particular needs of the residents may also be present. A facility shall have common kitchen, dining, and entertainment areas for the purpose of assisting the residents to return to or to maintain a semi-independent life style. In addition to providing shelter, services shall include access to but not be limited to meals, medical, housekeeping, laundry, social, recreational, educational, protective, and transportation.

Construction and demolition debris recycling and disposal facility means an establishment that operates facilities for separating and sorting recyclable materials from construction and demolition debris from non-hazardous waste streams.

Construction material sales center means any retail or wholesale establishment that sells building materials, hardware, landscaping and other materials and supplies necessary for the improvement of property. Asphalt and concrete ready-mix plants are specifically excluded from this definition.

Convenience store means an establishment or food mart (except those with fuel pumps) that primarily retails a limited line of goods that generally includes milk, bread, soda, and snacks or similar convenience items.

Conventional warehouse means a building or portion of a building in which goods, merchandise, or equipment is stored for eventual distribution.

Co-working Office means a facilitated environment which may contain desks or other workspaces and facilities and is used by a recognized membership who share the site. Rules for membership and participation in the coworking space are explicit, transparent and are available to the public. Coworking spaces may host classes or networking events which are open either to the public or to current and prospective members. Fabrication tools are limited to those which do not generate noise or pollutants in excess of what is customary within a typical office environment.

Day care center for adults means a program of services provided for functionally-impaired adults who do not require 24-hour institutional care, and yet who are in need of an adult day care program directed toward maintaining physical and mental health, and should be a structured, comprehensive program providing a variety of health, social, and related support services in a protective setting for a period of time less than 24 hours. A skilled nursing facility shall not be considered as an adult day care center.

Demonstration project is the redevelopment of a site for allowable uses in a district designed to stimulate redevelopment and economic growth in the area. The subject site must be in a designated redevelopment district. The proposed project must be designed to fulfill the goals of the redevelopment district. In order to stimulate development, relief may be granted in the area of district development standards and other Zoning Chapter regulations.

Director of Community Development means the official of the Village who has been duly appointed by the Village Manager as the Director of the Community Development Department.

Director of Engineering means the official of the Village who has been duly appointed by the Village Manager as the Director of Engineering of the Village.

Director of Public Works means the official of the Village who has been duly appointed by the Village Manager as the Director of the Department of Public Works.

District means a portion of the corporate area of the Village within which certain uniform regulations and requirements, or various combinations thereof, apply under the provisions of this chapter. For the purpose of this chapter, a zoning district shall be an area into which the Village has been divided for zoning regulations and requirements.

Dog run means any area set aside, intended, or utilized primarily as an area for the defecation by and/or penning of dog(s).

Dormitory means a rooming or boarding establishment that serves a specific group or membership, provides temporary accommodations, and may offer housekeeping, meals, and laundry services. A congregate living facility shall not be considered a dormitory.

Dry cleaning and laundry establishment means a business that provides pickup and/or delivery dry cleaning and/or laundry service, with less than 3,500 ft 2 used for activities that would occur in a dry cleaning and laundry plant. The dry cleaning or laundering may be done on-site, excluding self-service.

Dry cleaning and laundry plant means a building or portion thereof used for the cleaning, drying, and pressing of clothing and fabrics.

Efficiency unit means a residential unit consisting of 1 principal room, exclusive of bathroom, kitchen, hallway, closets or dining alcove directly off the principal room, providing that such dining alcove does not exceed 90 ft 2 in area.

Elderly and disabled housing means a use that is limited to occupancy by persons qualifying under 1 or more of the following categories:

(1)

Persons who are 62 years of age or older.

(2)

Persons who are certified by a physician as being physically disabled.

(3)

Spouses of persons at least 62 years of age or certified by a physician as being physically disabled.

(4)

Persons under the age of 62 or not certified to be physically handicapped who are offspring, dependents, or relatives by blood or marriage to an otherwise qualified occupant, if a physician certifies that the qualified occupant is essential for their care.

(5)

A person who is determined by a physician to be essential for the care of an otherwise qualified occupant.

Electric vehicle charging station means a place where a vehicle may be parked to transfer electric energy to a battery or other energy storage device within that vehicle and any equipment necessary to transfer that energy.

Electronic answering services, collections, or telemarketing means a use where at least 20 percent of the floor area is devoted to a business conducted primarily by telephone or electronic means, not limited to solicitation of sales directly to customers, collection of bills, or answering of telephones or other electronic messages.

Facilities support services means an establishment that provides operating staff for support services within a client's facilities. They typically provide a combination of services, such as janitorial, maintenance, litter and trash disposal, security, mail reception, and laundry services. They provide operating staff to carry out these support activities, but are not involved with the core activities of the client.

Fence means a structure which is a barrier and used as a boundary or means of protection or confinement.

Firearm range means any establishment where the discharging of a firearm, as defined in the Firearm Owners Identification Card Act, 430 ILCS 65/1.1, is allowed for a sporting event or for practice, instruction, testing, or training in the use of a firearm and may also include rental of a firearm for allowable uses within the establishment and a firearm seller.

Firearm seller means any establishment or entity that engages in the sale or purchase of any firearm or firearm ammunition, as defined in the Firearm Owners Identification Card Act, 430 ILCS 65/1.1.

Floor area, gross means the sum of the gross horizontal area of all floors, 50% above grade or more, and roofed areas. The horizontal area shall be measured from either the exterior faces of the exterior walls or the exterior faces of the posts or ground supporting members if the roofed area is not supported by a wall. Any floor or roofed area with a floor to ceiling height of 16 feet in height shall be counted as 2 floors. Each 8-foot increase in the floor to ceiling height, greater than 16 feet, shall be counted as an additional floor. Any attic area with a height of 6 foot 9 inches or greater, measured from the top of the top plate to the top of the roof, shall be counted as gross floor area.

Floor area, ground means the lot area covered by a principal building, measured at grade, from the exterior faces of the exterior walls, excluding open porches or terraces, garages or carports.

Floor area, net (for determining off-street parking and loading requirements). "Floor area," when prescribed as the basis of measurement for off-street parking and loading spaces for any use, shall be the sum of the gross horizontal area of the basement, and all other floors, excluding hallways, stairways, elevator shafts, boiler and air conditioning equipment rooms, or areas used for off-street parking facilities. All horizontal dimensions shall be taken from the exterior faces of the exterior walls, or from the centerlines of walls separating 2 buildings.

Floor area ratio (FAR) means the gross floor area of a building(s) in relation to lot area, as determined by dividing the gross floor area of all buildings and/or structures on a lot by the lot area.

Fruit and vegetable store means an establishment that primarily retails fresh fruits and vegetables.

Funeral homes and services means an establishment that prepares the dead for burial or internment and conducts funerals (i.e. providing facilities including chapels for wakes, arranging transportation for the dead, selling caskets and related merchandise) and may provide cremation services.

Games arcade means an establishment in which 4 or more amusement machines are available for operation for the amusement of the general public, but does not include gambling, billiards, or pool.

Golf course means an area of land, with at least nine holes, improved with tees, greens, fairways, and hazards for playing golf as well as other related services or amenities such as swimming, outdoor recreation, limited retail, and restaurants.

Grade means the highest level of the finished surface of the ground adjacent to the exterior walls of the building or structure.

Grocery store, supermarket, or bakery means an establishment that retails a general line of food, such as canned and frozen foods, fresh fruits and vegetables, and fresh and prepared meats, fish, and poultry, except convenience stores. Included in this class are meat and seafood markets, delicatessen-type establishments, and establishments retailing baked goods (not for immediate consumption and made off-premises).

Hand car wash means any establishment where employees of the establishment wash or detail motor vehicles by hand inside a building.

Health and fitness center means a building or portion of a building used primarily for the conduct of any combination of sports, exercise, health education and counseling, or similar activities and any other appropriate uses that support such activities, such as massage, beauty salons, child care, or food services. Health facilities for the exclusive use of hotels, businesses, or building tenants are not health and fitness centers.

Heavy construction business is an establishment that provides heavy nonbuilding construction. Establishments may subcontract all or some of the construction work. Establishments include general contractors, design builders, engineer-constructors, joint-venture contractors, highway and street construction, bridge and tunnel construction, water, sewer, and pipeline construction, power lines, communication and transmission lines, and industrial and other nonbuilding construction. Also included are construction management firms and special trade contractors and subcontractors.

Height of wind energy system means the total vertical distance from the lesser of the crown of the street or the top of the curb to the tip of a wind generator blade when the tip is at its highest point.

Helipad, medical, means an area or structure used and designed to accommodate the landing or takeoff of a single helicopter solely for the emergency transport of patients, staff, organs, and equipment that does not include refueling, maintenance, or repair facilities. The design and construction of the facility shall meet all federal, State and local requirements.

Home occupation means the partial use of a residence for limited nonresidential uses by a resident thereof, which is subordinate and incidental to the use of the dwelling for residential purposes.

Hotel means a building in which lodging is offered to the public for compensation with ingress and egress to the rooms through an inside lobby supervised at all hours.

Impermeable surface means a surface that allows little or no water to be absorbed.

Junkyard means an open area of land and any building or structure that are used primarily for buying, selling, exchanging, storing, bailing, packing, disassembling or handling waste or scrap materials including vehicles, machinery, or equipment not in operable condition, or parts thereof, and other metals, paper, rags, rubber tires, and bottles.

Kennel means any premises, or portion thereof, on which more than 3 dogs, cats or other household domestic animals, over 6 months of age, are kept, or on which more than 2 such animals are maintained, boarded, bred or cared for, in return for remuneration, or are kept for the purpose of sale.

Landscaping means the finishing and adornment of unpaved yard areas. Materials and treatment generally include naturally growing elements such as grass, trees, shrubs, and flowers, as well as accent features and contouring of the earth.

Large vehicle dealer means an establishment retailing larger vehicles that are not sold at a car dealer, such as buses, recreational vehicles (RVs), mobile homes, and trucks, including replacement parts and accessories.

Laundromat means a business that provides self-service type washing, drying and ironing facilities, provided that:

(1)

No more than 4 persons, in addition to 1 owner or manager, are employed on the premises at any given time.

(2)

No pickup or delivery service, or both, are maintained.

Loading space means a space within the principal building or on the same lot, providing for the standing, loading or unloading of motor vehicles with access to a public way.

Local transit systems means the set of operational facilities and infrastructure improvements associated with a transportation system that operates over regular routes and on regular schedules within a local or metropolitan area, including, but not limited to, tracks, shelters, parking, taxi stands, and station buildings that may include limited retail amenities such as ticket sales and other retail uses commonly found in train or bus stations, and areas for loading and unloading passengers.

Lot means a parcel of land that consists of either of the following:

(1)

A single lot of record, which is a single tax parcel; or

(2)

A combination of complete lots of record, which are consolidated into a single tax parcel.

Lot area means the area of a horizontal plane bounded by the lines of a lot.

Lot, buildable, means a parcel of land which meets the minimum zoning requirements for use in the zoning district in which it is located.

Lot, corner, means a lot situated at the intersection of 2 or more streets.

Lot depth means the mean horizontal distance between the front lot line and the rear lot line of a lot measured at the side lot lines.

Lot, interior, means a lot that is not a corner lot.

Lot line, front, means a boundary of a lot that abuts an existing or dedicated public street, or, where no public street exists, is along a public way. On a corner lot, the lot line having the shortest length abutting a street shall be the front lot line.

Lot line, interior, means a lot line which is not a rear lot line and which does not abut a street.

Lot line, rear, means a boundary of a lot that is most distant and nearly parallel to the front lot line. In the case of an irregular lot, a line 10 feet in length within the lot, parallel to and at the maximum distance from the front lot line.

Lot line, side, means a boundary of a lot that is not a front lot line or a rear lot line.

Lot of record means a lot which is part of a subdivision, the plat of which has been recorded in the office of the County Recorder of Deeds, or a parcel of land, the deed of which was recorded in the office of the County Recorder of Deeds prior to the adoption of the Zoning Ordinance of 1946.

Lot, through, means a lot having a pair of opposite lot lines along 2 more-or-less parallel streets and that is not a corner lot. Both lot lines along streets shall be deemed front lot lines.

Lot width means the minimum horizontal distance between the side lot lines of a lot measured at the narrowest width within the defined buildable area.

Machinery related contractor is a contractor that installs or utilizes specialized machinery not generally used by other building or trade contractors such as building equipment and machinery installation, excavation, water well drilling, wrecking and demolition, structural steel erection, and other similar contractors.

Marine craft dealer means an establishment retailing boats, personal watercraft, outboard motors, and boat trailers, including replacement parts and accessories for such craft and other related marine equipment supplies.

Medical cannabis cultivation center means a facility operated by an organization or business that is registered by the Illinois Department of Agriculture to perform necessary activities to provide only registered medical cannabis dispensing organizations with usable medical cannabis.

Microbrewery, microdistillery and micro-winery means an alcoholic beverage production facility that does not exceed 50,000 gallons a year with a tap room.

Mortuary means a building used only for the storage and preparation of bodies until burial or cremation.

Motor vehicle parts and accessories store means any building used for the display and retail sale of motor vehicle parts and accessories.

Motorbike, ATV, and other similar vehicle dealer means an establishment retailing motor vehicles with less than 150 cubic centimeter piston displacement engines such as motor scooters, motor bikes, mopeds, and off-road all terrain vehicles, including replacement parts and accessories. For retailing of motor vehicles with piston displacement engines of 150 cubic centimeters or more, see car dealer.

Nameplate capacity means the maximum rated electrical output of a generator under specific conditions designated by the manufacturer. Generator nameplate capacity is usually indicated in units of kilovolt-amperes (kVA) and in kilowatts (kW) on a nameplate physically attached to the generator. "Rated capacity" is often used synonymously with "nameplate capacity."

Nonconforming building or structure means any building or structure that does not comply with all the regulations of this chapter, or of any amendment to this chapter, governing bulk of the zoning district in which such building or structure is located.

Nonconforming lot means a lot whose width, area, or other dimension does not conform to the regulations of this chapter.

Office and administrative services means an establishment that: a) provides day-to-day office administrative services, such as financial planning, billing, record keeping, personnel employment, and logistics; b) holds securities (or other equity interests) of companies in order to own a controlling interest or influence management decisions; c) oversee and administer a company often by providing strategic or organizational planning; or d) provides other administrative services not classified elsewhere. Only use this classification for stand-alone establishments which, although they may be part of a larger company, are separate from the actual goods or services producing facilities. The activities of these establishments could apply equally to a manufacturing company, a law firm, etc.

Parking lot means an open area at grade, other than a street, used for the parking of motor vehicles.

Parking lot, deficient, means a lot that meets the surfacing requirements of this chapter but may be deficient in 1 of the following: curbing, striping, handicapped parking, drainage, detention of stormwater runoff, landscaping, regulatory signing, or any other provision of this chapter.

Parking lot, unimproved, means a lot that does not meet the surfacing requirements of this chapter.

Parking space means an area reserved for the parking of 1 motor vehicle.

Particulate matter means finely divided solid or liquid matter, other than water, which is released into the atmosphere.

Party wall means a vertical wall dividing 2 occupiable units.

Performance standard means criteria established for regulatory purposes to determine levels of noise, vibration, smoke and particulate matter, odors, radioactivity materials and hazards or glare or heat generated by or inherent in uses of land or buildings.

Person means a natural person, heirs, executors, administrators, or assigns, and includes a firm, partnership, or corporation, its or their successors or assigns, or the agent of any of the aforesaid.

Pet services means an establishment that provides services to animals (except veterinary) such as clipping, bathing and training. No boarding shall be permitted.

Planned development (PD) means a development guided by a total design plan with 1 or more principal buildings or planned and constructed as a unified development where specific regulations of the zoning district or the subdivision or sign chapters are modified to allow flexibility and creativity in site and building design.

Public safety use means a government-owned or private establishment providing fire, rescue, police, or emergency response services.

Public works facility means a facility operated by a public utility or unit of government, including offices, storage, testing, repairing, and servicing activities, but not including off-site electrical generation, manufacturing plants or storage facilities for natural or artificial gas, and batch-mixing plants for asphalt or portland cement concrete.

Recreational vehicle means a camping trailer, motor home, mini motor home, travel trailer, truck camper, or van camper, all as defined in the Illinois Motor Vehicle Code, 625 ILCS 5/1-100 et seq., used primarily for recreational purposes and not used commercially or owned by a commercial business.

Religious assembly means a use located in a permanent building that provides regular organized religious worship and related incidental activities such as churches, temples, synagogues, mosques, etc.

Residence means a building or portion thereof designed or used exclusively for residential purposes, including detached, townhouse, and multifamily residences, congregate living facilities, and elderly and disabled housing but not including assisted-living facilities, skilled nursing facilities, hotels, or dormitories.

Residence, detached, means a building containing 1 residential unit only.

Residence, multifamily, means a building containing 2 or more residential units except townhouses.

Residence, townhouse, means 2 or more residential units attached side by side.

Residential unit means 1 or more rooms which are arranged, designed or used as living quarters as a single housekeeping unit. A residential unit includes bathroom and kitchen facilities in addition to sleeping and living areas.

Restaurant, carryout, means any establishment where the primary purpose of the operation is the preparation and service of food and/or beverages for immediate consumption off the premises; however, up to 5 seats may be provided for patrons.

Restaurant, limited service, means an establishment that provides food services (except carryout restaurants) where patrons order or select items and pay before eating, including cafeterias, which use cafeteria-style serving equipment, a refrigerated area, and self-service beverage dispensing equipment, and which display food and drink items in a continuous cafeteria line. Some establishments in this subcategory may provide food services in combination with selling alcoholic beverages.

Restaurant, full-service, means an establishment that provides food services to patrons who order and are served while seated and pay after eating. They may provide this service in combination with selling alcoholic beverages, providing carryout services, or presenting live nontheatrical entertainment. Banquet halls with catering staff are considered a full-service restaurant for the purpose of this ordinance.

Retail merchandising unit (RMU) means an outdoor, freestanding fixture to be used for the sale of goods and services, informational purposes, including new product launches, community service announcements, or other similar activities.

Road materials recycling means a general process that crushes or grinds recycled material and/or road material allowing for its incorporation in concrete or asphalt production and any associated machinery, which must have permanent power and foundations.

School, alternate education, means a publicly operated educational facility working with local school districts to provide services to students in a small, highly structured, non-traditional education setting. Such facilities are designed to provide special educational services to students that have difficulty learning in a traditional school setting or require a highly structured program, or to provide a curriculum that is specifically designed to meet the educational or developmental needs of a student.

School, technical and trade, means a school that offers vocational and technical training in a variety of technical subjects and trades, which may lead to job-specific certification other than the associate, baccalaureate, or graduate degree levels. Operation of the school shall not involve increased danger of fire and explosion, noise, vibration, smoke, dust, odor, glare, heat, or other objectionable influences (except as provided for by the performance standards in industrial districts).

Self-service storage facility means a building or group of buildings divided into separate compartments used to meet the temporary storage needs of small businesses and residential users, and may include, but not exclusively consist of, outdoor storage of motor vehicles, boats, and boat trailers, subject to the regulations of this chapter, and limited retail sales such as moving supplies, boxes, packing materials, locks, and other similar items.

Services to the elderly and disabled means establishments that serve the elderly and persons with disabilities such as group support and activities, companionship, day care, home care service agencies, etc. but not housing.

Setback means the horizontal distance between a building or structure and another building, structure, property line or other feature.

Sight distance triangle means a volume with a triangular base established at the intersection of two rights-of-way or a street right-of-way and a driveway where obstructions are limited in height or width so as to not obstruct the sight of pedestrians or motorists. The measured distance is the length of the legs of the triangle at grade from the point where the two rights-of-way intersect or where a right-of-way and driveway intersect.

Skilled nursing facility means a facility providing 24-hour skilled nursing care to at least 3 unrelated persons, including nursing homes and convalescent hospitals but not including hospitals, clinics, or similar institutions devoted primarily to the diagnosis and treatment of disease or injury, maternity cases, or mental illness.

Smoke means the visible discharge from a chimney, stack, vent, exhaust or combustion process which is made up of particulate matter.

Special trades contractor is an establishment that specializes in construction activities, such as carpentry, floor, and tile, concrete, electrical, glass and glazing, masonry and drywall, painting and wall covering, plumbing, heating, and air conditioning, and roofing, siding, and sheet metal work. These activities may be subcontracted from builders or general contractors or may be performed directly for project owners. Construction work includes new work, additions, alterations, maintenance, and repairs. Special trade contractors usually work at the job site, although they may have shops for prefabrication and other work.

Specialty food store means a store that primarily retail specialty food items, such as packaged coffee and tea, confectionery products, nuts, spices, and gourmet foods, except beer, wine, and liquor.

Story means that portion of a building included between the surface of any floor and the surface of the floor next above it, or, if there is no floor above it, then the space between the floor and ceiling next above it. A basement more than 50 percent below grade is not a story.

Street means a public right-of-way containing a surface used or intended to be used for vehicular travel that affords the primary means of vehicular access to abutting properties. An alley shall not be considered a street.

Street frontage means all of the property fronting on 1 side of a street between 2 more or less parallel streets, or, in the case of a dead-end street, all of the property along 1 side of the street between an intersecting street and the end of such dead-end street.

Structure means anything that is built or constructed, an edifice or building of any kind, or any piece of work artificially built up or composed of parts joined together in some manner.

Tap room means a facility that allows customers to taste samples of beverage products manufactured on-site and purchase beverage items produced by that producer.

Tax parcel means a parcel of land with a single property identification number (PIN) as assigned by the County. For the purposes of this chapter, tax parcel shall be only the first 10 digits of the PIN.

Townhouse. See Residence, townhouse.

Trailer means any vehicle or portable structure constructed so as to permit temporary occupancy for use as a building or structure in the conduct of a business, trade or occupation and which may be used as a conveyance on streets and highways by its own or other motive power.

Trailer, travel, means a trailer designed and constructed for travel and temporary lodging purposes which is intended for use only for camping, recreational travel or vacation use.

Transit oriented development means a building or combination of buildings, within 2,000 feet of a commuter rail station, that may contain dwelling units and permitted or special uses in a unified development in which there is a significant physical and functional integration of the uses. Such development shall not abut or be across an alley from property zoned in R1 or R2.

Use means the purpose or activity for which the land, or building thereon, is designed, arranged or intended, or for which it is occupied or maintained, and shall include any manner of performance of such activity with respect to the performance standards of this chapter.

Use, lawful, means the use of any building, structure or land that conforms with all of the regulations of this chapter or any amendment to this chapter and which conforms with all of the codes, ordinances and other legal requirements as existing at the time of the enactment of the ordinance from which this chapter is derived, or any amendments thereto, for the structure or land that is being examined.

Use, nonconforming, means the use of any building, structure, or land that does not comply with the regulations of this chapter governing use of the zoning district in which it is located.

Use, permitted, means any use that may be lawfully established provided it conforms with all requirements of this chapter.

Use, principal, means the primary use of land or structures.

Use, special, means a use of land or structures that may be allowed only by special use permit.

Vehicle, motor, means any passenger vehicle, truck, truck-trailer, trailer or semitrailer propelled or drawn by mechanical power.

Vending machine means a machine for dispensing merchandise or services designed to be operated by the customer. For the purposes of this chapter, an automated teller machine is not a vending machine.

Veterinary services means an establishment with licensed practitioners of veterinary medicine, dentistry, or surgery for domestic animals; also included are establishments that provide testing services for licensed veterinary practitioners. Boarding and caring are allowed in conjunction with this use.

Wind energy system means equipment that converts and then stores or transfers energy from the wind into usable form of electrical energy. This equipment includes any base, blade, foundation, generator, nacelle, rotor, tower, transformer, vane, wire, inverter, batteries or other component used in the system.

Yard means an open area on a lot which is unobstructed from the center of the earth to the sky, except as otherwise provided in this chapter.

Yard, corner side, means a side yard which abuts a street.

Yard, front, means a yard extending along the front lot line, which is bounded by the side lot lines, the front lot line and the front yard line.

Yard line means a line in a lot that is parallel to the lot line along which the applicable yard extends and which is not nearer to such lot line at any point than the required depth or width of the applicable yard.

Yard, rear, means a yard extending the full width of the lot on which a building is located and situated between the rear lot line and a line parallel thereto and passing through the nearest point of the building.

Yard, side, means a yard extending along a side lot line, which is bounded by the rear yard line, the front yard line and the side lot line.
