05 - PLANNING AND ZONING COMMISSION
A.
Commission Established. There is a Soldotna planning and zoning commission, which shall consist of not fewer than five nor more than seven regular members, who shall be nominated by the mayor and confirmed by the city council.
1.
Regular members must be residents of the Kenai Peninsula Borough. One regular member may reside outside Soldotna City limits; a second regular member may reside outside of Soldotna City limits provided that such member holds record title to real property located within Soldotna City limits. All other regular members shall reside in Soldotna City limits.
2.
A chair and a vice-chair of the commission shall be selected annually and shall be elected from and by the regular members of the commission.
3.
The mayor and one council member selected by the council shall be ex-officio members of the commission, but they shall have no vote.
4.
Regular members of the commission shall receive seventy-five dollars for each regular meeting, limited to two meetings per month.
B.
Duties and Responsibilities. The commission shall have the following duties and responsibilities:
1.
Develop, alter or revise and propose a comprehensive plan for the physical development of the city. Such plan with accompanying maps, charts and descriptive material shall show the commission's recommendation to the council for the development of the city.
2.
Make a recommendation to the council on the development, location, and sequence of all public improvements including the relocation, removal, extension, or change of use of existing or future public properties, buildings, ways, grounds or spaces.
3.
Act as an advisory commission for the Kenai Peninsula Borough Planning Commission on all platting matters as provided for by the Kenai Peninsula Borough Code of Ordinances.
4.
Perform such duties and exercise such powers as may be delegated to the commission by the Soldotna Municipal Code and the Kenai Peninsula Borough Code of Ordinances.
5.
Make and develop plans for the replanning, improving and redevelopment of any area within the city which may be destroyed in the whole or part or damaged by fire, earthquake or other disaster.
6.
Make investigations and offer recommendations regarding any matter related to the planning of future developments of the city; and
7.
Make studies, surveys, maps and other plans relating to any element of comprehensive planning, including land use, transportation, recreation, housing, economic development, public and community facilities and recommend actions to the city council.
C.
Terms of Commission Members. The following shall govern the terms of commission members:
1.
The term of each appointed regular member of the commission shall be three years and shall be staggered so that one-third, or a number as close to one-third as possible, shall expire every year. Any member who misses three consecutive meetings without being excused shall be subject to removal by the mayor or chair of the commission.
2.
Terms shall commence on January 1st of each year. A vacancy shall be filled in the same manner as an original appointment and shall be for the unexpired term. At any time when the commission consists of fewer than seven regular members, additional members may, but are not required to, be nominated by the mayor and confirmed by the city council.
D.
Proceedings of the Commission. The commission shall establish rules of procedures and there shall be at least one regularly scheduled monthly meeting of the commission that shall be open to the public. Permanent records or minutes shall be kept of the commission's proceedings and such minutes shall record the vote of each member upon every question. Every decision or finding shall immediately be filed in the office of the city clerk and shall be a public record open to inspection by any person. Every decision on platting matters or findings on a matter delegated to commission by the Borough Code of Ordinances shall be immediately filed with the Borough.
E.
Quorum. Four regular members shall constitute a quorum. The affirmative vote of a majority of regular members present at a meeting at which there is a quorum shall be required to take action on any matter before commission.

City Manager and Administrative Officer. The Administrative Officer is the City Manager of the City of Soldotna or a person(s) designated by the City Manager to perform the specific day-to-day duties of administering the zoning code on behalf of the City. However, the City Manager shall not delegate authority to administer and enforce those provisions of the zoning code where the action of the City Manager is specifically required.
B.
Duties of the Administrative Officer. The Administrative Officer shall perform the following duties and responsibilities:
1)
Interpret and enforce the provisions of this zoning code provided that the Administrative Officer shall have no power to change, modify or waive any requirements of this zoning code except where specifically granted by this Code;
2)
Process zoning code, amendments and appeal applications, check plans for conformance to local codes and standard specifications, and coordinate plan reviews by other agencies for compliance with state or federal codes;
3)
Issue zoning permits and certificates of zoning compliance when provisions of this zoning code have been met;
4)
Prepare the meeting agenda and recommendations for the Commission's consideration;
5)
Inspecting buildings or premises necessary to carry out duties in the enforcement of the zoning code;
6)
Maintain records of all matters related to this zoning code. Such records shall be available for public inspections and copies of zoning compliance certificates shall be furnished upon request to any person; and
7)
Provide technical assistance upon request by the Commission.
