ARTICLE XXV
R-3 Multiple Residence District
§ 162-153 Permitted uses.
The specified uses permitted in the R-3 Multiple Residence District shall be the erection, construction, alteration or use of buildings or premises and/or land for multifamily dwellings commonly known as "garden apartments." No other uses, residential, commercial or business, shall be permitted in this district, except as hereinafter provided.
§ 162-154 Area regulations.
Areas, building setback lines and yard provisions required in the R-3 Multiple Residence District for every building or structure hereafter erected, altered or used in whole or in part shall be as follows:
A.
This district shall have a maximum density of 12 apartments per net acre. The term "net acre" means all land exclusive of that dedicated to public streets by an owner.
B.
Said apartment structures shall have a maximum height of two stories above the elevation of the main front entrance. Nothing herein shall be construed to prohibit basements or underground garages, provided that the same comply with the Building Code of the Borough.
§ 162-155 Lot size.
A minimum size lot shall contain 30,000 square feet, and the minimum width of such lot shall be 100 feet.
§ 162-156 Setbacks.
Front yards, side yards or corner and intermediate lots and rear yards shall be the same as provided in R-1 Residence Districts; see § 162-142.
§ 162-157 Street access.
Any building established as part of a garden apartment project which cannot properly be served by emergency or service vehicles from an abutting street shall be made accessible to such vehicles by a paved street having a paved width of not less than 24 feet, exclusive of parking spaces.
§ 162-158 Off-street parking.

A.
Off-street parking established in connection with a garden apartment project shall be of such design, location and arrangement as will not interfere with the access of emergency or service vehicles.
§ 162-159 Sidewalks.
Sidewalks shall be provided in all areas adjacent to streets and off-street parking areas and between apartment structures.
§ 162-160 Location of dwelling structures.
No dwelling structure established as part of a garden apartment project shall be situated on a lot so as to face the rear of another dwelling structure within the development or on adjoining properties.
§ 162-161 Means of egress.
Every dwelling unit shall have a safe and unobstructed means of egress leading to safe and open space at ground level accessible to the street. In each building two or more stories above the grade, the secondary exit from the second story or additional stories shall be made by stairway, fire escape or horizontal passageway providing a safe path of escape in case of emergency.
§ 162-162 Recreation areas.
A.
There is permitted in this district the establishment of recreation areas, amusement devices for children, swimming, if desired, and such other recreational uses not inconsistent with a recreation area; provided, nevertheless, that no recreational facility shall be established as a business venture other than for the use of tenants of the apartments as part of the apartment rental paid.
B.
A recreation site shall be developed with facilities suitable to serve the residents of the apartment project. It shall be located in an area which will not be detrimental to adjacent property owners by virtue of noise, light, glare or any other objectionable feature emanating from such a facility. No recreation area shall be located in front or side yards. At least 20% of the gross area shall be devoted to recreational use.
§ 162-163 Laundry facilities.
No outside area or equipment shall be provided for the hanging or outside airing of laundry in any manner. Sufficient areas and equipment shall be made available within each building for the laundering and artificial drying of laundry for occupants of each building.
§ 162-164 Landscaping.
Where a garden apartment project abuts a residential district, an evergreen planting screen or fence providing visual obstruction shall be provided. The planting material or fence shall be at least four feet high at time of planting, and it shall be the responsibility of the owner or developer to remove trash, garbage and snow and employ a janitor to carry out this program and to promote such maintenance and care as is required to obtain the effect intended by the original plan.
§ 162-164.1 Recyclable materials facility required.

A. MULTIFAMILY HOUSING DEVELOPMENT RECYCLING AREA
As used in this section, the following terms shall have the meanings indicated:
A building containing three or more dwelling units occupied or intended to be occupied by persons living independently of each other or a group of such buildings.
Space allocated for collection and storage of source-separated recyclable materials.
B.
There shall be included in any new multifamily housing development that requires approval from the Borough an indoor or outdoor recycling area for the collection and storage of residentially generated recyclable materials. The dimensions of the recycling area shall be sufficient to accommodate recycling bins consistent with anticipated usage and with current methods of collection in the area in which the project is located. The dimensions of the recycling area and the bins or containers shall be determined in consultation with the Municipal Recycling Coordinator, and shall be consistent with the district recycling plan adopted pursuant to Section 3 of P.L. 1987, c. 102 (N.J.S.A. 13:1E-99.13), and any applicable requirements of the Borough Master Plan as adopted pursuant to Section 26 of P.L. 1987, c. 102.
C.
The recycling area shall be conveniently located for the residential disposition of source-separated recyclable materials, preferably near, but clearly separated from, a refuse dumpster.
D.
The recycling area shall be well lit and shall be safely and easily accessible by recycling personnel and vehicles. Collection vehicles shall be able to access the recycling area without interference from parked cars or other obstacles. Reasonable measures shall be taken to protect the recycling area, and the bins or containers placed therein, against theft of recyclable materials, bins or containers.
E.
The recycling area or the bins or containers placed therein shall be designed so as to provide protection against adverse environmental conditions which might render the collected materials unmarketable. Any bins or containers which are used for the collection of recyclable paper or cardboard, and which are located in an outdoor recycling area, shall be equipped with a lid, or otherwise covered, so as to keep the paper or cardboard dry.
F.
Signs clearly identifying the recycling area and the materials accepted therein shall be posted adjacent to all points of access to the recycling area. Individual bins or containers shall be equipped with signs indicating the materials to be placed therein.
G.
Landscaping and/or fencing shall be provided around any outdoor recycling area and shall be developed in an aesthetically pleasing manner.
§ 162-165 Construction standards.
All buildings erected in a garden apartment project shall be of fire-resistant construction and shall comply with the provisions of the BOCA Basic Fire Prevention Code and the Uniform Construction Code of the State of New Jersey.
